nbc's vaughn hillyard is following that for us. what are they saying, vaughn? >> reporter: we saw this after the search warrant execution of mar-a-lago when the fbi went looking for the classified documents that donald trump was allegedly holding on to. then we saw this after each of the four indictments that donald trump has faced over the course of the last several months. and now with the colorado supreme court making the decision that in colorado, he is disqualified from the ballot for the grounds of being involved in an insurrection. we see his republican rivals, if you may, the likes of ron desantis, nikki haley, vivek ramaswamy coming to his defense again, take a listen. >> i think the precedent that a court could just take somebody off the ballot without any type of criminal conviction or anything like that, i think that is not the way of the laws intended to be enforced. >> i do not believe donald trump should be prevented from being president of the united states by any court. i think he should be prevented from being president of the united states by

so, vaughn, this decision is on hold until the 4th of january. what comes next for former president trump and what has been the reaction inside his world? >> his campaign indicated that they are going to swiftly appeal this here to have the supreme court take this up. there was a stay that it was part of this order from the colorado supreme court that keeps donald trump on the ballot with the expectation that the u.s. supreme court, by january 4th, by january 5th, will make the determination whether they will hear this appeal or not. with the expectation that they will hear the appeal, it is then a matter of what this timeline here looks like because for donald trump and frankly the rest of this republican field, jose, it is in their interest to have the supreme court make this ruling sooner rather than later, because march 5th is the day of the colorado primary. and let's just take the scenario in which the u.s. supreme court were to rule that donald trump were to be removed from the ballot and disqualified on these grounds, the decision would i

vaughn hillyard in iowa, carlos curbelo is here, and eugene daniels. carlos and eugene are msnbc political contributors, wooet is -- wall street is cheering the fact that -- americans haven't seemed to notice. what do you think about that disconnect in political terms? >> these are the types of headlines that the biden administration needs. the macroeconomic data has been good, sentiment isn't, why, because inflation is backed into the numbers and americans haven't adjusted to the higher prices that are frankly here to stay. what we want is for inflation to stop going up, and it certainly seems like that's happening, which is why the fed announced some cuts for next year, which will also be helpful. we have seen interest rates skyrocket. mortgage rates have skyrocketed. as those come down, sentiment will likely improve, and that's really what is keeping president biden's numbers down, that people don't feel good about the economy even if the numbers are pretty good. >> you know, vaughn, it is arguably a useful political strategy for the trump team to s

vaughn, what kind of threats have these justices been receiving? >> right this group has tracked what they describe as explicit, graphic threats on the lives of the colorado supreme court justices. of course, it was a 4-3 decision. what they have tracked on fringe sites online are specific calls for the death of these justices that ruled for the disqualification of donald trump from the presidential ballot in the state of colorado. one of those threats, quote, kill judges, behead judges, round house kick a judge into the concrete. another, what do you call seven justices from the colorado supreme court at the bottom of the ocean? a good start. this follows a year of severe threats made against prosecutors, who have investigated donald trump, an attack on an fbi field office in cincinnati after the fbi executed a search warrant at mar-a-lago, there have been threats on public officials like maricopa county supervisor, a man was arrested and convicted and sentenced to jail time for threatening to hang him. of course, the paul pelosi attack, this foll

also with me, nbc's vaughn hillyard. glen, the request was breaking around this time yesterday. then pretty quickly the supreme court fast tracked it. are you at all surprised by how quickly this has moved so far and how quickly might it move? >> you know, i would say i'm a little surprised, chris, but i'm heartened. to say, you know, time is of the essence right now would be an understatement. we have a presidential election coming up, we have a leading republican candidate for the nomination who is pending felony charges in state and federal courts. this is an issue that must be resolved before the election. particularly in the event donald trump is the republican nominee, i think the american people, the american voters have a right to know whether they will cast their vote for a convicted felon or a completely innocent exonerated man because he's been found not guilty on all the charges. so, we'll know more on december 20th, which is when the supreme court has directed the trump team to respond to jack smith's request that basically this case leapfrogged the d.c. federal cir

