rosa rosa college students accused of trying to shoot and kill a suspected prostitute were stopped by police and then let go the night of the crime. shooting was at a motel in rohnert park last thursday. they pulled over 22-year-old ronny threadgill and his roommate, sibley, at a fast-food restaurant minutes after the shooting. officers let them go to assist another officer on the call. a surveillance photo shows threadgil near the crime scene and that's what led to the arrest friday. both were training to try out for the school's football team and the coach cannot believe they are lanes of north lanes of interstate 880 are closed after a fatal shooting on the freeway. 880 was shut down after a pedestrian was found dead near the overpass. the san leandro police department is investigating the homicide -- the incident as a homicide. no one has been arrested. again, all north bound lanes are closed. traffic is being diverted off the interstate on to marina boulevard around the scene. we will bring you more details as soon as we get them. >>> 5:01, the time. a three-month-old baby is back with his mother after vallejo police say two men kidnapped the infant. officers arrested john brumfield and michael jones yesterday. they snatched the baby from the grandfather at his home. it appears the suspects were headed toward the greyhound bus station. brumfield was in a relationship with the child's mother burks it remains unclear if he's the child's biological father. >>> a man is at san francisco general hospital after getting swept up in the waves at ocean beach. a kite surfer tried to rescue him but couldn't hold on to his kite and make the rescue. two others managed to pull him out of the water and start cpr before the other men got there. he saw the man struggling in what he described as choppy water. >>> in east san jose police are trying to find the man who shot a man to death in broad day light. it was at the mobile home park around 5:30 yesterday. neighbors heard several shots and saw the man lying in the street. witnesses say the shooter left in a car with several people inside. >>> a young man remains in jail this morning after being formally charged with the murder of a hi ward police officer. 21-year-old mark estrada made his first court appearance yesterday following thursday's killing of sergeant scott lunger. >> we have more. >> the 21-year-old marcus estrada was historic as the judge read the charges against him. the courtroom was packed. >> if you ask teachers neighbors, friends they all say he's too kind. >> court documents reveal estrada is the registered owner of the white truck involved in the shooting. he went to the hospital with a gunshot wound to his side and admitted he was shot while in the driver's side of his truck but he would not say by whom. sergeant lunger's partner fired at the truck. his attorney said it's speculation that his client is guilty. >> we don't know the totality of the circumstances in this case or how those bullets occurred inside of his car. >> police tell me they are not currently looking for other suspects, but investigators still want to talk with the three people seen getting out of this car at estrada's house after the shooting. grieving members of the community continue to bring flowers to the hayward police department. >> it's very hard. we wanted to come and show our respect. >> the senior baseball league will dedicate their game to their teammate. >> he will always be in our dugout and on the field in spirit. >> mark estrada is expected to enter [applause] >> john baner released a statement renewing thoughts for her to turnover her server. >>> the legal recreation use of marijuana. >> and today in the four by four, we're taking a final four minutes and examining steps as california considers making marijuana legal. >> and a one of a kind drone school. today in money business, we're taking a look at the first of its kind university to teach people the ins and outs of unmanned technology. >>> all right. today in the four by four, we're taking four minutes at 4:00 to take a look at the push to legalize recreational marijuana in california. joining me now is dale sky jones, part of commission for cannabis reform. let's talk about your initiative, specifically what it says, kind of the highlights and what separates it from the few other initiatives that are also trying to get on the 2016 ballot. >> i think the most important aspect about reform california is the long view that we've taken. we've been doing our homework for 2 1/2 years now. and it's culminating in the same homework our governor has done in his two years of homework. and what that means is hours of times with stake holders, community leaders, officials, and thought leaders to make sure we're getting this right and for the right reasons. >> and this week, the blue ribbon commission, which the governor led up and down the state, gaining all this impact on this exact issue, came out with dozens of recommendations. really kind of urging tight regulations. i mean, he wants to protect small businesses, protect the youth. i know the lieutenant governor doesn't want this to be the next golf rush. i'll talk about what he said a few days ago about the recommendation. and let's play it. >> as a group, we don't want to maximize revenue and create a in industry for two reasons. both are predicated on heavy use, increasing use. we want, certainly, tax revenue. but it's not a priority, a goal. we're explicit about advertising bans and