cnn has learned sterling and his wife, shelly, have agreed to sell the l.a. e an expected vote to terminate their ownership. we're also told mrs. sterling now calling the shots in secret negotiations under way with the nba. our panel is standing by. there's a lot of information tonight. including new details on how and why this scandal exploded in the first place. >>> let's get the latest from our national correspondent, suzanne malveaux. suzanne? >> cnn has learned that donald sterling has turned over controlling ownership of the clippers to his wife of 58 years, shelly, in hopes of selling this team. now, after threatening to sue the nba, he is now using another tactic to play hard ball with the nba that if successful could mean a half a billion dollars in profit and a speedy resolution. the ball is now in shelly sterling's court. now that her husband and longtime business partner donald sterling has handed over his control of the l.a. clippers. shelly sterling is now negotiating with the nba to possibly sell the team. >> the nba made it clear this was all a

clippers owner donald sterling, his wife shelly trying to hang onto it. telling others she wants to keep her stake in it. and at least one other person thinks there is no way that donald sterling can be forced sell. that person? donald sterling himself. in a new audio recording released by radar on-line, a man said to be sterling is speaking on the phone with an unidentified man. cnn can't independently confirm this is donald sterling but if it is it is the first we've heard from him since he was banned for life from nba. on the recording sterling says he is not a racist and seems to lament the fact that everybody jumped to conclusions about him. listen. >> it breaks my heart that magic johnson, you know, a guy i -- that i respect so much wouldn't stand up and say well, let's get the facts. let's get him and talk to him. nobody tried. nobody, from here on -- on beverly drive and sunset, across from the beverly hills hotel. you know? >> donald, i think they're probably trying to force you to sell it, that is the thing. >> you can't force somebody to sell pr

shelly sterling said if she divorces her husband, she'd own the team. n.b.a. a looking to take ownership of the team after leaked recordings. sports attorney darren heitner joins me now. let's start with donald sterling's cause. a lot of people look at the situation from the outside in. how can someone be forced to sell anything in this country. special sports don't operate the way a lot of other companies do in this company. if you are an owner, you agree to a certain set of rules. what legal recourse does sister-in-law have. >> that is correct. every n ba applicant, anyone wanting to own an n.b.a. franchise agrees to be bound by its constitution and by-laws. within that exists an article, article 13, which allows a 3/4thst vote by the n.b.a.'s coverage. if it violates a provision found within the article. >> what we have come to understand is article 13 did is what the n.b.a. is relying on. if an owner fails to fulfil its contractual obligations to the association, to members, players or third parties. and it affects the n.b.a. there can be a vote and the own

as you mentioned, the nba says it's resolved its dispute with shelly sterling over the ownership of theer, that it's going to withdraw its charge to terminate the sterlings' ownership of the team. it's going to cancel the june 3rd meeting and vote that would have voted to have the owners vote on the termination of the sterlings' ownership. in return, shelly sterling and the trust have agreed not to sue the nba. and here is the interesting part here. the nba says shelly sterling has agreed to indemnify the nba against lawsuits from others, including donald sterling. well, that's not necessarily what donald sterling's side thinks because they are suing the league. they just announced that suit within the last hour saying they're suing the nba for a billion dollars in damages. they're calling for donald sterling's lifetime ban from the league to be lifted for his $2.5 million fine to be lifted. they're saying that this case against donald sterling was entirely on an illegally recorded conversation. so those are the two sides speaking in very different tones tonight. and erin, this comes ju
