i point out, we talked to tim kaine down here, a senator from virginia. look, the things al franken was accused of, they feel one might not fit the time line, happened from before he was a senator. if that's the precedent that the accusations that happen before your time in office get you forced out, it's a game changer not just for roy moore, but any number of people facing allegations down the pipe. >> this started with senator ker stin gillibrand and moved quickly. is there a conversation being h had? do you get to take the moral high ground because sexual harassment isn't acceptable? >> listen, if you talk to senator gillibrand and other democratic senators, particularly the women, they say this is a broader conversation they have having about sexual harassment and assault in congress and around the country. there's a lot of politics at play. democrats need to be able to say they are not part of the swamp or part of the problem in washington. you can see a total election where it's throw everybody out and get new people in here. >> as i mentioned earl

chris: chuck, democratic senator tim kaine said we've got a new standard here and that people who are to office will be judged, among other things, on their behavior before they took office. do you have any problem with the pressure on franken to resign? was this, as the speaker says, a lin p. ing? >> i think it's highly inappropriate to call anything like this a lynching when you think about the history of what actual lynchings really were in this country. having said that, i would add that i think for a lot of women they may feel like, well, you know, when in the past these things came up, there wasn't so much speed about addressing the complaints, that they got swept under the rug. what we're into right now though as these sort of extreme points of view are show is a -- view show is a situation where contrary to senator kaine, there isn't a new standard, there's a shifting standard. there is not an established rule here either about what a fireable offense is or what the procedure should be, and at the end of the procedure what the punishments should be. so i think, you know, what

as of today, that's what he'll do, and that does turn the conversation to roy moore, and senator tim kaine, i spoke to him earlier who said look, this clearly sets a standard. behavior undertaken prior to being in the senate is fair game for the ethics committee. actually, in past cases that wasn't the case. the ethics committee has on occasion said, if you weren't a member of the senate, there's nothing we can do, but in the case of franken, they were investigating things that were alleged to have taken place in 2006, before franken was a member of the senate. so now republicans are going to be having to answer tough questions about roy moore's behavior should, he be elected. i caught up with a couple today. take a look. >> i think at franken made the right decision for himself and minnesota and i respect his decision. >> reporter: what if senator franken resigns and roy moore gets into office? >> i'm not supporting roy moore. >> and the ethics committee won't be looking at al franken but if roy moore's elected, the leadership said they'll be looking at roy. >> reporter: should they call