marketing bans within constitutional guidelines. we're very specific about protecting small cultivators and retailors against the corporateisig of big tobacco. >> those are his comments of not becoming the next next gold rush. >> i think it's exciting for the advocates trying to change cannabis policy to have such a post. the blue ribbon report has given us parameters of whatnot to do and the best way to get it done. number one this, should not be a cash cow. and all that will do is continue to push business in the black market as well. so there are multiple benefits to not turning into into the next cash cow. >> let's talk about the pulse of california. prop 19 back in 2010. i believe we have a graphic here on the results of that. it wasn't a presidential election year. but still californians had the opportunity to vote on whether or not to reelize marijuana. you can see here 53 1/2% said, no way. 46 1/2% said, yes. and then the they put out a poll, 55% of voters said that marijuana should be legalized. do you think the tide is turning? >> the height has changed. and 2010, keep in mind, the first time a lot of it was even asked. a lot of folks were like, what do you mean? [ laughter ] >> the same public policy of california poll showed most parent with children are still opposed to legalizing the recreational use, one being roger morgan. i know he's pushing a measure opposite of yours. he spoke to reporters last week about his measure. let's hear what roger had to say. >> we should be doing everything possible to prevent the use of marijuana, not open the barn door and legalize it so that everybody can get it easier, like alcohol and tobacco. we should have learned something from those two legal drugs that we don't need a third. >> calling marijuana a gateway drug. i think he even referenced later in that interview, his own children in that day were smoking marijuana and eventually went to meth. so .... >> well, it's unfortunate about his children. but let's not forget the bigger picture here. number one, the health organization and institute of medicine have agreed this being a gateway drug is really good marketing in the nixon area. it's false and ingenerallous to think the -- enginous to think the drug dealers will market your children. cannabis is the largest cash crop in california. we should be enjoying the tax dollars and benefits of this, not building more prisons but schools. and education will be the key to keep people off of drugs. and, you know, frankly just contributing members of society. >> what about washington, colorado? there are opponents that have said since it's legal in the state that the black market has not reduced but spiked. and i mean specifically the sales to minors. people growing marijuana in those states and then packing up to states where it's illegal and selling the marijuana. have you learned some things from colorado and washington? >> well, i'd like to see the proof indicating that the black market has even stayed the same, never mind increased. i think this is the same disengeneral white house scare tactics. but we do know -- disengenuous scare tactics. and even if you are concerned about emergency room visits, it's important to find that cannabis is not lethal. so they're walking out of the emergency room unlike the prescription pill epidemic we are. this is an opportunity to have safer communities if we control cannabis for adulters. >> so the language -- adults. >> so is the language finalized? "today in the bay" tracie potts live in washington, d.c. this morning with the latest. we've seen a lot of developments this morning, tracie. >> reporter: right. and it looks like there may be no shooter there. the latest information that we are he' getting, laura, from authorities, they've done a first entire sweep of the place and there was no active shooter, no one found with a gun, no bullet holes seen, no shots heard. the initial report was a possible shots fired, but they haven't found anyone who heard gunshots in that facility. now, the s.w.a.t. team doing ago second team just to be sure about but d.c. ems, the emergency personnel, dozens of ambulances told us that no one there has been treated. that is certainly good news. initially the officials that we talked to there said that they thought it may be a post or a tweet, something online that gave them the concern that there may have been shots fired. there was a heavy response of police, the fbi, ambulances, they even stepped up security at the white house about a mile or so away. they are as far as we know still on lockdown, people were asked to shelter in place. we know now some of them have been evacuated. the good news at this moment it does not appear to be an active shooting situation or possibly shots fired at all, but it is still a developing story, they are still on the scene and still checking out the navy yard which of course raised lots of concerns because of the shooting of 12 people there two years ago in 2013. >> a memory that's etched in the minds of people living in d.c. thank you very much, tracie potts. >>> other big stories we're following at home, san francisco police say they have detained a person of interest in a deadly shooting last night at a popular area it he waterfront, pier 14, a bay area woman died after being shot there in the stomach. right now police say it appears to be a ran tomorrow shooting. >>> three people are hospitalized, one in critical condition after a motorcycle slammed into a group of people last night on san francisco's market street at third. police have not determined what caused that biker to lose control. >>> some action a in the skies over parts of the bay area overnight, light thing storms rolled through some locations, leaving traces of rain in the process as well. >>> some hard to believe new findings in a deadly plane crash back in february. you height remember the video of the plane slipping an overs pass as it crashed after take off in taiwan. unbelievable. 