the second uva student -- second-year uva student, hannah was seen leaving a bar with jesse matthew. after intensive searching, her remains were found on an abandoned property in albemarle county on october 18. matthew is currently incarcerated in fairfax where he's facing attempted capital murder, rape of a fairfax woman in 2005. the commonwealth's attorney would not touch on why they are not burr suing capital charges, whether or not there's not enough evidence at this point or something else. here's what she did say about the first-degree murder charge. >> the charges that the jury will hear are the charges that the prosecutor feels comfortable and feels the prosecutor has probable cause to bring. in this case first-degree murder and intent to defile. the abduction with the intent and the first-degree murder are 20 years to live. substantial penalty that the jury will be able to consider. >> reporter: prosecutors do say that they have d.n.a. evidence linking jesse matthew to hannah graham. they also say they have d.n.a. evidence linking him to that rain in fairfax and prosecutors
