front of the santa clara county main jail this morning. there are dozens and dozen of crews and people gathered outside of the jail as we await the release of brock turner, the former stanford student who was convicted of several counts of sexual assault and given a six-month jail sentence which will now end up being three months when he leaves the jail this morning. obviously a lot of interest right now in what's going on. we were told he he will be released any time between 4:30 this morning an 9:00, bob redell is there waiting for the release. that's what the folks told bob could happen this morning and definitely you see the sheriff there. this is clearly a high-profile release for her. she says this is unprecedented. she's never had to have barricades outside the front doors of main jail there in san jose. looks to be some sort of briefing at this point. they're deciding what's going to happen next and how this is going to happen. certainly we're interested as well. >> majority of turtles in the hawaiian islands actually nest up here

kpix 5 reporter maria medina is live outside the santa clara county jail. maria. >> reporter: good morning, michelle. yeah. technically, brock turner can be released anytime now but the sheriff said he will likely be released between 5 and 9 a.m. we are keeping a close eye on the doors behind me. you can see a huge presence of the media here but the protestors who plan to show up have not shown up just yet. turner sexually assaulted a drunk woman outside a frat party last year. he is a former stanford swimmer. he faced several years in prison. but judge aaron persky gave him just six months in jail. many felt that was a slap on the wrist. now he is getting out after only three months. the protestors who plan to show up today say their message isn't necessarily for turner but for persky, who they believe should be off the bench. >> we want to make sure that the public is safe. and if there is any kind of violence, that we have deputies here to respond. >> reporter: so the sheriff says that they are going to plan on having several deputies out here just in ca

the santa clara police union encouraging officers to voluntarily work 49ers' games. the union wasn't so sure last friday. >> nbc bay area ian cohl broke the story earlier and joins us now. a lot of closed door meeting goes. what happened behind the scene. >> reporter: officers say they will continue to volunteer for 49ers' games thanks in part for the santa clara mayor for supporting them while offering words of caution. >> first a warning and now a change of heart for santa clara police officers, about 70 of them typically volunteer to work over time at 49ers' games, but last friday the police union said they might stop, upset over colin kaepernick's statements about police officers and the fact he wore socks at a practice showing pigs in police uniforms. >> i am hearing it this week that next week on monday night football some officers are not going to work. >> reporter: but that's not the case anymore after mayor lisa gillmor voiced support for the officers, encouraging them to voluntarily work the game, saying if they didn't their actions could be misunderstood.

the former stanford swimmer walked out of the santa clara county jail in san jose. turner served just three months of a six month sentence after sexually assaulting an unconscious woman on the stanford campus. >> turner walked out of the jail, past the many reporters gathered outside and straight into a waiting white suv, was then driven on the highways of the peninsula south bay for more than an hour. sometimes went north, sometimes went south. the suv was spotted getting on and off freeways. that journey came to an end around 7:20 this morning. >> do you have anything to say, we're giving you a chance to apologize, anything to say? >> anything you want to say at all. >> photo journalist tony hodrick tried to get a statement from turner and his family when they arrived at a hotel along the peninsula. the turners refused to comment. the family now expected eventually to return to their home in the state of ohio. >> at this moment, we do presume the three of them, mom, dad and brock turner are together alone in that hotel room. the scene is not over in the south bay.

in saratoga, a santa clara county sheriff's deputy has shot a person. right now that person's condition not being released at this time. it happened about 8:00 late night on titus road. investigators are saying very little except no deputies were injured. the person shot was taken to the hospital. once again, no word on their condition. we have calls in to the sheriff's department and will update you as we hear back. kris sanchez is live on the scene as the investigation continues. expect her live report in our next half hour. >>> new this morning, did you feel it? many people in the east bay were broken up overnight by a small earthquake that created quite the jolt.