43 people died in that accident. safety council now says the pilot mistakenly switched off the plane's only working engine just seconds before it crashed. one engine had had already malfunctioned. the crew apparently tried but failed to restart the engine that was mistakenly turned off. the plane's captain also apparently failed a training test last year related to engine failures. >>> new video to show you this morning of a tornado whipping through a city in most. you can see the funnel cloud briefly touchdown in the city of lee summit. a major storm pummeled that area bringing heavy rains and high winds. forecasters predict up to 3 inches of rain possible in that region. >>> in washington state firefighters now have the upper hand on a testify stating wildfire, the sleep hey hollow fire now 83% contained. the fire burned about four square miles in the city of want achy and destroyed 23 homes. they believe the fire was caused by human but haven't determined whether it was set on purpose or by accident. >>> we do have some new information regarding that sunol fire that is still going on right now, breaking news. there's our live camera shot. as you can see the smoke still perm yagt above the air there. what we have found out it's still at about 20 ache err, but the belief from alameda county fire is it actually might have been two separate fires that merged and it they think that all the lightning we've seen over the course of the last day might be to blame for that fire. we're still following it to bring you more information. >> we have had quite a few lightning strikes overyiet. want to check in with meteorologist kari hall to see how our weather conditions are holding up. >> we still see some light ming coming down this morning so a major concern for us into this afternoon as well as tomorrow as this monsoonal moisture streams in and we've even seen some lightning for the north bay as well just to the north of santa rosa lot of that rain has been drying up. unfortunately we need that rain, but there may be a slight little bit of hope in the forecast as we go through the day. look at these temperatures now. this is right now in the tri-valley. it's 73 degrees and with the high humidity today our temperatures come down, but that does not mean it will feel that much more comfortable. we will still have a chance of some of those showers and storms popping up today as we break the heat spell that we had the past couple of days. 86 degrees will be the high today in the south bay, with as well as 86 in the north bay. san francisco can expect a high of 72 degrees, a lot more clouds waiting 0 minutes to get on the bridge. it seems to be improving a little bit. and as we get closer to 8:00ing :00, we'll see more improvement. taking a look at 880, it looks good. southbound traffic gets slower as you approach hayward and head into union city. i can show you that on the road sensors. you are seeing a little bit of red there. it's lighter than it usually is. northbound, 101 has been heavy and slow. it's improving a little bit. there was an earlier accident near oakland road. that's gone. 280 and 85 are moderate. back to the desk. >>> hundreds of firefighters are working to contain a wildfire burning near vacaville. it's burning near mixed canyon road and sky ranch. ktvu fox 2's alex savidge is there to tell us about the progress crews have been making and do they know what started the fire? >> reporter: yeah, it appears to be a truck fire that broke out yesterday morning. that's what sparked this wildfire that threatened quite a few homes. i want to get you straight up here to a live picture so you can see what things look like this morning from up above. this is being called the sky fire. it is no longer advancing. that's the good news. calfire is saying the fire is 25% contained. we expect the figure will likely rise as we move throughout the day and crews get another look at the fire. total of about 150 acres have burned so far. this is a remote area that's west of interstate 80 near mix canyon road and sky ranch road. here was the scene yesterday. this fire was fabbed by very strong winds, especially in the afternoon and flames came dangerously close to quite a few homes. crews were on standby to make sure those homes did not burn and in the end, they did -- they did their work and those -- no homes were lost yesterday. this fire started about midmorning. it quickly grew in size. they called in helicopters, air tankers and that air attack brought water and fire retardant and helped out the crews on the ground. neighbors were not forced to evacuate. but there were some people who decided to leave on their own yesterday. the sky fire appears to have been sparked by a pickup truck that either caught fire or threw a spark along a dirt road. >> it's that time of year. it looks drier than july. i live not far from here. i'm accustomed to seeing it a little bit greener than this. this is kind of the situation over most of the state. >> reporter: fire crews in the