pete dominic is a standup comedian. liz plank is a columnist for "msnbc daily" and author and eugene dales is a co-author of politico. it's exciting to get all of your takes on the lineup tonight. what is your take on this political gamesmanship? could there be benefits to pushing it forward? >> it's the same fight over and over. giving six weeks and going to make it better for the country. you definitely don't want that happening around the holidays when people are needing to spend money, thinking about how strong the economy is, but it does give democrats some time to deal with their infrastructure bill, deal with a build back better agenda. it does give them time to figure that out before they have to deal with this issue. as a country it's not as good that our leaders continue to kick this down the road and the fact that the debt limit is something that was created so that we stop borrowing money, that the government did that less, it doesn't stop us from doing that and it continues to be huge problem and especially

pete, what does this judge's ruling mean for women in texas today? pete, you can't hear me, so i'm going to turn to julia and toss the same question to you. effectively what does this ruling do for people across the state? >> it's a good question because it could be so temporary. we just heard from judge robert pitman last night in the western district of texas. he lifted this, he had addressed an effort for a temporary stay, but it was immediately appealed to the fifth circuit, arguably the most conservative in the country, so they very well could reverse that. in fact they've already had the chance to weigh in on this before and they have said that they've allowed it to go forward. so what this means for women in texas is, yes, for now they may have their rights back, but maybe for a very short glimmer of time, which is hard for women who were maybe trying to make such an important decision. >> and wendy murphy, if you can hear me, and we should say we have been having some technical issues here at msnbc, hopefully our viewers will stay with us, yo

or is it really both here, pete? >> it's both. the supreme court's going to hear both those cases on november 1. that's the lightning speed part of this. the decisions will follow, i suspect, at the court's normal pace, complicated by the fact that on december 1, the court hears the third big abortion case of the term, the direct challenge to roe v. wade on mississippi's law that would ban abortion after 15 weeks. so i think, let's step back here and look as a practical matter, i think as a practical matter, sb 8, the texas law, is going to remain in effect for at least several more months while that's cases work their way through the supreme court, that's point one. point two, they'll hear two lawsuits on november 1. the first one is a state lawsuit filed by abortion providers in texas that challenges the law's constitutionality. so the court will consider that direct, straight-up challenge to the law. secondly, on november 1, the court will consider the separate question of the federal lawsuit. did the federal government have th

i should note pete williams chuckling there audibly on the idea that arrests would come down. kyle, i want to go, politico is looking at a letter saying not to cooperate. president trump is prepared to defend these fundamental privileges in court. nbc news hasn't seen the letter. i literally just got a response from the trump team about 90 seconds ago. i'll read part of it. this is from one of the reps for former president trump saying, quote, the highly partisan communist-style select committee has put forth an outrageous broad records request that lacks legal precedent and legislative merit adding executive privilege will be defended not just on behalf of president trump and his administration but also on behalf of the office of the president of the united states and the future of our nation. the statement goes on to say some stuff about fake news. i'm not going to dignify that by reading it but the point is that they are insistent that they are going to defend what they describe as this -- this request that they say does not have legal or legislative merit. talk about where

pete, the white house rejected donald trump's requests.e national archives then turn over those documents to the january 6th committee? >> reporter: depends on what a federal judge says. there have been three letters from the white house now waving executive privilege. first sort nf response to a request from the committee that the archives be passed along. two other letters include the one last night directly responding to president trump's assertion of executive privilege and the white house saying "we don't agree." the former president asked a federal court to block this because without intervention by the court, the archivist will begin handing them over november 12th. a hearing november 4th evalue ace request. and then wanting to write legislation, needs to have a legislative purpose and has an identified one and secondly, he still has some level of executive privilege even though he's the former president. those are the things that the court will have to work out. this whole idea congress needs a legitimate lawmaking purpose is an ar

"washington post" national reporter carol leonnig. mike, what more can you tell us? >> joe, this is a significant development. as it relates to the january 6 committee, a clash between the biden and trump white houses in terms of what executive privilege means. here is what we just learned. we obtained a letter from the white house counsel to the national archives instructing the release of documents requested by the select committee in a broad request for a wide range of documents relate to the president, president trump's, actions on january 6. according to white house officials, what has happened here is that the request that was made by the committee sought a range of documents relating to president trump's activities on january 6. everything from his phone logs, from photos, from videos produced during the day, everything involving mike pence, former vice president, his activities, his protection. this was the first request made by the select committee after it formed. what happened after that point is the national archives which

and pete is 100% on the law. but the political question about why the supreme court of the united states would bother itself with what is really a fairly trivial procedure question, something that the supreme court really wouldn't be interested in in an ordinary case. and remember, they get so many cases filed every year, they take about 1%, why did they take this one. if what they suggested actually happens and the attorney general can reignite the abortion debate, the attorney general can file an appeal with this supreme court, something that had been precluded by the fact that the 6th circuit struck it down and the attorney general at that time chose not to appeal to the supreme court. so really this is -- my opinion, the supreme court of the united states saying we want this case. we hope to give you the power, mr. attorney general conservative, to go back, relitigate and bring it back to us because we want to uphold this restriction on abortion rights. i think that is what the court was signaling today. >> s
