department of agriculture but in my quick run through the case i left something out because i didn't want to complicate things, but that second appeal to the 8th circuit from the district court's decision holding that before did not apply, the government didn't appeal. the government at that point said okay, we'll disclose, you know, fair fight and we lost, end of story. but at that point a private party, the food marketing ins institute which is a trade group for food grocery stores was aloed to intervene in the case for the purpose of stepping into the government's shoes and appealing to the 8th circuit which is a, unusual and b, we think wrong. that shouldn't have been allowed to happen, but even though fmi lost the appeal to the 8th circuit it gained party status so it had the right to seek supreme court review and over our arguments to the contrary, they got supreme court review. so this is a foi case now in the supreme court where the united states government is not a party. so that's unusual. the government, the solicitor general has filed an am icu s brief. the other odd thing and then i'll stop, about two months ago while the sert petition was pending, congress amende