vacaville area have been very busy over the past couple of days. this is the second big brush fire that's broken out here just since saturday. on saturday afternoon, on the east side of town, there was a large fire, about 300 or so acres that was threatening homes and it broke out on the fourth of july. it appears as though fireworks started that fire. overnight here calfire crews had many of their engines stationed near some of the homes up on mixed canyon road. the homes that were threatened yesterday, just to make sure this fire didn't flare back up and come towards the homes. they were doing structure protection through the night. the good news, they have 25% containment. the fire no longer growing in size. they expect to get more containment through the morning. >> look at the live picture, i can tell there are not many strong winds. is that smell of the smoke still in the neighborhood where you are? >> reporter: yeah. we're down from where the fire is burning. the fire is up in the canyons there. we're sort of down from where it is. we don't have a strong odor of smoke in this area, at least not this morning. in all likelihood, the delta breeze and winds blowing yesterday, probably blew a lot of that smoke out of this area. >> that's good for the crews and the people who live there. thank you. >> reporter: yeah. sure. >> we extra help to firefighters. the system will use drones, planes, satellites to look at wildfire. also, infrared cameras will be mounted. once the system is up and running, researchers say it will be killing a woman on san francisco's waterfront last week, he's been charged with murder. 45-year-old francisco lopez sanchez, he's scheduled to be arraigned today in connection with the death of 32-year-old kathryn steinle last wednesday. now, he's an undocument mnth -- undocumented immigrant. he's been deported five times. he's a repeat drug offender released from jail back on april 15th. signs tonight leland yee is about to take a plea deal in his corruption case. the former state senator is supposed to go on trial in august. but he has a change of plea hearing set for tomorrow. legal experts say federal judges usually do this only when there is some sort of agreement. he is accused of taking bribes for various political favors and attempting to put together a deal to smuggle guns. >>> san francisco police are checking some surveillance video to find out what happened during a reported attack on a muni bus. the incident happened in this area of the western addition neighborhood last week. the original report said a 72- year-old woman was beaten by a younger woman who refused to give up her seat. but now police are telling us that the video shows the older woman throwing the first punch after a long argument. police are still trying to track down the younger woman. >>> california has now one of the strictest schools vaccination laws in the country. the governor signed the hotly debated bill today. >> all of us want to thank you for listening to the science and the people of california who want our state and communities to be safe and healthy. >> state senator dr. richard pan is one of the author of the bills. parents can not get a personal belief exemption for immunization anymore. some say it's about time. opponents aren't giving up. >> i don't vaccinate my children. we have religious beliefs against it. so if they are going to require kids to be vaccinated, then i'll have to end up homeschooling my kids. because that's not something i'm willing to do. records show that the balcony passed inspections less than a year ago. a private structural inspector marked the balcony supports as being in quote good condition along with balcony decks and rails. >>> other bay area headlines, highway 84 in livermore was briefly shut down because of this head-on collision between a box truck and a sedan. the box truck ended up on its side. the chp tells us there were only minor injuries. the highway is back open now. >>> muni fares going up tomorrow. monthly passes are increasing by $3. the fare for youth, senior and disabled riders is going up from 75 cents to a buck. the basic adult fare though remains the same at $2.25. >>> the parents of a 5-year-old belmont boy just filed a discrimination complaint against his catholic school. all because of his haircut. administrators at immaculate heart of mary school called the kindergartner's modern fade hairstyle distracting and in violation of policy. so they sent him home. the family claims the school discriminated against the boy because he is black. the boy's parents decided to send him to a different school. the san francisco archdiocese says they will comment once the case is settled. gouged. >> reporter: he says oil companies are using market manipulation to inflate gas prices artificially this summer. >> the refiners are charging their branded gasoline stations 30 cents more than they are charging two unbranded stations. >> reporter: something he alleges violates federal antitrust law that requires companies charge similar prices for similar products. by charging its own gas stations more he says all station end up charging more. >> this is the longest 30-cent price gap ever in effect between branded and unbranded gas. >> haven't had a chance to look at that specifically. >> reporter: but the energy commission says branded prices are normally higher than unbranded although not this high for this long but blames refinery outages for the prices. >> the refinery explosion was