steve kornacki has been watching. steve what's the latest?well, there's an interesting and extended discussion about marijuana based on the legalization of recreational marijuana in colorado. chris christie has pledged as president, he said enjoy it while you can, colorado, because when i become president you're going to lose legalized marijuana in the state. and there was a long back and forth between chris christie and rand paul. and rand paul saying look, this is a tenth amendment issue on the one hand. individual states have the right, should have the right to make their own laws on drugs. the federal government should not be coming in and intervening. he also started to make an argument you don't hear necessarily that much in a republican debate about the sort of unfairness in prosecution of drug crimes, basically saying if you're a privileged rich kid like jeb bush, you can use marijuana as a kid and you can get away with it. but if you're poor, if you're black and use marijuana as a kid, you pay a price for it. and then carly fiorina e

steve kornacki is the host of "up with steve kornacki." let's start with the latest poll numbers. and what it really means for hillary clinton. she ranks third when it comes to to this other question which is prif vat ol about honestly and whether or not she's trustwor y trustworthy. joe biden coming out at 91% with the caveat being he hasn't officially thrown himself into this race. once you do then you can see the numbers go down. how much of a concern is this for the clinton campaign as they're working on that issue? >> it's been a surprise to the clinton campaign. first of all, these numbers you talk about with honesty and trustworthiness is concerning but also surprise how much traction bernie sanders has gotten in this thing so far, how much traction a non-hillary candidate has gotten. if you talk to the clinton people they talked about basically they're going to make a real full fledged effort in the first four primary states and they figure that's sort of it. they were speaking of it as a tune-up for the general election. they would put a real of for the in and move on. no

let's turn to steve kornacki joining me. hi. >> how are you doing? >> nice to see you again.s talk about the plan and the politics. we can put up on the screen the basics of the trump plan and talking about no income tax for any single person earning less than $25,000. four income tax brackets created. lower corporate income taxes down to 15% and top tier from what is now 39.6% down to 25%. so the people at the very top and the very bottom if i have this right are both going to be seeing a pretty significant tax cut. >> yeah. i think this is what's interesting on this is the run-up to this. if you listened to donald trump in speeches and debates when the subject of taxes came up, he was striking a much more pop list tone than any other candidate and republican last few years and some expectation he would go republicans haven't before and in materials of specifying the rich pay more and there's a big giveaway to the rich with the estate tax and the totality of the plan, this is really a republican establishment tax plan. this is -- with one exception here dealing with carried

steve kornacki and chuck todd, you sent out a tweet that said this is a plan president obama would have approved of it in a lot of ways. >> the numbers and the rates, but when you sort of -- if this were the starting place that the republican congress would have come through, this is sort of the philosophy behind where the obama white house would have worked on tax reform which is, yeah, close these loopholes here, still keep a progressive tax code in it. it is -- look. you can say this with trump. it is arguably, if you're looking to reform the tax code and believe that your only shot is to do is semi-incrementally, this actually is a very realistic starting point. now, look. we have to see if his numbers add up. he obviously believes they do. there is a lot of tax research analysts that will go through this the next couple of days. it could very well be that some of this stuff doesn't fully add up. but it is going to get the ire of some conservatives who have have been trying to make the argument this guy is not a real conservative and here's more proof. >> it is also potentially a wa

joining me here in the studio with a deeper dive, colleague steve kornacki here on msnbc.w everybody, again, the new polling numbers, donald trump followed by dr. ben carson and then jeb bush there. rubio barely cracking the top five and then rounding out the top ten, 2% to 5% range. tomorrow night, is it really going to be the story of the 11 people on stage and three nontrads, nontraditional candidates against the typical eight of those? >> you have to look for the squabbling between the three, fiorina, trump and carson. a couple of things to look at, kasie is right fiorina going after trump and a risk to donald trump. the one that came at donald trump or tried to at least was rand paul. didn't work. rand paul for a variety of reasons not equipped to pull off that kind of attack in that setting. carly fiorina communicator. very quick on her feet. that's the reason she's in this debate. she was elevated from the kids' table debate so impressive in the performance in that first debate and there is i think a clearly gender dynamic to it, as well. that's an interesting thing

let's go to steve kornacki who's on the phone. what does this mean?free man. the first game of the season is going to be a nationally televised game featuring the patriots, the defending super bowl champions, against the pittsburgh steelers. and tom brady is going to be suiting up and starting in that game for the patriots. >> there was also fines involved. the team had to be giving up money. does this affect any of that? or it's just about brady? >> reporter: this is just about brady. this was an appeal filed specifically by brady. the other penalties that were handed out earlier this year, they were accepted by the franchise, by the owner of the patriots, bob kraft. he accepted a hefty fine. he later said when the four-game suspension came down that he regretted agreeing to that. but those are franchise penalties, that's been adjudicated. the owner agreed to those months ago. this is an appeal by tom brady. the judge here obviously had said that he wanted the two sides -- he wanted the nfl and brady's camp to reach some kind of a compromise on the o
