it affects what is happening on polk. all the restaurants that used to be there with the 47 licenses are turning into clubs. that needs to stop. they are not bona fided eating places. this legislation should be a blanket moratorium and we have to reduce what is there now to protect this neighborhood. thank you. >> thank you. >> any questions? >> possibly later. >> thank you. >> (inaudible) cornell had a two o'clock meeting, okay, linda chapman for knob hill neighbors. i sent you a copy of restrictions for other districts. which are certainly more strict than what is proposed here. although this is model on some of them. i would like to refer to what happened with student housing. a lot of people discussed in a rationale way with the director that was responsible for a wonderful process. and a few people that didn't want to have controls. and then all of a sudden emerged this thing from staff. we will throw that out and do everything by conditional use. i think you realized and a number of people pointed out, that was not

on polk. i mean, and now those people that stood out, you know, they stayed and duked it out with rents and everything else. i have just feel that you should have at least a dialogue with some of those neighbors that are impacted with them. and make it a little bit so, i think that they are willing to meet with them. but they have this idea that they don't, the residents don't want to talk to them at all or they are totally unreasonable and i don't think that is the case. but i think that before you push this through, listen to what they have to say, because they were there, when polk street was dead. they stood it out, to where, know they probably lost money. what i am afraid of with this moratorium, not only the liquor licenses going up, is the rents are going to go up. because then, only serve kind of use can go in there. i am glad that it is grandfathered in that existing places can keep their serving to two where i see in other districts where a new owner, or a place has been serving to t

the second recommendation has to do with the lower polk alcohol. that new liquor licenses would be allowed with continued use by this commission. however we suggest adding specific findings to allow the cud. and we recommend to amend section 303 of the planning code to add a finding that a new bar is within 100 feet of a parcel on which an existing bar is located. and secondly we recommend that the planning commission adopt a policy that the department's recommendation to you, to this commission, as part of the continual use operation would be disapproval of bars proposed of 100 feet of existing bars. that gives you the exception to recommend or not but our default is disapproval. this would trigger close examination and analaysis of bas in the proposed district. but allows of approval of the planning commission and establishments of areas not permanently saturated and appropriate of new businesses. along those lines i want to make note of the maps that are available for the public. that is that the data we have for the abc licenses is not our data

because you have to look at lower polk from pine to o'farrell. if this map is correct, are there places that you can get a liquor license and kind of the lower polk area? >> you can. >> i just put on the overhead the image that includes the buffer of 100 feet. may be less confusing than the one that shows 300 and 100 and 150. >> okay, but the rud is just covering pine to o'farrell; right? >> the rud is from o'farrell to california. i think 100 feet prohibition would allow new permits to come in. essentially south of post and then on the side streets of polk. so it would allow. and given any existing licenses transferred to other locations within this area, or outside. that would also open up the possibility for new permits to come in. >> right. >> okay. i think the 100 feet is somewhat arbitrary in bad actors or good a actors or competition. but more importantly we should revisit this and we have seen this happen with neighborhoods and bars within 100 feet and doesn't work and revisit it. >> i agree that the sunset is appropriate. and something t

when i am along polk street it's earlier in the day. and looks better than it used to. still has a way to go but it's getting better. i want to find out what is going on with the late-night stuff. for example is it bridge in tunnel or are they people living in the city or people from the neighborhood? >> the polk street just like chestnut street. there are some bars that do bridge and tunnel. i think we have two. and then some bars that do the neighborhood. and then some bars that have a mix of everything. the big problem with, it isn't the bars it's more of who runs the bars. and we have had particularly coming throughout the northern station issue right now. we started a regressive way before saint patty's day, you will get charged with overpouring and can't sellout of bars. there is a lot of stuff going on and not in place since captain (inaudible) has been here for a month. when you talk about how many times out of town with the olympics. the big issue is the restaurants. >> yeah, i heard that. >> and the fact they are coming in under the ospicious of being a restau

street there are about 60 liquor licenses within a 6-block area and 100 on polk street as well. and the neighborhood associations have asked me for a number of years to move forward legislation to deal with the situation. and that legislation is sitting in front of the planning commission. i have proposed not that we cut back in those areas, but that we simply say at this point we feel that is an appropriate level and so we are trying to taylor the legislation to say that the current exuberance is right and we are concerned that a little bit more might create a tipping point that could be detrimental. >> i certainly appreciate that and i think that we want to be helpful to the extent that there are district specific things that need to happen. i also do want to be careful to make sure that we don't you know, shoot ourselves in the foot, the reality is that the night life and entertainment has been an important part of our history in san francisco in the culture and for many of us it is more than just entertainment. i think that for many of us in the lgbtcommunity for instance, t
