the issue here is university of oklahoma is a public university. a private cleollege company, can a private university expel someone for speech? >> a public university is what we call a state actor. it is subject to the first amendment. the general rule is the vast majority of speech is protected speech. it's true the supreme court has carved out exceptions. one of these is harassment. we see that language in expulsion of this student. the problem with harassment is most citizens have misunderstood what it means. it doesn't subjectively mean i feel harassed. there's a legal definition in the educational context and the supreme court has defined harassment in the student to student educational context as something that's severe and nasty but something that goes a step further that bars victims' access to education and that's why this expulsion is certainly in my opinion ripe for a constitutional attack. if ultimately the expulsion stays and they're not allowed to return to school. >> do you think that someon is going to bring a challenge to this? the

university of oklahoma? things like this spread across social media, and one of the things that struck me very -- a very public letter written by the president of another chapter at the university of oklahoma, the president of five delta theta, an african-american member of the greek system. made some outstanding points and i encourage folks to find acting medications on facebook, or twitter. he talked about how the afghan american and the greek experience -- african-american experience any greek experience are one or him at the diversity of oklahoma. he rejected the thought that sigma alpha epsilon was representative of the university of oklahoma, what happened in that video or, in the broader context of the greek world at large. he talked about how the media focuses on that outlying events instead of small, daily acts that fraternity and sorority members do to help their communities every day. we have gotten far more attention for a stated of video that for the efforts than the students took to raise half $1 million for a local hospital. host: some critics saying this is not necessarily an outlier of evidenc

the university of oklahoma is funded by the public, us.ren't the public rules, you can say anything as vile as you want but you can't get fired for it or can you extend it to expelled? >> you can extend it to expelled and i do believe the university acted responsibly and appropriately and legally. here's why. first of all, privilege, not a right to attend the university. you have no right. they admit you. when they admit you, you are bound by the student rules of conduct. that rule of conduct balances your private right to act as you wish. that thing we call the constitution, of course, we have free speech. but that free speech is limited. and remember, there's something called the tinker test, 1969 supreme court decision. and that decision says as a public school, in the event that something occurs by manner of speech which impairs or otherwise affects higher education or education in general, the university can act. they did that here. i think they're protected. >> so let me read the students rights and responsibility code. it's a little

the state set aside $50,000 for the college, and $6,000 a year, which made it the best funded public university in the united states of america. this 1846 plaque shows the area that had been set aside for the state college within the city on the bank of the river. lots of great architectural drawings. this is a joint of the courthouse and post office. it dates to 1870. this was the first eight federal construction project during reconstruction in columbia. much of the city have been devastated by fire in 1865, but this was the federal government's efforts to have a nice architectural presence in the city. that building is now city hall and still located here. i think an architectural record is a viable part of the states passed. especially if you have various renditions of a certain building. it gives you an idea what the architect was thinking at the time, how architecture was meant to be emblematic of certain purposes of state government and this building in particular is a beautiful structure that the federal government put money into to make a presence as the city had been devastated by war

. >> students at public universities have free speech rights.ey had threatened a specific person that would be different. but nearly uttering even offensive racist speech is protected by first amendment. >> that was gabe gutierrez reporting. overnight, the ou president announced the creation of a vice president of diversity position at the university. >>> well let's look at this a police chase ended with a car crashing into a fire truck. los angeles police were chasing two suspects when their car slammed into the back of that fire truck. the truck was sent careening into a yard. the car caught fire and the fire fighters got out of their truck and started battling the flames. one person was killed another injured. at least two firefighters had minor injuries. >>> a 2-year-old was rescued after falling down a hole in a backyard. it happened near colorado springs. the child somehow fell about 15 feet into a sump pump hole and almost drowned. neighbors called for help and when firefighters got there, they lowered ropes and harnesses into the hole. >
