only one in -- the irs's position. only one in the sixth judges held that decision. if the statute is ambiguous and the court should defer to the irs, in the future, it will revert to the statutory language. there is a petition for rehearing en banc in the d c circuit that was fired by the federal government on august 1. the response is due at the end of the week. the administration filed this because it helps to eliminate is split and reduce the likelihood that the supreme court will review this decision. the d c circuit has been very stingy at granting en banc decisions. and historically have not considered the circuit court to be in a position to grant en banc decisions. that has to between not the position in the past 10 or 15 years or so. there was a petition to file by the plaintiff before the supreme court that could be enacted upon in the fall and could be the decision on why the bc court will take this -- the d.c. court will take this case en banc. i have probably gone on farther than michael wanted me to, so i will stop there. but i would like to wrap up by

jon: a potential game-changer, heather, in the irs political targeting scandal. it centers on the missing lois lerner emails. if you remember the irs says it went to unprecedented lengths to try to retrieve two years worth of emails from lois lerner that were supposedly lost in a computer crash. well now there is word from judicial watch, the government watchdog organization, that the government actually has a backup system. the watchdog group says a department of justice attorney admits it and said so on friday but the doj says there is no backup system and this is just the email retention policy the irs has in place. joining us now, ellison barber, staff writer for the "washington free beacon." so, judicial watch is saying they were told on friday, by a department of justice attorney that there is definitely a backup system that should have recorded lois lerner's missing emails. do we know in fact that that actually exists? >> well, theoretically we do know they are supposed to. according to the federal records act we know government agencies are supposed to be

[laughter] if someone received a tax credit in excess of what they are entitled to, they have to pay it back. not all of it and not all the time. there are limits on what people would have to pay back. people could end up having to pay thousands of dollars. what made the obama administration decision so reckless, not only are they taxing and borrowing and spending money they have no authority to touch, but they are using it to induce people to enroll in exchanges that those people could have to pay back the subsidy. those people could get hit with thousands of dollars more on their tax bill. the irs might have the authority not to collect that money. but that is an open question. >> it was reported in the new york times that because the federal government has not been verifying eligibility for the tax credit on these exchanges that somewhere up to 2 million people have not been able to -- that have received tax credits and subsidies may not be eligible. they have not been able to confi

>> i asked the irs about that right before i did this show. when i was looking through the report, i couldn't really tell for sure whether or not they had. it was more of a risk assessment. this is the statement the irs gave me in part. they said there are no findings in this report that conclude that any data was used inappropriately in these instances cited. keep in mind the irs only provides contractors access to the necessary data needed to complete if the contracted work and ensures that data is recovered or destroyed when the work is complete. i'm not entirely sure that answers either of our questions in terms of did they call people. it seems like they are saying, no, we didn't, but we're careful so it's not anything that needs to be worried about. they did tell me they have gone back and they're working on enhancing their program guidelines and making sure that these security checks are done appropriately and that they started doing that a year ago. i'm not sure if they called everyone individually. >> i'll leave it up to our viewers to

only one in -- the irs's position. only one in the sixth judges held that decision. if the statute is ambiguous and the court should defer to the irs, in the future, it will revert to the statutory language. there is a petition for rehearing en banc in the d c circuit that was fired by the federal government on august 1. the response is due at the end of the week. the administration filed this because it helps to eliminate is split and reduce the likelihood that the supreme court will review this decision. the d c circuit has been very stingy at granting en banc decisions. and historically have not considered the circuit court to be in a position to grant en banc decisions. that has to between not the position in the past 10 or 15 years or so. there was a petition to file by the plaintiff before the supreme court that could be enacted upon in the fall and could be the decision on why the bc court will take this -- the d.c. court will take this case en banc. i have probably gone on farther than michael wanted me to, so i will stop there. but i would like to wrap up by
