joining me now, our justice correspondent, pete williams. let's start with the basics here. 2-1 decision in a circuit, and they didn't ask for the full circuit to weigh in. they went ahead with this. >> right. >> doesn't that mean they want to fast-track it to the supreme court? >> it sure does. this is very unusual that the justice department, with less than 24 hours after getting an appeals court decision decide what it was going to do. and it maybe in part what josh earnest said that the government is convinced of the rightness of its argument, but more than anything, it's a desire to get this settled while the president is still in the white house. the other option would have been to go to the full fifth circuit court of appeals and try to get them to rehear the case. but they wouldn't do that unless they were pretty confident they were going to win, and they had a lot of time. they don't have a lot of time. so they took the other option, which is to go right to the supreme court. >> well, isn't it possible that justice roberts says, boy

pete williams, thank you very much. tom costello, one more check-in with you for those flying domestically. what can they expect in terms of the old phrase, leave extra time? >> well, i think probably that's it. for the most part, we are talking about a normal process going through the nation's airports. i think that you may see a little more swabbing of hands to see if anybody has explosive residue on their hands. a little more in terms of roving canines, more dog patrols. as i was at reagan national airport this week, i saw a dog patrol literally stationed at, standing there at the checkpoint where people go through. i've seen roving dogs, many, many, many times here in washington and elsewhere in the country. that's a first time i have seen one just stationary, staying there throughout most of the morning. so i think that the whole system's kind of on a heightened sense right now, but for the most part it's going to be pretty much travel as we have seen for the last 10 or 11 years since 9/11. the one point i will mak

joining me now is nbc news justice correspondent pete williams. pete, can you fill us in on whatever you've been hearing? >> well, kate, no, not really. my sole contact here at the federal authorities and this is very much in the hands of the colorado springs police. earlier, they had not asked for any assistance from the fbi, but a short time ago they did, and the fbi can provide additional manpow manpower, but the whole operation here at this point is totally in the hands of the colorado springs police. this is all happening within their area, they're the ones in charge. it may be that once this is all over, that the fbi can assist in helping to reconstruct what happened inside that building, which is a specialty the fbi has, and also looking into the background of this person, who as far as we know from all the reports, came into the building for some reason today, with a high-powered rifle and has been shooting outside the building. we don't know whether he also shot inside the building. we've heard nothing really of substance really about what
