correspondent shannon breem is here with details. good evening, shannon.court are we talking about? and what do we expect is going to get so heated? >> the problem is this is the d.c. circuit court. what's important is the key appeals court for looking at federal regulations, things like epa and irs. something that looks at administrative axz that goes around congress. so it's a real check on administrative power. this is the court that looked at the nlrb recess appointments and found them unconstitutional. so it's very important. it's balanced right now evenly between judges who reported by republican presidents and democratic presidents, so adding even one new nominee to the president's is going to tip the balance. four of the u.s. supreme court justices served on this court. it's very important. >> democrats rightly point out there are a lot of empty seats so why shouldn't they be filled? >> there are three vacancies. the president has tapped three current lawyers, one currently a judge in a lower court. there were vacancies back when president george w

. >> cnn's shannon travis joins in washington. deal differ from what we see from the house republicans? >> it will have to be more creative than what we have seen so far. president obama is insistent, any deal that emerges must be free of the ideological thoughts, they want the clean bill to re-open the government and that's what they are insisting on and that's not what we have seen being offered by republicans so far. the house we have, that proposal to extend the debt ceiling for six weeks that didn't reopen the government and out of the senate we had that plan from senator collins, and other bipartisan senators that hope to re-open the government through march, and also raising debt ceiling through january but had the medical device they wanted to suspend the medical device tax through obama care, and that went nowhere. mcconnell and reid will have to be creative. >> the conversations were extremely cordial, but very preliminary, of course. nothing conclusive, but i hope that our talking gives some solace to the american peopl

shannon bream live in washington on this.es that the justices will tackle, shannon? >> reporter: bill, from abortion to campaign finance the term is packed with controversial cases. with that in mind several of the justices attended the traditional red mass here in washington held each sunday before the new term opens. several other lawmakers and top administration officials were there as well. they got an earful of a sermon about the partisanship and heated rhetoric that has taken over in washington and appeal for civility. this term the justices will tackle several cases touching on religious freedom including one that considers whether public government meetings can be started with prayer. opponents saying allowing that would send the wrong message. >> if most of the prayers that were presented at the town council meeting were christian it, could be seen as an endorsement by that government, that christianity is the religion that they endorse, that they think is good. if you do not believe in that religion, then you're som
