steve harrigan has the latest developments live in atlanta tonight. at evening, steve. >> that evening, shannon. both of those officers were ordered to surrender themselves by 6:00 p.m. to police and both did so. the first, he did not bear a shot during friday's incident, stands accused of aggravated assault, could face up to 20 years in jail, released after a short time on bond. the second officer, no bond for him, faces 11 charges in all including felony murder, could face life in prison or the death penalty. one disturbing charge wednesday by the district attorney was that rolfe after shooting rayshard brooks in the back twice kicked the body of brooks, this is a charge that rolfe's lawyer vehemently denies. >>y client kicking mr. brooks, you would've seen it. he could be leaning down to try to give him first aid, it could have been when he was trying to evaluate whether he needed handcuffs. >> rolfe's lawyer says his client will be vindicated when all the video from the event comes out. on th in the meantime, president trump commented on the case.

steve harrigan live in atlanta with more, hi, steve.exas and florida were early to reopen their economies very aggressive in doing so and now each state due to new coronavirus cases has been forced to take a step backwards and place new restrictions initially on bars but we could see more ahead. florida had a record single day total for cases, 9,585. the statistics in florida are certainly worrisome, 70% increase in new cases in just a week, more than up 500% in new cases in florida since memorial day. the mayor of miami is shutting down the beaches ahead of the fourth of july weekend. he's encouraging people to wear masks including tourists and he is criticizing young people in the miami area saying they do not practice proper social distancing. >> we are see light of the new cases 18 to 35-year-old range which are, you know, younger adults who seem to be for whatever reason not worried about the fact that this is a highly contagious disease and they can pass it along to their parents and grandparents and potentially put them at risk.

correspondent steve harrigan has been on the ground with us for days reporting on the latest developmentsere tonight. good evening, steve. >> shannon, good evening. the curfew is in effect now, appears to be holding very strong. the only vehicles we are seeing on the streets are either police cars or national guard vehicles. since the arrival of the national guard, about 7,000 strong, it has changed dramatically here from three or four nights of leading chunks of the city burn to some real aggressive policing held by the national guard. the number of arrests and the fires and violence have gone down dramatically. discussions are underway for the funeral of george floyd set to take place here thursday and also further memorials and services taking place in north carolina and houston, so a three state funeral for floyd. a civil-rights charge has been launched by the state against the minneapolis police department. that means all matters, all actions to do with race for the past ten years will now be investigated in the police department here in minneapolis. shannon, back to you. >> shannon:

fox's steve harrigan is on the ground now in atlanta with the latest on this story, steve. >> laura,his all began friday night at about 10:30 p.m. at a wendy's in atlanta. rayshard brooks was asleep in his car in a drive-through lane, blocking other cars. police were called, they roused him. police officers and brooks spoke, with each other for more than 20 minutes. they gave him a sobriety test, which he failed. it was only when they were about to put the handcuffs on him that he began to struggle. the three began fighting. two officers and brooks. brooks got a hold of a taser of one of the police officers and began to run away. he turned at one point to fire the taser at the police office officers, then turned to continue to run. it was during those moments when an officer drew his service weapon, fired three shots, hitting brooks in the back twice. he was taken to hospital and pronounced dead. the mayor quickly condemned the use of lethal force by the police as a mistake. they released a video quickly too and violence followed the release of that video. at that wendy's, windows we
