it is going to be a busy morning here at uc-berkeley. first i want to tell that you the occupy encampment has grown to nine tents. they set up thursday. another group of students will be gathering here at this same spot. they will have a rally to support throwing out proposition 209 in san francisco, right before a hearing at the 9th circuit court of appeals in san francisco to try and restore affirmative action for minority and gender admissions into public colleges and universities. the ban was approved in 1996, the ban has been challenged many times but groups say they are encouraged by recent court decisions and support from governor brown. the complaint was filed by a group that said 209 violates the civil right of certain minorities that make up half of high school graduates but a smaller percentage of uc admissions. the american civil rights institute is defending 209 saying that applicants should be treated the same regardless of race, that hearing is at 9:00 this morning in san francisco. the group is going to gather here at uc-

uc berkeley police are investigating the mysterious death of a student.ck at the manville apartments on channing way near shadegg. friends of the student had reported him missing. we don't know the student's name but officials say there is no evidence of foul play. >>> a man suspected of shooting at oakland police officers and causing a three-hour search and a school lock-down, is now behind bars. we first brought you this story on ktvu channel 2 news at noon yesterday. police responded to a burglary call on 70th avenue at 11:00 a.m. and saw a man with a gun in each hand. the man started shooting at officers and then ran when they returned fire. no one was hurt but the search for the gunman prompted a lockdown at nearby roosevelt middle school. nearly three hours later, a chp helicopter spotted the man not far from the shooting scene, and police arrested him. >> dave: your time now 8:33. a mars martinez man is in jail this morning accused of using craigslist to rent out foreclosed houses. alfonso salazar used to be a lie associationsed real estate agent.
