>> reporter: good morning, shirleen and ken. within the last hour we have received the report of another shooting happened in the brownsville section of brooklyn. that happens in the 300 block of mother gaston boulevard. that person is in unknown condition. a man was shot. police have someone in custody. meanwhile, in the 800 block of saratoga, it is blocked off. you can see behind me members of the crime scene unit working outside the apartment building where the shooting happened. there are nypd cram as on this block. police hope the cameras were functioning last night which will help them identify the shooter they are looking for. it happened around 8:30. according to police and eyewitnesses, a man drove up in a black car. that driver jumped out of the black car, approached three men standing in front of the apartment building and just started shooting. a 21-year-old man was shot in the chest and later pronounced dead. a 19-year-old and 22-year-old were shot. they were taken to brookdale hospital where they are listed in stab

>> reporter: dare and shirleen, the number of cases has slowed. only three new cases but two of them fatalities. to make sure that the outbreak is under control, a new health department order regarding those cooling towers which are at the heart of this outbreak. building owners will be required to test the cooling systems within 14 days and failure to comply will be considered a misdemeanor. the mayor announcing the numbers r number of cases in the -- the number of cases in the bronx has hit triple digits, 100 and ten fatal. the state health commissioner was in the bronx with ruben diaz touring complex -- concourse plaza. the state has been doing the lab testing for the city and will now provide the testing for free for building owners, testing that is now mandatory. >> the order instructs the owners or managers to test and disinfect their cooling tower within the next 14 days.

i'm david novarro. >> i'm shirleen allicot. >>> prosecutors released new details in a devastating crash on the southern state parkway that claimed the lives of a father and his two young children. >> authorities are saying o'neil sharp junior was driving drunk when he hit the car causing it to burst into flames. n.j. burkett has the details. >> reporter: outside the suffolk district attorney's office in hauppauge where the d.a. is holding a news conference at this hour. we have wondered for weeks what it was that lead up to that horrifying crash that killed a father and his two young children. now that picture is a lot clearer today. prosecutors revealed that shiane richards was driving up to 95 miles per hour on the southern state parkway that night, that he blew past o'neil sharp and prosecutors say sharp, who was allegedly drunk, decided he would catch up to him at speeds estimated to be 120 miles per hour. well, the result, dave, as we all know, was a catastrophe. o'neil sharp plowed into the back of the victim's car, prope

. >> i'm shirleen allicot. we begin with new developments in the deadly legionnaires outbreak in the bronx. >> the state health commissioner is getting involved. he toured a movie theater, one of several businesses linked to the outbreak. the death toll has risen to eight and the number of cases shot up to 97. >> marcus solis is live with the latest on this one. marcus? >> reporter: shirleen and dave, the state health commissioner invited by the borough president calls it an all hands they toured the area. take a look at the cooling tower, one of these identified legionella. dr. howard zucker joined reuben diaz as they came to this neighborhood, one of four throughout the bronx that has been affected. this cooling tower is one of five tested positive but it is not definitively linked as the source of the outbreak. the numbers have continued to grow since the first reported cases on july 10th. eight people died. 89 others sickened. the borough president proposed legislation for city inspection of cooling towers

. >> reporter: shirleen, david, those families inside the home are devastated this afternoon still on scene waiting to hear what if anything may be salvaged. behind me there is a great deal of firefighters on scene. they have ladders up continuing with the hot spots. witnesses say it was a fast and furious blaze that quickly spread through this home. our chopper got the shots overhead as multiple flames shot out tuesday morning. francine lives on the top floor with her family. her 16-year-old son left the house before the flames broke out. fortunately everyone inside the building made it out safely before firefighters arrived. the source of the blaze is under investigation. it originated in the basement or first floor and quickly spread throughout the structure. the assistant fire chief says eight firefighters were taken to jacobi with minor injuries and they had to stretch hose lines because of the difficulty in the perimeter surrounding this home. now, fortunately we know it was no other injuries incurred by people living inside. at one point the blaze was upgraded to four alarms. r