unplanned. >> reporter: but data from the same month shows refine russ also exported 32,000 more barrels of gas overseas this february than last. gas that could have been used to keep prices lower here. >> this is a committee -- >> reporter: information presented today at this commission meeting investigating gas price manipulation and while exporting gas is legal, court contends this summer's high prices are not. consumer watchdog is calling on the attorney general investigate. meanwhile, the industry calls these accusations inflammatory and inaccurate. and points out it has been the subject of dozens of investigations over the past few decades and none found evidence of anticompetitive conduct. >> it's either that or we have to retool the refineries so it's going to be shut down a while right at the height of the driving season they do this maintenance. we have to wonder. >> reporter: court will say listen, they have these planned outages for maintenance and that leads to oakland, by 11 degrees in mountain view. this is just the beginning. we're going to continue to heat up as we get into tuesday and wins. hitting the century mark going above that for our inland cities by tuesday into wednesday. in addition to being hot we're going to be very dry with relative humidity, low in the overnight hours for some areas. thankfully we will have a gradual cooldown as we get wednesday at hayward's chapel of the chimes. friend and family mourning the death of bobbi kristina brown daughter of singer bobby brown and the late whitney houston. brown died yesterday. the 22-year-old was found unresponsive facedown in a bathtub in january. paramedics were able to resuscitate her but she never fully recovered. an autopsy is planned, but authorities say interpreting the findings will be difficult because so much time passed between the time brown was found unresponsive and her death. >>> joe jackson, the father of michael jackson is hospitalized after suffering a stroke in brazil. jackson is in the intensive care unit suffering from an irregular heartbeat. jackson is in brazil in part to celebrate his 87th birthday. media reports say he never made it to his own party. >>> the boy scouts of america is expected to end its ban on openly gay scout leaders in a vote later today. the boy scouts executive board will consider a resolution that was approved by yes, a significant warmup already underway. giving you a live look, the coast is clear around the bay we're clear, and the signs out there are clear that yes, indeed, temperatures are already warming up above yesterday. at the top of the hour, i showed you numbers anywhere from 5 to 10 degrees above what we had at the lunch hour on sunday. here's a look at santa rosa, 87 degrees outside your door, half- moon bay 71. even the coast getting in on this warmup. 76 in san francisco, concord reporting 86, san jose in the upper 70s. so the winds have shifted. we've got that northeasterly breeze in fairfield. over the weekend we were tracking the onshore breeze no longer the case. we do have those dry north winds that are moving in as well. this will add to the increase in fire danger for the next few days. giving you a view from up above and what's happening out there, the trough that was responsible for our relatively mild weather will continue to push east. in its place we have a ridge of high pressure building in, and that means we are going to be heating it up. the sinking air associated with this ridge is really going to warm up those temperatures. we'll keep relative humidity fiberoptic cables that blacked out internet and tv services between northern california and washington state. ktvu cara liu is live in alamo to explain why the fbi is calling this the latest in a series of attacks. >> reporter: the fbi says this is where one of the recent incidents happened near danville boulevard in alamo the second week of june. the fbi now saying at least 11 different cases where vandals targeted fiberoptic cables. internet, tv, and phone services were knocked out for customers in the sacramento and as far north as seattle yesterday. fiberoptic cables were deliberately cut in livermore. workers at a software development company say they were impacted and had to do a lot of their work offline yesterday or use cell phones to connect to the internet wirelessly. >> we never had a problem up until today. not once has it been down. so we are surprised. >> reporter: on its website they wrote the outage effected customers in sacramento and rockland and it was the result of a deliberate act of something cutting three major fiberoptic cables belonging to two companies it contracts with. the fbi has said the cables are about the diameter of a pencil but coated in protective layers. the cables had been intentionally cut. not just in alamo and livermore but fremont, walnut creek, and berkeley. >> cara liu reporting live from alamo this morning. thank you. >>> leland yee appeared in court. today he and three codefendants will appear in federal court to change their pleas. yee's attorney is not commenting. but a spokesman says there have been negotiations and a plea deal is possible. yee was among 27 people arrested early last year in a wide ranging political corruption scandal. >> the oakland city council approved a two year $2.4 million city budget. it calls for 40 additional police officers, oakland hopes to eventually increase the numberover officers which is currently less than 700 to 800. the budget also restores compensation