we got 9 charging decision letters from the da's office after that meeting. the last presentation and homicide has received those 9 charging decision letters and i'll say on the da side there's some other agencies so they cleared a lot of those cases out of there. we had 9 that we received homicide as finalizing their reports and the process of getting those to internal affairs to finish our work and we'll be presented at the next fdrv or the one after which will be well moving forward and there's 9 investigations currently with the da in review and they are either in the process of writing their reports or drafting their final letters and we have 1 case that is still open and homicide is going to be waiting for the me report in that case. the medical exam ers report and to recap we have one open case at this point from 2011 we do have the letter from the da and that's moving forward. and then all the cases for 2012 we did receive charging decision letters since the last fdrv so those are moving forward with the final administrative report and we actually have

and these are i think, the representations by the da's office. and with what they are asking, if somebody is charged currently, with a simple possession, of drugs and the offense that the district attorney is now trumpeting for the state wide initiative to have lowered to a misdemeanor defense, this candidate for em would be ineligible for the electronic monitoring because a day, prior conviction that would have existed based on their concerns of this legislation. and so that, in there is an inherit contusion -contradiction that we do not make a broad stroke of what this does and this is why that i am investing in the power of the da and the judicial system then to referee, and render the decision on whether someone should be on em or not. that is built into the legislation and it is built into the successful history of our departments, and administration of the electronic monitoring. >> thank you. >> i appreciate that and i think that that is, and i think that for me, that is a really important selling point to the extent that there is a differen

incusdy and post custody programming and that gives us enough to alert all members, in particular the da as indicated that we would do in the first iteration and then to go before the judge and let the judge decide and that is because someone spends time with us and both are the sworn staff and the program mat i can staff and works closely with those people that are under our supervisor vision, there may be knowledge that may not have come to the floor previously that we may want to see returned and brought to the attention of the courts and the judges themselves, keeping public safety. keeping it without compromise of why we are advocating this legislation and while providing a system that is built on a level of fairness. and so that we are not inaccurately encars rating somebody, simply because they cannot afford the alternative of not being incarcerated because of our very strong pretrial deversion programs that exist, and our very strong and robust electronic monitoring program that exists, we feel the confidence through our law enforcement infrastructure and our deputy sheriffs and

-- here's the real troubling problem here. you've got a da prosecutor, bob mccullough, his father and mother and brother and uncle, all worked for the police department. this is the guy going forward with this case. as a matter of fact, his father was killed responding to a call that involved a black man right there in that community. the problem, ed, you'll find very few places in small town america where the good old boy relationship between the da and law enforcement isn't overwhelmingly strong. the same thing holds true for grand jury. the local grand jury should not be the people deciding this. a prosecutor can push a grand jury to reach virtually any decision he wants in how he presents that information to the grand jury. it's time for the governor to move the center of gravity away from ferguson. >> that was my next question. this is on the governor's desk, is it not when it comes to the prosecution process here? he can step in as an executive and reassign the da -- the attorney general cannot do that. does not have that jurisdiction.

the relationship between the police and the da has nothing to do with the fact that the da himself hassues in terms of his own family. it's really the ongoing relationship that exists between the local da and the local police, that is one that could that a very negative impact in terms of prejudice and the working relationship. local das don't have experience prosecuting the local police. that's where i think that they should be concerned about because they have this working relationship that makes it very difficult for them to want to really put their heart in process. we saw that frankly in the trayvon martin case, it was the police that turned against the prosecutors and the prosecutors didn't invest the kind of energy and intellect they should have. walk us throu >> walk us through the process. >> reporter: they stay darrin wilson the officer who shot michael browne will have an opportunity to testify before the grand jury, they haven't said when. the current grand injure expires in september. then they will appoint a second grand jury which will be the same 12 jurors. they'll cont
