tara moriarty is joining us now from the courthouse with more on what he is saying about the case. tara. >> reporter: the retrial is set to begin at 8:30 this morning. when ktvu spoke to joseph martin in jail, he's be there for a year and a half, he appeared very relaxed and confident. >> did you ever molest any of these students? >> absolutely, never at all, whatsoever. >> reporter: the 46-year-old spent nearly two decades teaching in concord until his arrest last year. that is when a former fifth grader accused him of molestation and then others came forward. march tine taught at wood side elementary. he only patted or hugged students as a common technique. >> i believe in my justice system and believe my heart was in the right place. and i do believe i will be acquitted when the jury sees the truth. >> reporter: martin initially faced 150 counts involving 14 boys. his attorney says prosecutors told him that 73 of the 95 outstanding counts have expected to be dismissed today. that means 22 counts will remain. his first trial ended in august. the jury acquitted him of charges including three students. jurors were split on the other account. coming up we will

ktvu tara moriarty is joining us live thousand.s are searching for the driver of an 18 wheeler. tara. >> reporter: there is only one witness to that accident. police have interviewed that witness. we also know that they have take an look at surveillance video from a nearby hotel but we are told it did not reveal much. police believe it is possible that the driver of the 18 wheeler didn't even realize he had hit someone. the accident happened just before midnight on the city's tenderloin district. police patrolled that area around the clock but were not on that particular block when the man was struck and killed. the victim's identity has not been released. it also does not show a license plate on the vehicle. so officers are hoping that anyone else who may have information about the accident comes forward. we do know that the person who was struck by the car was not in a crosswalk. we are told they were j- walking. live from san francisco i'm tara moriarty ktvu channel 2 news. >> thank you. >>> time is 5:37. in san jose a man was k