for employees who accepted pay cuts during the recession. now the budget includes more than $450,000 over two years to pay for a brand new department. the department of race and equity would work to prevent racial bias in city policy. this department is scheduled to begin in december. >>> time is 5:05. happening today healdsburg becomes the first city in california to imcrease the legal age -- to increase the legal age to buy cigarettes. it would require anyone buying cigarettes to be 21 years old. the 13 stores that sell cigarettes predict teenagers will be going to neighboring towns to buy tobacco. santa move forward financially. >>> president obama will announce the latest step in a renewed relationship between the u.s. and cuba. the opening of embassy's in washington and havana. the president began the process last december to thaw a 50-year- old long freeze. he also called on congress to lift a trade embar doe but republicans are strongly against that. they say because everything in cuba is state controlled, the money will not help the cuban people. >>> also today authorities may reveal if a fire that destroyed a south carolina church was arson or accident. now i want to show you video now. if you're going to make that ride from the south bay and move up the peninsula, up into san francisco and i know many of you will be doing that, now is a good time to be doing it. highway 101 checked in at 108. clear lake has had 106. concord 105. gilroy 103. and growth that up in lake county another ridiculous high of 107. [ laughter ] it's already 67. the highest low of the year. i dare not even ask about today. dare. dare. it will probably be about 106 and tomorrow we start a cooling trend. 70s for some. 70s for some. on the current temps 50 for others. about a 20-degree spread. heat advisory for inland areas. and there is a lot more on the way coming up from the san joaquin valley and there is a bunch heading up from high desert. and a lot of these are playing into our weather later today. that will give us cloudy skies. delta breeze coming down a little built. a little bit stronger than yesterday 3:not enough to make a difference. 70 ann 80s through the interior. a lot of 80s down on the desert. look at that. it's a pretty big complex. possibility of heavy rain down there. a lot of this will favor areas east and south but we will get the higher clouds. they are already beginning to show up on the forecast model by noon and this afternoon. that may take the high temps down a few degrees for some. i know it's not much consolation but i think yesterday was the hottest day. today might be a little on the humid side and they will roll in on thursday and give us cloudy to mostly cloudy conditions. not only thursday but also into friday as well. and a possibility of some light rain. we'll see. fog, sun, clouds. kind of a mix bag here. cool to hot. depending on your proximity to the coast or inland areas. if the clouds come in a little sooner, some of the 100s could be 5-6-degrees cooler than that. mostly cloudy thursday into friday and early next week looks cool. >> you were talking about rain on friday. >> thursday night, friday is a possibility. >> thunder and lightning. >> possibly. not here but maybe east of us and north. it will be close. >> all right, thank you, steve. >>> it's 5:18. firefighters still battling wild fire south of gilroy that has been burning for more than 12 hours. i want to check in with janine de la vega who is in the area of southern santa clara county. how does it look down there? >> it's still pretty dark but we can certainly smell the smoke. we started smelling it when we were on highway 101 about two miles away from gilroy coming up from san jose. very strong. now the the last update we received from cal fire is so far 50 acres of wild land has burned. the fire started just before 3:30 yesterday afternoon in an area south of gilroy. it's burning in a canyon area with heavy brush. cal fire has 200 firefighters working to bring it under control. so far we are told it is 50% contained. they fought it from the ground and during the day their aircraft provided support. now that it's dark, they can't fly their helicopter. one of the problems is the terrain and the other is the heat. so far no structures are threatened and no one has been injured but firefighters are expecting to be out here fighting this fire and mopping everything up all day today. pam. >> just an extra warning for everybody to be cautious because it is hot. thank you janine. >>> 5:19 is the time. well investigators blame a car for sparking a grass fire near the benicia bridge. flames spread to brush on the side of the road forced two lanes of interstate 680 to be closed during the evening commute. that fire threatened an rv storage facility but crews managed to get it out in time before it damaged there. >>> there was also a fire in nearby cordelia that backed up traffic on 680. that grass fire reported just before 5:30 last night north of lake herman road. the cause of that fire is under investigation. but just a reminder don't through your cigarettes out the window. can i just say? >> good morning to you. i have a good looking traffic report that's what i have. no major issues that we are tracking this morning for really anybody. just a couple of slow spots we will get to those. getting more and more crowded. people are just beginning to start to make that trip into san francisco. so you want to find that window of opportunity. this may be it right now. so make your way to the toll plaza as soon as you can. here we go this is oakland and that is interstate 880 and the headlights are going south. the taillights are going north there. out to the livermore valley we go. this is where you are going to find some pockets of slowing along westbound 580 especially as you come over the altamont pass. it slows down a good deal and then some slowing you will find later on through the livermore area as well. everyone looking pretty good there. boy it is just clear sailing as you head up to san francisco. 