randy: thank you. right now, the driver charged in a deadly crash at a newton restaurant is facing a new lawsuit from the family of one of the victims. the eye's sera congi is at that restaurant, sweet tomatoes, with the latest developments. sera: randy, the crash happened in march. you can still see the front of the store is boarded up. and now one of the victims, one of the -- the husband of one of the victims is now filing a wrongful death lawsuit. eleanor miele and gregory morin were both killed when the s.u.v. plowed into sweet tomatoes. seven others were hurt. our media partner wicked local reports miele's husband george is seeking compensation from the driver bradford casler. the lawsuit seeks damages for alleged negligence and compensation for personal loss. years or more to resolve if it is not settled. the driver, bradford casler, is facing criminal charges. he pleaded not guilty to motor vehicle homicide and due back in court in december. emily: sera, thank you. new this morning, congressman

randy: i'm randy price. we'll get to mike wankum with the storm's track at this hour. mike? mike: it looks like the storm has weakened a little bit. anything category three and above is considered a major hurricane. look at that eye. it is just offshore. the strongest winds are these bands you see right here. those are 10 to 12 miles offshore. let's check out the winds that are happening at this moment. the we had wind gusts over 70 miles an hour. now the melbourne area, 64-mile-an-hour winds. no reports from cocoa beach right now. as you travel up the coast, less wind gusts, but those will be picking up. i think this is aiming more toward daytona beach as we head to the afternoon. we see those category three winds continuing through the day today. its position at 2:00 in the afternoon. it continues to work its way along the carolina coast, pushing offshore. in boston, warming to the upper 60's. some areas away from the coast will be in the 70's today. looking like beautiful weather we have to deal with. early on a friday morning, i hope things are going well, olessa. olessa
