we have this developing story and allie rasmus is in morgan hill with how the community is reacting to all of this but first let's start with tara moriarty, you are at the santa clara's main jail in san jose, tara? >> yes, we were the only people here when the sheriff let the suspect out of the building and we found court documents and found antolin garcia-torres has been in trouble before. he was arrested for trouble with a peace officers. they are trying to find out sierra lemar's location. around 9:00 last night antolin garcia-torres was escorted out of the sheriff's office and to the main jail and they booked him on charges of kidnapping and murder. >> we have evidence that leads us to believe and we have probable cause to believe that he has committed the murder and kidnapping. we are charging him with murder and it is very difficult, it's very difficult to come to that position where we believe she is not alive. >> reporter: now deputies arrested antolin garcia-torres around 5:30 6:00 last night. we know he used to working at the store and was well-liked by co-workers. he was the

allie rasmus has been there since 4:30.eporter: the house at the center of this homicide investigation is behind us. this is omega avenue in castro valley. you can see the street is still blocked off. the body of the man in his 20s, it's the house with the blue trill. about 20 minutes ago, the coroner removed the body from the home. neighbors tell us that a mom, her adult son and daughter have lived in the house for the last 20 years. the mom, according to neighbors, was on vacation in reno but her son was still at hole. at this point, we don't know the identity of the victim. we depth know if the victim of this homicide is a family member. was able to speak to the daughter who lives here, when i asked her if everyone was okay, she samemy said she -- simply said she did not want to comment about what happened. the sheriff's spokesman says one of the people who live in -- who lives in this house is on probation. he wouldn't say what for but because of the status, dupes were able to walk in the house and they saw blood in the

ktvu's allie rasmus joining us live this morning from the scene to explain.llie. >> reporter: firefighters are getting a handle on this fire. half hour ago we saw three of their ladder trucks out here. now they have just got two. their water cannons or hoses are still aimed at the top of this building. they are still tackling some of the hot spots here. the first crews arriving on the scene reported seeing flames coming from this building, hundred-year-old building that stretched 15 to 20 feet into the air. this was a 3-alarm fire at its worst when the fire started just after 4:00 this morning. luckily no one was inside the building, no firefighters were hurt tackling it. although they did mention it was a challenge for them to get access to this old building. it is a very long brick structure. it extends all the way to a block behind it where there are a lot of apartments and homes. so neighbors in that area watched this fire nervously hoping it wouldn't spread. >> i woke up to some sort of noise outside and i just looked across the street and saw huge flame

allie rasmus is live with more. >> reporter: behind us is the headquarters for the p.u.c. in san francisco. they are the agency that fine pg&e for what happened with the san bruno pipeline disaster. the agency has not fined the utility yet. but if and when they do, they want the money to go toward rebilling the old pipelines. pg&e expects to pay anywhere from $2 million to $25 million. under california law, the money from those fines usually go into the state's general fund. but assemblyman hill filed a bill that would require the money from pg&e fines to repave the gas like systems in northern california. >> to me it's aren't the rate systems, the people within is the -- the people within the service area -- we're ones who have been the victims. >> we support the concept. we see this as an opportunity to improve pipeline safety. >> all of the fines. >> reporter: now, assemblyman hill says if pg&e is able to use the fine money to improve the pipeline system right away, the utility wouldn't have to take out as much money alone and the cost of those loans wouldn't be passed