5:32 is the time. brian and pam i give it to you. >>> homeless advocates are claiming a minor victory after the berkeley city council tabled a series of ordnances. paul chambers is live in berkeley with the battle ore the city's sidewalks. paul, good morning. >> we have a growing encampment with more things spilling out. lots of complaints from passer byes. >> reporter: that is why the council member wanted -- stronger regulations on using the restroom outdoors. lastly restraining the number of items a person can have on a sidewalk. advocates say the proposals do not take the homeless or their property into consideration. >> we think that is a terrible way to deal with people who are our most vulnerable and most in need. they will not be able to be on the sidewalk under this ordnance. >> reporter: and of course when it was said and done, council members propose the proposals. advocates are -- this is is an issue that we will still continue to follow. >> paul kim pers in berkeley this morning. >> reporter: contractor on the berkeley apartment complex that was the sight of a deadly balcony collapse that will seek a restraining order against investigators. pleasanton based segue construction does not want any evidence tested without its representatives present. legal analysts tell ktvu the request for a restraining order against the district attorney is highly unusual. >> some sort of an order making sure there is no destruction is the most likely thing they will get out of this. this broad brush request for access. broad brush request that they be present when testing takes place. it is just not going to happen be >> segue construction blayed investigators for their handling of evidence from the june 16th incident which included removal of the balcony that collapsed as well as the balcony from the unit below. segue says it was not allowed to examine that debris. the da's office refused to comment. >>> prosecutors say a man charged with stealing and crashing a dump truck has skipped bail. mark edward hill is accused of stealing the truck in san francisco in may. officers spotted him in kolema and chased after him. the truck slammed into several cars and injured three people. he was supposed to appear in court on monday but did not show up. his bond has been revoked. there is a $125,000 bench warrant for his arrest. >>> the mural displayed on the wall outside the galleria depicts a lesbian couple, gay couple, and transgender man. vandals have spray painted over the murals twice before but monday night police say someone burned it. all three incidents are being investigated as hate crimes. the gallery plans to hold off on replacing the mural out of safety concerns. the community forum is scheduled for july 18th. >>> a san francisco teenager has been arrested accused of carrying out a series of armed robbery including one targeting a girl with cerebral palsy. the boy followed the girl off a bus as she was heading for school and robbed her of her iphone at gunpoint. that happened at turk and pierce on june 9th. the other robberies happened in the city's western addition neighborhood. he was booked in juvenile hall on monday under suspicion of the robberies. >>> 13 catalytic converters were stolen mostly from toyotas. the thefts happened between 10:00 p.m. and 6:00 a.m. in the areas of citrus and walnut avenues and springfield drive. thieves might get anywhere from $50-$250 for the parts but for the victims the repairs can cost as much as $5,000. police say the best way for drivers to protect themselves by parking in locked garage or by installing a clamp on to your converter. >>> sexual predator living in walnut creek -- charles chrisman was convicted of several sexual assaults on boys about 25 years ago. now he had been living in walnut creek since february and according to the contra costa times the district attorney would not say exactly how chrisman violated his patrol but it did not involve a minor. a lot of high clouds. >>> welcome back. it's 5:43. for thes in washington have a better handle on that wild fire but it has already questions destroyed 29 homes. the fire is in wenatchee east of seattle. it's 47% contained up from 10% containment yesterday morning. it has burned 3,000 acres. you can see the extensive damage to some is of the homes. nearly 250 firefighters are there on the lines and they say the cause was likely manmade. >>> in arizona family, friends, and residents gather to remember the 19 firefighters who died in prescott trying to fight that fire back in 2013. tuesday marked the second year since they were tragically over taken and killed by that fire. it was the deadliest firefighter incident in the states history. hundreds attended the ceremony which was held at the site of a memorial park that is going to be built to honor those firefighters. >>> a military plane with 122 people on board was having engine trouble before it crash into a neighborhood yesterday. the