could the at&t/warner deal be in trouble because of trump? first, we start off with the banks. despite the major reversal the financial still dragging. checkout the regional banks tracked by the kre now negative for 2017 down more than 1.5% today. j.p. morgan, wells fargo, bank of america, set to report earnings tomorrow morning. will bank earnings derail this rally, pete? you're an owner, are you worried? >> no. what we've seen is this consolidation going on for over a month. if you look at the range, banks you're looking at basically call 23 to the upper 23 it, 23 it 80. and that's where we've been and where did we finish today. by the time everything was said and done, we finished at 2340. so it's sitting right where we want it to be right now those of us that are on the bullish side. when i go to last quarter and i see the numbers that were produced, all these are going to be reporting tomorrow, we're going to find out but my hunch is that the banks are doing extremely well still. i think the environment was great for trading. because of that and the forecast going forward,

donald trump reportedly strongly against the $85 billion time warner at&t merger. ut first retailers getting hit hard with the sector down more than 2% today. >> i feel like i'm playing that old game hot or not when it comes to retail's holiday sales today. let's start with gap because we just got that one and shares are higher, gap's kind of hot. gap in november and december holiday those comps are up 2% and just december old navy comp sales did grow 12% that was off a pretty weak december last year. gap grew 1%. department stores so far are not so hot. macy's and kohl's are nearly exactly the opposite down 2%. sears comp are down 12 to 13%. both macy's and kohl's lower their four year earnings guidance as a result. macy's, in fact, expects the comp trend scene to continue throughout this year. costco is in the hot camp. in december at least were up 3%. but l brand is the parent of victoria secret and those comps were up 3% for the month of december. american eagle comps are flat quarter to date so that's longer time horizon. barnes & noble are down #% but online s

the future. at&t and time warner saying content is king. e we seem to see a deal that once the infrastructure. ceo ofa while the verizon, strategy was go all wireless. they were shutting a lot of this fixed stuff. all of a sudden you have this issue where maybe wireless is not the best issue or only thing for them to do. there's a lot of pressure on the company to make some type of changing transaction for them. bloomberg's alex sherman talked about them looking at 10 companies. that makes a lot of sense to us. they have issues in the wireless business. as a host of companies they are looking at. with the new administration, there tends to be this anything goes mentality where you can really person -- proceed with any type of transaction. caroline: maybe not an at&t-time warner one. what about the 10 other companies that verizon could be looking at? who would be a good fit in your point of view? >> if they are interested in fiber, if they want to actually fix the wireless business or have capacity, and hurt t-mobile's ability to get capacity

and sprint-t-mobile deals, and at the same time we approved with appropriate safeguards the time warner cable-bright house transaction as well as the at&t-directv merger, which will give americans more competitive options for the high speed broadband while spurring fiber deployment to over 12 million locations. as the agency responsible for america's networks, we made cyber security a primary mission of the commission. we adopted privacy protections that give consumers control over how their isp is used and share their personal data. as charlie mentioned, we have adopted strong neutrality rules to preserve the open internet as a platform for free expression and innovation. the basic concepts thawe were dealing with weren't new. the idea of an open network goes back as far as the first come first serve traffic management of the telegraph. telephone networks common carrier status was an extension of this concept, and it is warranted by a behavioral heglegacy in a demonstrated exercise of monopoly power. and let's not forget, it was the open network that delivered the early internet and al

the bigger issue with time warner is the cable asset. the cable access, millions of people, there is an interest in making sure it is not too big to choke off other people's competition. >> this monopoly over public opinion. there is concern among many viewers, the mainstream media is big enough as it is and mainstream media has a particular bias, sympathetic of president obama and hillary clinton. cnn publishing, defending as well, fake news and it is fake because they were not able to verify it, no one is able to verify the stuff which to me is a journalist you don't put it out there because you are just trafficking -- isn't it a little dangerous to think they could be that big, that important and be trafficking in fake stuff? >> it is absolutely very disturbing, i listened to earlier conversations. buzz feed published a 35 page document that cnn was referring to an on-air in their breaking news coverage earlier that day. they broke the dam on this story, not fit to publish hours earlier, trying to create a rationale to get it publishe

back to the at&t and time warner deal now at risk. t donald trump has been having with the public about time warner and at&t. two things, first and foremost, this started during the campaign trail in gettysburg, pennsylvania ahead of what was being dubbed as a major policy address for the then candidate trump. it came at a time when there were several women who accused of havingate trump misconduct against them. he started up the press conference in gettysburg lambasting the media, and as a result, he lambasted the corporations owning that media, most notably time warner and at&t. that was back then. the second point i would make is that this fit with the base of the republican party, many of which are skeptical of large financial institutions and large corporations. now that he is president-elect, we had not heard much publicly on this particular issue. we have the story on the bloomberg now saying that trump has said to at least one individual that he is still planning to oppose the merger. i can tell you i have also spoken with a so

sounds like he is doing everything to rescue the deal with time warner that looked for a while to be a slam dunk. i'm not so sure now. what do you think? the. >> well, i didn't sit in on that meeting so i'm not really sure what happened there but i do remember from my antitrust days in law school that the number one criteria in the sherman antitrust act, what is deliverable to the consumer? and do companies get so big that they are now controlling -- neil: do you personally like it? >> do i personally like it? i have to study it more, neil. i'm not one of these knee-jerk pundits and really have to look at it and look at it through the lens of what the process should be for the law. what i do know, our civil is so wonderful that these companies can become gigantic like microsoft or this situation or exxon, standard oil years ago or at&t or ibm. those are wonderful, wonderful things but what we have to do from the governmental side to continue to make the economy efficient and help the most people, sometimes you have to impose these antitrust laws. they're not anti-business, neil. they'

. >> but ultimately, politically that did not stop the warner act. so the question a lot of people have, okay, huge turnout for the march, how do you understand this building political power? >> this was just the beginning of a building an infrastructure that's going to complement the work done by many organizations and many groups. these women that came out to march with their family, they're ready to act. they want to know what is next. and we had 400 organizers across the country that helped put on sister marches. we are meeting tomorrow morning 10:30 a.m. because we have a plan. >> all of those organizers? >> well, first the national steering committee. >> right. >> and then getting together with national organizers, and we are coming, chris. we are organized. we have vision. you saw what we were able to do in less than eight weeks. we organized 600 marches across the world. to have 1.2 million people in washington d.c. that came out in solidarity to stand together is absolutely remarkable. we are not just a march, and we are going to go sit home.

>> i've never been a big fan of the time warner transaction. >> you're not a fan of the deal. >> theyon't need to own content to get good deals. they have a great deal with the nfl which is exclusive. they won't be able to do exclusive deals with time warner once the regulatory approvals are in place. even with that, if you're not going to grow the video base, that mitigates the potential synergies you can take with time warner. >> so given all of that, do you want to own this stock? >> no. i think you want to own verizon. verizon's numbers were a disappointment as well. but verizon is on an upward trajectory. last year flat numbers. this year 2%, and continue to grow. they're spending less than $10 billion on video strategy. at&t will be well over $100 billion on their video strategy. >> so you don't disagree with the idea of bringing content in, just how much money you're willing to spend on the content? >> yeah. that's one of the things. verizon doesn't actually own the content. they're buying content from video producers, they're licensing exclusive content the way a netflix is do
