no officers have yet been charged in the shooting death of tamir rice.gation is still ongoing. but the results of that investigation whether anybody involved, any of the officers will be ultimately charged, that is a big unknown still hanging over cleveland right now. even with that big announcement today about reforming the police department and, of course, it hangs over the protests, the peaceful protests in the streets of cleveland. and in the meantime while we wait to learn what will happen in the tamir rice case, the cleveland police department and department of justice say they will get to work implementing these changes right away, these fixes for what is broken at the cleveland pd. they will get to work on it right away, and yet, soon enough, not even close. joining us now is pastor richard gibson from the elizabeth baptist church in cleveland. he's one of the co-chairs of the greatest cleveland congregations which organized a march today in response to the acquittal of officer michael brelo. pastor gibson, thank you for being with us tonight. >>

"outfront" we have walter madison, the attorney for tamir rice's family.e have david klinger, a former officer with the los angeles police department. i want to ask you, david, because some of these recommendations from the department of justice, there's a key one that says police essentially get a refresher course on when the use of force is proper and lawful, but you look at that tamir rice video, and you believe that the officer acted lawfully. how does a recommendation like this help prevent a situation that i think everyone agrees needs to be prevented? >> i think what you have to do is step back and understand that the critical mistake was the officer driving the vehicle, getting so close. and there were four key bullet points in the 2014 letter to cleveland p.d. that then led to this consent degree. the fourth one was the bad tactics. if you look carefully at a number of questionable shootings around the country, what you will find is officers not behaving in an unlawful fashion, but using poor tactics and getting too close to a situation. that crea

walter, we do anticipate a decision soon in the tamir rice case.ow does the judge's verdict in this case in cleveland yesterday affect your thinking about what is going to happen with the tamir rice case? >> it's discouraging. you heard the county prosecutor argue to the judge the training, the behavior of this officer are the reasons why they felt he should have been convict of a crime. what we have on video, a complete deviation from training protocol and anything reason to drive upon a suspect that they believe to have had a gun. listening to their own words. and if we have yet to have an arrest and yet for them to conclude this investigation after six long months, then i don't believe there's much hope. >> now, this case that was decided yesterday, in fact, there are five other police supervisors who have been charged with dereliction of duty. there is a chance for more legal exposure involving the cleveland police and the case yesterday. >> but those are low level charges. those are nowhere as significant as what mr. brelow was facing. so ther

i'm joined by walter madison, who represents the tamir rice family out of cleveland. that's the 12-year-old young man who police thought was holding a real gun. turned out to be a toy gun. he was shot dead. and cnn law enforcement analyst cedric alexander. walter, to you first. one has to wonder how influential this case and the outcome of this case may be for any upcoming case involving the police officers who shot tamir rice. do you see there being any correlation? >> absolutely. and i think it feeds to the public's distrust of the system. one of the things that i think needs more attention is that the prosecutor and only the prosecutor engineers, if you will, the inputs for a grand jury. he controls exactly what comes out of there because he controls what's presented. >> meaning in this case timothy mcginty, the prosecutor, imposed a charge or charges for only one of the 13 officers, and you heard from the mayor earlier who said he didn't think it was going to be -- it was not likely to bring a successful outcome. he thought it would be very difficult to prove thes

no incident in cleveland has been more horrifying than the killing of tamir rice.security camera video captured rice playing with a pellet gun. the police pulled up, and within two seconds, an officer shot the boy. on the left, you see tamir's 14- year-old sister being tackled by police as she rushed to her dying brother. the police ride up, and almost even before the door is open the 12-year-old boy is shot. >> williams: a 12-year-old boy lost his life, period. and what makes it even more difficult for me, not just as a person that lives in the city but as a chief, is that that happened at the hands of a police officer. >> whitaker: the rookie officer who killed rice was hired by the cleveland p.d., even though another police department had found him emotionally unfit and forced him to resign. how did he get hired by the cleveland police department? >> williams: those are things that are under investigation that we're definitely taking a second, a third, and a fourth look at. >> whitaker: how did he slip through? >> williams: we know some of the things that happen

last november, 12-year-old tamir rice, playing with a pellet gun in a cleveland park. a witness calls 911 believing that was probably the case. >> there is a guy with a pistol pointing it at everybody. >> but that is not what the officers were told as they were dispatched to the scene. so police say with those words in their minds, officers drove up to rice, while tell iing himo drop the gun and raise his hands. two seconds after exiting the car, officer timothy loman fired the shot that killed the boy. an orange tip on the gun to indicate it was a toy had been removed. almost two years earlier, officer loman resigned from another police force after a supervisor described him having quote, a pattern of lack of maturity, indiscretion, and not following instructions. loman has not spoken publicly during the rice investigation. his attorney said that the investigation, quote, must not be influenced by outside commentary or news conferences. and that they will quote, continue to remain silent until the investigation is concluded. a month later, the cuyahoga county sheriff'

police killed tamir rice. jericka duncan has more. good morning. >> reporter: good morning. the protests over the weekend for the most part remain peaceful although there were 71 arrests. now, we did get a chance to sit down with the family of timothy russell. they expressed disappointment over the verdict and concern of what might happen in the case involved 12-year-old tamir rice. >> i was very upset about the verdict and i also feel that brelo was wrong. >> reporter: michael brelo was one of dozens of officers who chased russell and brown when they thought someone in the car fired at them. they shot more than 100 rounds. officer brelo jumped on the hood and fire 15d bullets through the windshield after the car had stopped moving. no gun was found at the scene. prosecutors claim russell's car backfired sounding like a gunshot. >> i feel that there was adrenaline flowing that night. those officers were angry, they were mad, and they went overboard. >> the judge said he could not conclude brelo's shots alone caused the deaths of williams and russell and he said there was jus