chief of indonesia's air force says the pilot had told the control tower he needed to turn back to the airport. crews with heavy equipment started to remove the plane which struck a building containing apartments and shops. at least 141 people were killed. >>> the first african american woman to be named senior executive at toyota has resigned following her drug arrest last month. julie halve is accused of receiving of oxycodone in japan through an international parcel service. while the painkiller is legal in the u.s. with a prescription, ox psycho done is categorized as an ill lee narcotic. they have accepted her resignation after considering the concerns and inconvenience that recent events have caused to shareholders. >>> several new state laws go into effect today. one gives millions of additional workers paid six leave. the new law requires employers to give workers at least three paid sick leaves a year. the employee must work for the company for 30 or more days within a year of being hired. workers become eligible after working for the same employer for 90 days. >>> another new law increases over sight on fracking being done in california. fracking is the process of drilling and injecting water into the ground in order to release natural gas. the new law almost require well permits. disclosure of what chemicals are used and studies of fracking impacts. uber and lift that use amateur drivers to transport people for a fee will have to purchase more comprehensive insurance. >>> beginning in january, california school children will be required to be vaccinated unless their parents get a medical exemption. governor jerry brown signed the bill into law yesterday. it eliminates personal and religious belief exemptions for vaccines. now parents can only get an exemption with a legitimate reason. the law comes in the wake of the measles outbreak. >> the courts have been very clear. you don't have a right to spread commune call disease. >> opponents of the bill say they plan to sue the state if their children are not allowed to go to school because they are not vaccinated. california is the third state in the country to require school children to be vaccinated. they do expect more states to follow suit on that. >> certainly a hot topic. i'm within it right now. i'm talking with other parents around my kid's school. >> it's a hot topic. >>> 5:46 is the time right now. let's get you out the door with alex filling in for sal. >> good morning guys. i'm happy to say traffic seems pretty light so far. we always like to knock on the nearest piece of wood we have here. hoping it stays that way. here's what it looks like here as we take you outside to the san mateo bridge. you can see sort of cloudy conditions there. those taillights the folks heading away from you on the screen are going westbound to the peninsula and they seem to be moving at a nice clip this morning. so no issues there. we will also show you the bay bridge toll plaza where you are going to have a lot more company right now as you try to get into san francisco. boy that has filled up pretty quickly here. just within the last 15 minutes or so. a lot more people beginning to make their way up to the pay gates and across the span into san francisco. all right let's go to the maps. i will take you over to the livermore valley where you will find a lot of sluggish traffic. kind of slow. almost off and on all the way from the altamont pass as you come west on 580 and into the dublin area. and it freezes up for you. down south in the south bay, here's an over all picture of the san jose area and there you go right there. no major accidents to report and all the freeways seem to be looking good right now. if you want to make your way up the peninsula, we are not seeing any pockets of slowing along highway 101 so now is a good time to make that ride. your time is 5:48. steve is here. it will be another warm one. >> did you see the sky on the bay bridge toll plaza? >> let me look at it. it's gorgeous. there it is. that is a fantastic shot. you know i'm so focused on the roadway, i need to take some time to look up. >> once in awhile things go pretty fast. take a minute and take a look around. thank you alex. >>> yesterday my goodness, just for some amazingly warm here. livermore was not a record. the record was 112 back in 1972 some of you might remember that. it was still hot at 108. lake port 108. vacaville 107. clearlake checked in at 106. concord 105. gilroy that was a record high. santa rosa 102 and there were a bunch of 97th. although the fog son coast and in the city, michelle said give it a rest fog horns you have been billowing all night. some people love the fog horns but michelle get up and come to work. if that is bothering you that much. 60s and 70s on the temps. it is not 90 degrees. we have a lead story. we have to go to the fountain because that is way warmer than anyone else. west coast pete though we had 5:30 in the morning with 79 degrees and you might be in antioch. i did see upper 70s and low 80s. so very warm there. a lot of high clouds are moving in. heat advisory is out but i believe we topped out yesterday. the cloud cover is streaming in here from the san joaquin valley and southern california and this is all going to take about 5-7 degrees off the inland temps today. there is just too much cloud cover on the way. not a roaring breeze but there is a slightly stronger breeze today. water temps holding steady. maybe coming up a tiny bit but still 54-59.
