in an upscale san ramon neighborhood. kron 4's jeff bush is live in san ramon with the latest. jeff?? the property manager was taken to a local hospital for treatment. no other injuries have been reported. a major crackdown on second hand smoking in walnut creek. the city council initially passed an ordinance tuesday night that would prohibit smoking in all of downtown. and most other public areas in the city. a vote that is drawing mixed reactions. kron four's philippe djegal explains exactly where smoking will be outlawed. and, when the new ordinance could go into effect. soon. this could be illegal and considered an infraction in walnut creek. lighting up and smoking a cigarette downtown. the new ordinance probihits smoking in or near any businesses. outdoor dining areas. all recreational areas. like parks, playgrounds, picnic areas and sports fields. smoking will even be prohibited at multi-unit residential properties. that's apartment complexes, condos and duplexes. smoking on balconies and patios will be against the law. the city council has to vote on the new ordinance o

a stand off we've been following came to an end in san ramon when a shooting suspect surrendered. the man shot through his front door wounding a property manager during an eviction. and live from the scene, we have more from the situation there tonight, christen. >> reporter: the situation is starting to dial down here. you might be able to see one of the few remaining police vehicles that are still out here. we talked with the sheriff's office about 28 minutes ago. they were able to bring the three-hour, 45-minute stand off to a close without further blood shed. the sheriff's office used a vehicle to barb in the suspect's door. once that door had been breached, officers launched pepper gas inside. the suspect surrendered with m minutes. the whole incident started at 1:55 this afternoon when deputies tried to serve an eviction order. that suspect shot one person. they used gas ever trying to negotiate with the man inside. we continued to negotiate and enter into a dialogue with the suspect but it kept breaking down at which time we decided to introduce gas into the residence and a
