district court judge robert pitman issued an order suspending the texas law, calling it an offensiveconstitutional rights of women to have abortions. but tonight the appeals court quickly granted texas's request to set aside judge pitman's order for now while the case is reviewed. joining us now is democratic congressman barbara lee of california. i just want to get your reaction to this breaking news. you testified recently about your own experiences. what is your reaction to the latest out of texas? >> well, i'm glad to be with you tonight. sorry about this horrible news that we have just learned. let me tell you, women's lives are at stake. and, you know, women, people all over the country are sick and tired of our lives being in jeopardy in so many ways. it almost feels like the courts and the state laws are just playing games with us. these are our bodies, our lives, and we have the right to make our own personal decisions about our own reproductive health care, including abortions and so for these courts to continue to put women in jeopardy and force them to scramble, who knows

in his 113-page order, judge robert pitman called the law, quote, "an unprecedented and aggressive schemeo deprive its citizens of a significant and well-established constitutional right." as the state of texas appeals, some abortion providers have resumeabortion care that the law had banned. stephanie sy recently traveled to austin and found that, in the five weeks that the law was enforced, it impacted hundreds of women. stephanie: in the last five weeks, sb-8 made texas the hardest place for a woman to get an abortion in america. >> to basically be an enforcer of a rule that i don't agree with. stephanie: marva sadler is the director of clinical services for the nonprofit whole woman's health in texas, an abortion provider. marva: it's been extremely emotional and taxing on our staff and our doctors. stephanie: sb-8 bans abortion as soon as a flutter of cardiac activity can be detected in an ultrasound. that's as early as six weeks into a pregnancy. most women may not even know they're pregnant by then. the texas law gives women an extremely narrow window to legally get an abortion. ma

we just heard from judge robert pitman last night in the western district of texas. he lifted this, he had addressed an effort for a temporary stay, but it was immediately appealed to the fifth circuit, arguably the most conservative in the country, so they very well could reverse that. in fact they've already had the chance to weigh in on this before and they have said that they've allowed it to go forward. so what this means for women in texas is, yes, for now they may have their rights back, but maybe for a very short glimmer of time, which is hard for women who were maybe trying to make such an important decision. >> and wendy murphy, if you can hear me, and we should say we have been having some technical issues here at msnbc, hopefully our viewers will stay with us, you told our team this morning you believed the judge's harsh editorializing in this instance is appropriate. why? >> because i think we've all known from day one that this was extremely clear that it was unconstitutional. like, no one thought this was constitutional ever. and it's so arrogant, fran

last night, judge robert pitman sided with the federal government and granted a temporary restraining order. during a special session last month, texas legislators passed a law that bans abortions once cardiac activity is detected, usually around six weeks before many women know they'r pregnant. it also bans abortions in cases of rape or incest. the law is enforced by allowing private citizens to file a lawsuits against anyone who provides an abortion or asichts a woman in getting one. >> this law took effect september 1, and since that time, there are 130 little babies every day that aren't being aborted in texas. so that's one tangible effect already, already over 4,000, as we speak t passed, abortions in texas have largely stopped, and some women are now traveling to other states to get the procedure. >> last night, we reached out to some of the patients that we had on a waiting list to come in to have abortions today. >> reporter: but other providers are fearful, waiting for a definite ruling. >> it delays people access to safe abortion and displaces them, requires them to travel

but the judge in this case, judge pitman, an obama appointee, he saw through what texas was trying toes this in part, fully aware that depriving its citizens of this right by direct state action would be flagrantly unconstitutional, meaning the right to abortion, the state contrived an unprecedented and transparent statutory scheme to do just that. but the judge went on to note the reality on the ground here for women in texas is that women are still getting abortions. they're just not getting them in texas. women who have the means and opportunity and the money can travel across state lines to places like louisiana and oklahoma to get abortions. and so that was the hook for the justice department to say, hey, look, this affects interstate commerce, commerce between the states, and so therefore the united states has an interest here to get this struck down. the judge was persuaded by that. and for several other reasons noticing that the feds have a federal interest here in protecting a woman's right to an abortion, but i should note, guys, this is just one federal judge in texas. this

the way it's being worded that way, that's what the texas judge, judge pitman initially does, when hentinue to be enforced. and the supreme court also says it's going to defer action on the federal request to put a hold on sb8 until it hears this oral argument. so, it's the -- the only noted opinion here that goes along with this is sonia sotomayor. she says the court is are certainly right to act quickly to take this case. but sheization the supreme court should put sb8 on hold. and acts to protect these women from grave and irreparable harm. and offers cold comfort for texas women seeking abortion care who are entitled to relief now. so, andrea, the supreme court has acted with unusual speed. they don't usually take a case this fast but on november 1, they're going to hear challenges on the law itself. and the question of whether the federal government can even sue texas. >> pete, let me drill down on that for a moment. you point out is the unusual speed. they consider it unusual speed to november 1 hear arguments. that doesn't mean they're going to have a decision anytime soon. and
