unconstitutional -- >> luanne: the ruling could have a major impact on the lives of currently on death row. dana jay joins us live here in the studio with more on the decision. >> reporter: consider the death penalty here in florida on hold for the time being because the u.s. supreme court said the way we decide whether or not someone goes to death row is not constitutional because we leave it up to the judge instead of a jury. the u.s. supreme court today handed down their decision based on a case from the panhandle. in that case, the jury was divided on the death sentence because the judge imposed it anyway and the justice said a system that allows that is unconstitutional. the florida supreme court, lawmakers and the attorney general, have a lot of decisions to make in order to figure out what comes next. >> all of my attorneys are trying to deny the opinion and see if we need a legislative change, whether it will affect people who have been sentenced to death and pending death cases. >> i really like that part of the supreme court statement that yes, juries should be the ones, not indi

then you go to defend people that no one cares about down on death row in alabama. and then you defend the mentally ill. then you defend children across america, 13 year olds, who've been given life without parole, all the way to the supreme court, multiple times, u.s. supreme court. why you? >> i think you grow up poor. you grow up in the segregated parts. and then people come in and change things for you. and you just begin to develop some consciousness that you owe something to somebody. and then, for me, it gets deeper, right? and i didn't appreciate this at the beginning when i went to harvard law school, i'd never met a lawyer. i didn't have any idea what lawyers did, really. i was just tryin' to figure out how to stay in school. and i was really alarmed at the models of advocacy that i was being presented with until i met these lawyers down in the deep south who were animated by the work of defending people on death row. and that starts to kind of accumulate and accumulate. and for me, it just becomes an opportunity to do justice. and i think my whole life, w

inmate. cleaned out instead of 390 inmates on death row, he says, we now have zero. you a supreme court says florida system of sentencing inmates to death row, to death, violates the 6th amendment. florida allows a jury to recommend the death penalty but a judge actually sentences the inmate that is not constitutional according to 8 justices with one dissenting on that opinion. according to judge perry, that means florida's supreme court would have to make what is determination in all 390 of these cases. he says that is a very high bar for the state of florida to reach to execute any of the inmates that are currently on death row. you add to that some of these inmates will likely be eligible for parole on the florida law. and not that they get parole, but technically, they would be eligible. the ripple effect is going to be enormously. over ratification. i got information from state attorney's office in orange county and they are saying that they are reviewing this decision and what the impact will have on any cases that they are working right now. but they say they
