let's turn to rick leventhal who's live for us this afternoon in newark, new jersey, where i promise is not yet nighttime. there's just a lot of light going on there. what happened in court today, rick? >> reporter: it was a very brief appearance, shepard. ali mohammed brown was maybe in court two minutes and spoke two words when the judge greeted him directly. he said good morning. the self-described devout muslim had plenty to say to investigators last summer. brown telling detectives and prosecutors, quote, my mission is vengeance for the lives, millions of lives lost every day, iraq, syria, afghanistan. all these places where innocent lives are being taken every single day. this is why this happened in west orange, referring to the ten bullets he fired at 19-year-old brendan tevlin, hitting him eight times. tevlin was simply driving home for a friend's home. brown hoped to travel to syria or iraq and join the fight but instead he will likely spend the rest of his life behind bars. >> and he's still facing charges in washington state, right? >> reporter: yeah. once brown is tried

rick leventhal with the news outside the courthouse. that brady's side had an offer on the table. do we know anything more about that? >> we're hearing that brady agreed to a one-game suspension instead of four if he didn't have to admit to any knowledge of any plot to deflate any footballs only that he failed to cooperate with investigators by not turning over his cell phone. and the nfl refused to give in on this point and the nfl attorney in court today made it clear why. the league believes that brady lied under oath right to the commissioner's face. the league says brady absolutely knew about the deflation of balls, that it wouldn't have happened without his direction and he should be punished for damaging the integrity of the game. daniel wallach still thinks brady will win. >> historically they side with arbitration awards 90% of the time. but this case is not like other arbitration cases. >> wallach is confident that you can go ahead and draft brady for your fantasy football team, shep. >> isn't he? >> and the union argues this

senior correspondent rick leventhal is trying to piece things together for us tonight. >> reporter: the call came into nashville metro police as an active shooter situation. fortunately for theater goers and staff at the hickory hollows cinemas, the gunman didn't pull his trigger until officers arrived on scene. the only person shot was the suspect, a 51-year-old local white male whose name has not been released. this happened around 1:00 p.m. local time when officers were responding to a car accident heard there was a man with a gun inside the theater where "mad max" was playing. the officers ran inside and after clearing the projector room one of the cops encountered the suspect who raised the gun at the officer and pulled the trigger according to a police spokesman. the officer returned fire at the suspect and retreated. officers found a man and woman fleeing out the front door all of them doused with pepper spray. the male victim had a superficial wound to his shoulder or arm where the suspect had hit him with an ax or hatchet. that's when the s.w.a.t. team moved in donning gas mask

correspondent rick leventhal in virginia with the latest. >> we are just across the street from bridgewater the shooting went down at 6:45 a.m. alison parker and adam ward were filming and interviewing about tourism in the 50 anniversary during the live broadcast, a former reporter at the same station, vester flanagan, approach, pointed his handgun at parker and the lowered it and appeared to wait for the cameraman to pan back and get him in the frame and that is when flanagan began to shoot, firing at least 15 rounds, killing parker who tried to run, killing ward and will wounded him who is being treated in stable condition. we know how that played out because flanagan shot video of the shooting, apparently on his phone and then posted it on his facebook page. he shot the video with his left hand and shot the gun with his right. he fled the scene. he live tweeted about the shooting and had a 23 page manifesto to abc news claiming that the murders were retaliation for the charleston church shootings, saying that the hollow point bullets had the victim's initials on them. and he said that he

rick leventhal joins us live with the latest. >> reporter: this was our first good look at david sweathe was shot twice in the back. today the convicted killer was brought to the clinton county courthouse to answer charges related i arrived with chains on his hands and feet wearing a green prison jumpsuit and a goatee. when asked if the court appointed attorney represented him, he said yes, he does. he faces two first degree escape charges and a third count of promoting contraband. i asked the d.a. andrew wily why they're pursuing charges against a man who is already serving life in prison without parole. >> the point is that david sweat and richard matt committed a crime in clinton county. they committed a crime of escape in the first degree. it's my jobs a the prosecutor in this county to prosecute people that commit crimes within this county. >> reporter: sweat escaped from the maximum security clinton correction correctional facility with richard matt and managed to taste freedom for three weeks. matt was killed by a tactical team on june 20th. sweat caught a couple days later. his

fox news rick leventhal at the airport. rick?eta, port authority police source tell me these drones are growing nuisance and serious threat to safety and security. latest sightings come at the same time local homeland security be on alert for aircraft advance terrorists. drones present detection challenges. this weekend saw four more drone incidents at new york and jersey airport. two of them on friday one of them involving a delta jet on approach with a pilot spotting unmanned aircraft up. a couple miles earlier a jetblue pilot spotted a drone on approach in the area. sunday evening the crew of flight. spotted a drone as plane was landing on runway 13 left. all three of those planes did land safely. sunday a pilot at sea well regional airport in new jersey got a scare. he says he had to make a turn to avoid a drone that was flying in his path. the faa is, of course, investigating all these incidents, they get about 25 of them every month. chuck schumer says he knows a way to fix. this he says that the recent sightings should ser

jeff flock is at newark -- rick leventhal is at the airport where drones are buzzing over his head. >probably inevitable, melissa. four different pilots, four different aircraft, on approach, saw unmanned aircraft flying way too close. we asked faa what kind of drones and how close they were to the commercial flights but we haven't heard back yet. the planes were some 8 to 13 miles from the runway, beyond the five-mile faa restricted area but flying at two to three how feet when crews on board spotted drones which are not allowed higher than 400-foot sealing. faa has authority to levy significant fines to anyone that operate as unmanned aircraft unsafely and fed and state authorities could bring charges as well. more than a million drones have been sold past few years. there is a lot of concern that a major accident could be inevitable, considering the bird strikes are very common. more than 11,000 in 2013 alone. 600 of them damaging. when birds get sucked in engines and engines can explode and planes are forced to make emergency landings. the fame must one was "miracle on the hudson"