vaughn, what's the latest? >> timing is everything here. you're looking at all of these primaries beginning. iowa is going first on january 15th. new hampshire one week later on january 23rd. if the supreme court were to affirm the colorado supreme court's decision and disqualify donald trump from the ballot in colorado, that'll have a far-reaching impact, likely removing him from the ballot in all 50 states. of course, the concern of the republican party is potential nullification of republican electorate votes as they're selecting their nominee. his team does, in fact, intend to file the appeal and take their chances, take this to the u.s. supreme court. we expect them not to file the appeal until after christmas. sometime most likely next week but before january 4th, which is the requirement under the colorado supreme court's ruling for them to appeal if, in fact, donald trump were to stay on the ballot as part of the initial order. >> president biden hasn't weighed in on the merits of the case, but we heard from him this week, katty, sa

i want to bring in lisa rubin and nbc's vaughn hillyard, both with me here in new york. also with us, former federal prosecutor, renato mariotti. let's start with this breaking news. big move by jack smith. what do you make of it? >> i think it's a brilliant move. essentially what they're saying, we're going to do whatever we can to get a ruling on presidential immunity as we can. first we'll ask the court of appeals to expedite its briefing schedule, but not going to wait for them. in the meantime we're going to ask the supreme court for what's called certiorari where you leapfrog the court of appeals. my friend who is a law professor at the university of texas has written extensively about this. i asked him, how many times has this been used in recent years? it was granted zero times between august 2004 and february of '19. but 19 times since february of 2019. it became a popular procedural maneuver during the trump years. you see the special counsel using it against the same allies that were the big benefactors of this mechanism during the trump years. >> renato, why

a supreme court correspondent for usa today, nbc's vaughn hillyard is back with me here on set. how easy or not easy is it to say, no more primaries, let's do a caucus instead. >> a political party can do whatever they want to pick their nominee. they can switch to a caucus if they desire. they did hold one in colorado, the gop did in 2012. it's not like they haven't done it before. all of that said, is donald trump's i'm told, the legal team plans to file the appeal sometime next week after christmas, at least before january 4th. if they file that appeal before january 4th, his name will appear on the ballot, unless the supreme court steps in and says we affirm the decision of the supreme court. it's hard to believe that donald trump would not appear on the ballot. that said here, the stakes of this are high. obviously if the supreme court were to jump in, and rule one way or the other on this. >> critics of the colorado decision have warned it's a slippery slope, right. they say, well then you're just opening the door to all kinds of challenges. what are you hearing about that

we want to bring in vaughn hillyard and former rnc executive committee member jennifer horn. vaughn, start us off with maine. >> reporter: in the state of maine the decision of the secretary of state last night was much awaited. she had heard challenges in her role as secretary of state. this is where you get into the differences in what state law allows or puts the onus on a secretary of state to ultimately agent on. that's where the role of the maine secretary of state says it is her responsibility to determine whether a candidate is qualified to run for president of the united states under section 3 of the 14th amendment. listen to her discuss her decision. >> the weight of the evidence, all of the evidence, made clear that mr. trump was aware of the tinder laid by the effort to delegitimize the election, the election of 2020 and then chose to light a match on january 6th. >> reporter: now the expectation is that this will be appealed in the state of maine. it is currently saying that donald trump's name will stay on the ballot until the appeal. the secretary of state sugg

vaughn, i want to start with you. what is donald trump saying about these cases. >> the republican party was also party from the lawsuit. we still expect donald trump and his legal team to file their own appeal, but this from the colorado republican party automatically triggers that donald trump will remain on the ballot in the state of colorado unless the u.s. supreme court, number one, takes up the case, and affirms the decision, or declined to hear the case, allowing it to stand in the state of colorado. of course, we expect the u.s. supreme court here to likely take up the case, but it's a matter of when at this point. of course, there's the political timeline that is important, that undoubtedly they will be looking at here, but at the same time there's also a distinction between primary ballots and the general election ballot. part of the defense of the colorado republican party in their appeal filed last night was the claim that under the first amendment that political parties have their own rights to determine

give us a sense first with you, vaughn, what is donald trump saying right now? >> there is a lot on the line for donald trump. two major supreme court decisions pending. the supreme court could be ringing in the new year with donald trump and his legal team. for donald trump, he was on the campaign stage yesterday and he made it clear that he is putting pressure on the biden administration and the court system in turning his masses against what he says is political persecution. i think that this filing that just came out from his legal team to the supreme court to try to slow down the trial is just one example. they say that the fact that this case a rises in the vortex of political dispute warns caution, not haste. and donald trump wants to delay this case beyond the march 4 start date. i have to keep coming back to if we expect a three month long trial that will take us right into the heart of the summer. in july the national convention will decide the nominee. and donald trump only has the interests of putting the supreme court decisions off, not having them

