the national press club journalism institute is committed to promoting free press worldwide, providing professional development and training services to the journalism community and scholarships to aspiring journalists so we thank them for the work and other service. as the folks in august and we're coming to you live from historic national press club. the perfect setting really for the topic of our discussion tonight which is can a president really rewrite the first amendment? because after all before donald trump famously told us all that is going to utter the p. word, publicly he uttered the l. word, libel on television broadcast. we will look at in a couple of moments. that caught the attention of the people on this panel and the people in our audience and hopefully those of you at home. so we will examine exactly what for both parties standpoint, it's a bipartisan issue, what impact of who's in the white house can have on the public's right of access to information. as rachel mentioned my name is chuck tobin, i'm a partner in a law firm to represent journalists in washington, d.c.

be worse for press access. i think we would be worried, not necessarily about legal cases. i think we would be worried about every day access in the white house, what information we would get. you can just look at both candidates and look at how they are treating the press. >> tellis and accurately. anecdotally. us start with trump. >> trump is pretty vocal. those that cover him. and i have been covering president obama now and hillary clinton. , i thinkt cover him the way i would characterize it, he is out there talking about what he does not like. he is complaining about it. of course, we all hear from people when they don't like stories, but this is part of his campaign now. campaign rhetoric, it is about the media and, "when i get into the white house, i'm going to change things. anecdotally, i will use this example from sunday. he has a traveling press corps. most of the major media outlet, television, print, and radio follow him around, follow both candidates around. seconday, which was the presidential d

from a weekly press briefing is not quite as easy as it is to exclude a member of the press from one of your campaign events. the white house correspondents association is the body, the independent body that selects who sits in the room and where they said. the tougher question i think on hypothetically, what if the word goes out to the press secretary and everyone else that this particular reporter never gets called on, or this particular reporter never gets questions answered, never gets inquiries answered. a much tougher question and that is a question you have experience with because he represented the baltimore sun and it is one of the cases to -- only cases to address that retaliatory behavior. in decision did not turn out the way we would want -- have wanted it to turn out. that case then reporters,that the even though the governor of the state issued a memorandum saying, don't talk to these reporters, don't answer their questions, there was a wholesale ban, like a blacklist of these reporters. the court said you do not have any special right of access to a member of the media

the press. >> you don't think a single question about what james comey did? >> i don't believe so, not the way they are covering it now. the clinton campaign wants to discredit james comey, they put out their machine. the fact of the matter, we don't know the falk of the matter. we have to stay tuned. they cannot say they want fbi to be so transparent and put everything out there when they have really delayed this investigation from the very beginning and have been anything but transparent and that's clinton's team. >> mike isikoff reports they don't know what's in the fbi, huma abedin and former husband anthony weiner, they hadn't even gotten a search warrant. is it possible the coverage, the explosion in the last week, ends up being something that's not that serious? >> it's absolutely possible. it's really a remarkable moment. because one minute, depending on what side of the political spectrum you're on, jim comey is a hero. the next minute he's a fool and vice versa. either the media endorsing his opinion not to prosecute hillary clinton or attacking him

them about the press, and the press needs to definitely take a look at itself and look if there is something to it. there is a cultural mindset that i think even goes across the ideological divide of the mainstream news media. the "wall street journal" editorial page and "the new york times" editorial page agree on certain things like free trade that this crowd feels is, you know, threatening their livelihoods and their country. >> woodruff: at the same time, we know that... you have talked, bob lichter, about the need for american, frankly for journalists to rethink the way we write about, not just donald trump, but the people who have been supporting donald trump. >> i think jim rutenberg was quite right. journalists, national media journalists are part of an elite, and they know government elites, they know business elites, and it's these elites that donald trump is running against, and as a result, he stirs the populism of his supporters who also feel that the elites are running away with the country, although i think it's overstated to say that these are kind of pez ntses with pitchfork

why aren't you doing press conferences.nald trump has not done a press conference in the entire general election, but you don't hear the drum beat. all we're asking for is proportionality and fair coverage. >> i hope you hear that about both candidates needing to provide more access. dan wrote this pointing out hillary clinton has not given a national tv news interview in more than six weeks. he said clinton spoke with the "new york times" and snap chat and sat down with ellen degeneres. but david, the pruth is clinton has been avoiding national television news interviews to a greater extent than trump has been avoiding it. shouldn't hillary clinton in the final days of the campaign provide more access to the media? wouldn't is solve some of the bias claims clinton supporters have about the media? >> look, i'm all in favor of more access to the media. but i don't believe that it would be a corrective in terms of the kinds of coverage she gets. i don't think one follows from the other. look, you covered earlier in your show

, in terms of press requests. my gosh, i have no idea how many of those actually were but we had a team did everything filtered through. i was on the city side. even on the pleased sight of stuff came through my staff, the communications staff. .. we had three main press conferences and the second one was to convey the numbers but also you start thinking of the victims and their families so we had established a hotline for anybody that had information about anybody that was a victim where they could call and we set up a website and they had names of the victims and on there. that became a very tough thing to manage as well because we set up a victims assistance center where the families could go to to get information. some people asked me the mistakes we made, the open mic was on, another was not having a secure location the press could not get to the family because they were trapping people from the car to the building and back so they too, that was over at camping world stadium where we could park without the pr

it's a very unfair press. but one thing i'll say about you, you agree i've been treated unfairly. >> in some cases you have been, in some cases you're too sensitive. we do have a talking points memo tomorrow that will prove some of that. en and you'll be very interested to see what we've come up with. but women, well are tomen are t with this. you're winning with men. but women are big. you're behind with women. are you going to target -- >> i'm not sure i believe it. >> whether you believe it or not, that's what the polling says. do you have any plan to speak to women directly or target them with ads or anything like that? >> i do, but what women want, you know, we do the child care blow gr program that ivanka wanted. i agree with her 100%. they want safety, they want law and order, a police department that's allowed to do its job, they want justice for all. they want a lot of things that everybody else wants, and hillary clinton can't do it. she's been doing this stuff for 30 years and has failed every singl

but the straight press, the regular press, the traditional press has gone through a lot of soul searching campaign, and how to present, how to cover trump. and a lot of outlets that you would never have expected to do this have started to say, to call a lie a lie and to actually take account of reality, instead of he said/she said, everything that comes lightning. >> well, i want to show. we were looking at this today, and there is a gravitational poll that normally happens with normal nominees, and he isn't one, to be sure. but take a look at news coverage here in the day after the election. this is newspaper mentions of these losing nominees, both parties, the day after, in the middle 100s. then to new year's day, the next year, it's down to a handful, down to six, one, the little yellow dot bar you see on the right is the cratering. the question here is, if that's the norm, if that's accurate, if that's fair, then will the press be making a mistake if they cover him, because i don't think you or i would at all believe that it's down to ten reference ifs he's tweeting up a storm or call
