cory gardner, ben sasse, rob portman.verstate what mitt romney has done, but, i mean, if he can't get this establishment wing on board for 2020, that is a potential problem for president trump. >> exactly. what i found interesting, too, in the interview is that where he was the most forceful and confident is when he was speaking about foreign policy. and i think that's really where he's going to try to make his mark in the senate. sources have told me that he is angling for a spot on the senate foreign relations committee, which would naturally give that platform to talk about russia and north korea, particularly if the president shows some signs of cozying up to russia as he has previously on that issue. but just the whole thing i find pretty remarkable. because there is this time-honored tradition of senators keeping their head down once elected to the senate. you know, al franken, for instance. >> and hillary clinton for a while. >> and hillary clinton for a while, as well. and clearly, mitt romney is not taking that.

rob portman has more than a dozen co-sponsors for his bill to prevent shutdowns and mark warner has awith a catchier name. the stop stupidity act. and something tells me if lawmakers were the ones not getting paid in the shutdown instead of federal workers, it would happen a lot less. that's the idea behind a proposal, "no budget, no pay." even president trump thinks chances are less than 50/50 they'll get a deal done. here's what's clear. as long as hyperpartisan media is fanning the flames, it's going to be an uphill climb. case in point, the president claimed ten times over 22 days of the shutdown that women had been found bound and gagged by smugglers at the border. but the agency was scrambling for information to back up the president's claims. we haven't been able to review that e-mail. but we need to have a fact-based, not fear-fueled debate on these issues if we're going to make any bipartisan progress. and president trump isn't helping. and that's your reality check. >> we cannot argue with a fact-based argument. that is -- that's great. and also i think it's so great you poi

>> guest: there are a number of bills, rob portman puts in legislation. a number of people who put in legislation that would avert a shut that when option would be, even though the government would function, you don't write new contracts and whatnot. you would atn' least make sure workers who ared doing work we get paid throughout.e in fact, there's legislation now that would make the coast guard which is part of the department of homeland security but shares this dual role as a military branch, they are on duty without getting paid and there's a bill to make sure that they will continue or will get paid during the shutdown like the rest of the military who stunningly secured last year. those issues, legislation has been out there, pops up before, during, and afteror every shutdown. we go through this conversation picked up on this during a shutdown they just never pass. after shipment if one says that was so bad let's never do it again, we don't worry about that legislation, and you are secured after the last big shutdown in the middle of it again and lo

it's to the point where some centrists, senator rob portman among them, have suggested that they mayo outlaw shutdowns altogether. you've covered all of these issues for a really long time. do you think that that's a plausible scenario? on the one hand it makes sense to me. on the other hand, to a certain extent congress would be limiting their own power if they did that. >> they would be limiting their own power to use suicide as a weapon. that is, it's doable. they can simply say in the event there's no appropriation going forward, you go to an automatic continuing resolution, it can be down 5% across government spending. but it's doable legally. and congress has been so busy offloading its powers and responsibilities to the executive branch that one more wouldn't give them pause. >> it certainly would, eddie, at least eliminate a lot of stress from my life as a congressional reporter. but do you think this would make sense in the long run for congress to do? >> yes. i think it's important for us to end this spectacles holding federal workers hostage for particular political agenda

i was watching senator rob portman with neil cavuto. he is a moderate guy. he said the president has been bending on this and democrats haven't given anything and new barriers are exactly what the democrats want in terms of border security. so if that's true and if you believe that, this comes down to personality, does it not? >> it comes down to personality. i think the democrats are dug in. it is also with semantics. the secure fence act that passed in 2006 that passed schumer, barack obama and hillary clinton voted for it and it's an important point. the steel barrier, the fencing they call it, that is down at the border most constructed under the obama administration. what we're really talking about are how many more miles of this steel fencing do we want and need down there? our experts tell us 234 miles. it really boils down to that. i think the president has made a very reasonable compromise offering to negotiate on going from concrete to the steel fencing that's already down there. talking about protected -- temporary protected status for people in t
