kelly, what's the reaction from the white house over this dhs draft leak? >> reporter: yes, to give people a sense of what this is about, we were also able to obtain this three-page report from the department of homeland security. it is taking an assessment about the president's seven-country travel ban that affects mostly muslim countries and limits immigration from those countries. this report finds that those people with that citizenship from those seven countries are not any more likely to be responsible for terrorism inside the u.s. now, the white house is telling me that this is an incomplete report, that it was based on what's known as open sources, meaning publicly available information, not classified information, and that a more comprehensive report is still to come that will include that kind of data intelligence and would not be political. so i believe that the white house is saying that while this report could be part of the end result, it is not the outcome that they expect when the president gets what they call a threat assessment from the int

the aclu is the first public reaction that we have seen to these new implementation orders from dhs, saying "these memos confirm that the trump administration is willing to trample on due process, human decency, the well-being of our communities and even protections for vulnerable children in pursuit of a hyper- aggressive mast deportation policy." coming later on this week is the president's newly written and rewritten executive order on extreme vetting, the so-called immigration band that got caught up in a number of courts, ninth circuit court of appeals really put the kibosh on it, refusing to release this day from a district judge in seattle. our correspondent thinks that the white house and the council office and homeland security which have been working on this new executive order may make it legally bulletproof. here's what the judge said this morning. >> they've taken the ninth circuit opinion, taken opinion in brooklyn and taken opinion in the federal court in alexandria, virginia, and all of these judges that pointed out what is problematic with the order, they will address

story, what we have is the intelligence agency within dhs apparently being told by the white house what their intelligence report should conclude, that it should conclude those seven -- banning travelers from those seven countries makes sense. apparently analysts within the intelligence agency and dhs didn't follow instructions, they produced an independent report that said quite the opposite of that. it appears as we piece together this reporting from a.p. and "washington post" that the trump officials inside dhs spiked that report, wanted not to release it and now these intelligence analysts or somebody who had access to their work released it to the press instead in order to get around administration officials trying to disappear that report. does that make you feel worried about that kind of a leak? do you feel that leek is heroic? is it somewhere in between? >> i'm ambivalent about it, of course. government by leak is no way to run a government but you've gotten a awful lot of very patriotic people in places like nsa and cia and fbi who

those memos signed by john kelly, the head of dhs, earlier today put out by the administration. the highlights here include a spending spree be, i guess you could put it, by the federal government. among it, 10,000 i.c.e. agents, immigration and customs enforcement agents, to be added, along with 5,000 custom and border patrol agents as well. criminalize criminal illegal immigrants for deportation, that is something the president has talked about for a while now, and there will also be the end to so-called catch and release as the new guidelines call for a stricter judicial process. within the information that was put out by dhs today, there was also some stuff about the border wall in which they say they have identified certain portions in texas, arizona and california for which that wall can start going up in the near future. as for the other memo that you talked about, the extreme vetting memos, we expect those to come out here at some point we believe this week, potentially forward the end of the week. that would probably complement what happened here today with the departme