vaughn, you first because we're looking at a whole bunch of cases that could really shape, reshape, int's going on with the court calendar, also what's happening with the election. why isn't joe biden focusing on this. >> he's doing a good job of filling the airspace. he was the one who decided to go to the courtroom to go and listen to the testimony himself, come out to the microphones and speak on his behalf. so often donald trump does his own talking. and that is where joe biden and the white house, they are striking that balance right now between calling attention to the words that the potential republican rival is saying from the stage or on his social media accounts versus also saying t w potentially by repeating everything that donald trump says, calling attention to it, the voters, whether it be democrats or independents, especially, will drown out and tune out the concerns that are so consistently highlighted about donald trump and what his presidency could mean. >> so look, nbc news spoke with a dozen or so white house and biden campaign officials on the president's strategy

vaughn, you first. what is the backlash today?nikki haley, there's a reality in this republican primary right now that donald trump has a sturdy base of loyalists. those voters, you could say it's one-third to half of the republican electorate that are solidly in his camp. you have to rely on republicans on the periphery who are opposed to donald trump, but also independent voters and folks that are right now saying that they are in the corner of chris christie, who in new hampshire has anywhere from 10% to 15% of support. when we talk about independents, look at new hampshire. up to 47% last go around, they were -- the republican primary electorate were registered independents here. for nikki haley, she cannot afford to turn off some of the folks who are considering coming to her camp. i want to let you listen to some voters on the ground in new hampshire who spoke with our reporter there. >> i wish she would have answered the question historically accurate. >> i think any candidate running for the presidency should understand th

want to bring in nbc news correspondent vaughn hillyard, carol lam, and former republican congressman from florida david jolly as well. vaughn, if you will, walk us through this ruling out of michigan. >> it is most notable the supreme court, we should understand, is not actually taking up the appeal from the litigants. instead, they denied to hear any arguments and to take up the case. but by doing so, they are all but affirming the lower court's decision, which in the state of michigan is to not disqualify donald trump from the ballot, like the state of colorado did. on the primary ballot. this is the clear distinction here. and there is one justice that is part of the dissent, he stood by the other justices in the lower court's decision, but he contended they should have taken up and at least heard the case, but on the merits of the difference between colorado state law and michigan state law are different when it comes to who can appear on a primary ballot, leaving it up to the state in michigan -- leaving it up to the political parties to simply sign the identities of individuals

vaughn, jump in here with the political ramifications of this.ediately, there was backlash from donald trump's allies and his rivals, rushing to his defense. i think all of them seeing a primary base -- the republican base is not going to like this. >> once again, the legal is stepping on the political. january 15th is the iowa caucus. one week later, the new hampshire primary. march 5th is the day of super tuesday when one-third of the delegates will be decided in republican primaries around the country here. you said it, ron desantis, nikki haley, chris christie even coming to his defense saying, it should be the voters, not judges, that decide who the nominee for the presidency is. in the general election, who the president is. of course, it's up to the supreme court to make the determination and interpret what the constitution says. i think it's important to note, there is one presidential candidate, hutchinson, he is polling at 1%, he is at the forefront of this, including the first presidential debate, saying that donald trump should be rem

joining us now, nbc news correspondent vaughn hillyard on the politics of all of this, msnbc legal analyst, lisa rubin, and former acting assistant attorney general for national security and nbc news legal analyst, mary mccord. i will start with you. does the supreme court say, yes, we will weigh in, and we will weigh in quickly? >> i think they will say that they will weigh in. that is fairly unusual procedure to seek what's called certify j they found other cases important enough take directly from a district court ruling without a stop at the circuit court of appeals on the way. what could be more important. the court did this also back in the nixon case, back when a watergate case was going to trial, against someone else involved in watergate, and the special counsel sought documents to subpoena them from president nixon who had refused and sought to quash that subpoena, and because those materials were needed, it was the tapes were needed for that prosecution, this is another case where the special counsel went straight from the district court up to the supreme court. the supreme cour
