gilroy police heading up that investigation, but because d'arrigo is an officer with san jose, the san jose police department internal affairs division was also involved. now, according to the mercury news, the charges involve a 15- year-old boy and a 17-year-old boy and came after reports of alcohol and minors at the officer's gilroy home. he was arrested yesterday afternoon, but this is not the first time he's been in trouble. >> patrick d'arrigo was a patrol officer from 1994, he was terminated at one point for a botched dui investigation that was in the media. he was reinstated after his decision, his termination decision was overturned by an arbitrator. that was in december of 2010. in january that officer hit the streets again and today he was taken into custody at 3:30. reporter: the mercury news reporting he was also a school resource officer at leland high school from '96 to 2007. again, released early this morning from jail, no word where he is at this hour. san jose police still dealing with the impact this has on their department as this officer now finds himself on the oth

terry mcsweeney is live in san jose with more on the story. >> reporter: down here at south san jose we have a shooting, officer involved. this is the scene. it's not just police department but chp is involved because the task force auto theft task force. they spotted the vehicle, tried to pull it over. at some point one of the officers, they are not sure if it was a san jose officer or a chp officer who actually pulled the trigger that shot the suspect. the suspect in the hospital with non life-threatening injuries and to try to get more details and fill in the blanks. we're joined by officer jose garcia of the san jose police department. the question, what was it these people did that warranted an officer to shoot at them. >> we are still looking what led up to the shooting. i could say two of the officers, one is a san jose officer, 2nd officer is from the california highway patrol. they both discharged their firearms but we don't know if each one struck the 31-year-old. we are still looking what led up to the officers discharging their fire arms. >> reporter: second man in the ca

we begin with a veteran san jose police officer arrested. he is accused of sexually molesting two teenaged boys. this afternoon, he is out on bail, stephanie chuang is in san jose with why this is not the first time he has been in trouble with the law. good afternoon, stephanie. >> reporter: good afternoon, grace. a lot of questions still about patrick's history but we know he has been with san jose police for 16, 17 years and this is the second time he has been the center of an investigation within the past couple of years. veteran san jose cop patrick derego bailed out of jail this morning. 494-year-old spent last night behind bars accused of having sex with two teenaged boys 15 and 17 years old, both live in gilroy where he also lives. he was supposed to work the usual patrols starting at 3:00 yesterday afternoon but was told instead to report to internal affairs where he was arrested by gilroy police. >> he has been placed on administrative leave. >> he has been a patrol officer in san jose since 1994. he works as a cam pusz officer at l

san jose is supposed to be one of the safest cities in the country, but students at san jose state university are on high alert tonight after reports of two attempted sexual assaults on campus in one week. george kiriyama has the new details and joins us live with the latest for us. george? >> reporter: that's right. we're learning some new details regarding the most recent sexual assault that allegedly happened early sunday morning off campus. since this happened off campus, san jose police are handle thing one. they say a man approached two young men from behind and groped them. however, one of the women threw a soda can at the suspect and that caused him to run away. this is the second sexual assault reported in the last week. the other happening on september 5 here on campus. so police say they're not taking this lightly. with friends, but that's not the case right now. >> i'm waiting for my mom to pick me up tonight instead of walking home. she doesn't want me to talk home. >> reporter: because of? >> because of what's been happening lately. >> we always try to do a lot of high visibilit
