so the pennsylvania supreme court ordered the legislature to draw a nonpartisan map but anticipating that the republican controlled legislature, the democratic governor might fail to agree, the court said essentially if you don't do it in three weeks, we'll do it ourselves. pennsylvania party leaders is began talks to redraw the districts but the state's republican leaders appealed the decision of the u.s. supreme court claim willing the order intrudes on their turf. the u.s. supreme court has not yet decided to take the case. on january 26th, the pennsylvania supreme court issued an additional order requesting data from the legislature things like current boundaries of all municipalities and precincts. the response of the republican leader, senate president joe scarnotti was to flatly refuse to comply claiming both orders from the pennsylvania supreme court, the supreme court of the state he's in that they were unconstitutional under the u.s. constitution. senator scarnotti is legally bound to comply even while he waits for an appeal from the u.s. supreme court. if he continues to r

by the pennsylvania supreme court under pennsylvania constitution. there's a stay application pending in which the argument is that the state supreme court does not have the power under the elections clause of the constitution to regulate the way in which the legislature exercises its delegated power to set the time, place and manner of federal congressional elections so therefore, state law does not basically bind the legislature when it's doing that function. it is an argument reminiscent of one made in bush versus gore, if you want to go back and read that. but i think at the end of the day there's enough precedent out there to suggest that the legislatures can't be completely independent of control, but who knows. we will see what happens on the stay application. the response is due tomorrow. >> i mean, the sort of chattering classes of the legal, journalistic and academic worlds, took a great deal from the fact alito didn't just ditch the case, he referred it to the full court and asked for a response. >> the followup question from the relentless

the pennsylvania supreme court is going to consider whether the new soda tax in philadelphia is, in fact illegal double tax, and let's talk about what that consideration means, because already a city judge said it's okay, the tax is okay. the commonwealth court said okay, but now it's been bumped up to the top court, and they're gonna rule. what do you think will be the outcome? >> well, there was a divided commonwealth court, and the supreme court has decided to hear the case, which they didn't have to, so i don't know if that's a good sign or not, and they will decide on one issue, whether or not it violates the sterling act. i was in favor of, and i still am in favor of, the underlying premise behind the soda tax, of what we're trying to fund. my concern is that if you look at the revenues, they've been 15% below even the most conservative estimate. is this sustainable, and can we put the money that we need to put in order to expand pre-k and to accomplish some of the original goals of mayor kenney, which i think are important, and whether or not we get the revenues from the soda tax
