warren gets the message and calls goldberg. we tried for the recess appointment but it did not work out. he finally resigns in june of 1969. at which point, nixon nominates warren burger. a fairly conservative judge from the eighth circuit. he was based in minnesota to become chief justice of the supreme court. we replaced a white liberal chief justice with a fairly conservative chief justice. that creates a more conservative court. this is only nixon's first appointment. nixon will get to make four supreme court appointments in his first term. the second is an unexpected one. justice fortas. one of the great ironies of this is johnson, by trying to promote fortas from associate justice to chief justice gives the way for fortas to collapse entirely and be removed. the public had been exposed to this idea that fortas is a little ethically challenged. we have the $15,000 deal at american university. he seemed to be consulting with lbj inappropriately. it was clear this guy was not a paragon of ethics. press start looking into his

how bad is this for warren? >> it's not good, for three reasons, certainly her act and ability to communicate and her character. she went last month traveling around iowa looking at people square in the face saying i will get it out there. she didn't. there is still more information out there. she knew this and should have been honest at the time. her credibility is questioned. she is not able to communicate her message. today she wasn't able to say one word about the state of the union because she is fighting this and also her character is being called into question. rhonda mcdaniel chairman of the dnc is asking the fwoor penalize her. she could have put it to bed a month ago when she had the opportunity but she didn't do it. so she is continuing to be on defense instead of offense. >> that is never a good place to be when you are launching a presidential. >> paul, is she still viable as a candidate? >> sure. i think she need to listen to get yours on the defense. if you are apologizing, you are losing, she has

she herself, senator warren was a single parent for many years.hese are all stories not too many people know about her and she began to share today in the speech. and to retell to a national audience and that could help her be more relatable. that is something that she hasn't really widely shared as a national figure to this point. the speech was very well received. it was coming, of course, under a bit of a cloud given that the story of her claiming native american heritage came back up again this week when the washington post discovered that document that showed she had applied as you said, for admission to the texas bar identifying as american indian. that seemed to follow her into this announcement today. and yet, she made no mention of her and her speech was -- to help to just remind everybody why she became a note worthy or nationally known political figure in the first place, talking about the middle class and fighting for the middle class. getting washington to be more receptive to the needs of the middle class. she really sort of recenter

let's discuss warren first. you heard the comments we made questioning whether president trump will be a free man in 2020. is this the fight fire with fire approach? >> i think it's a little bit of that. he also think we heard senator warren pontificating on what is actually true, there is a growing sentiment that you don't know what could happen. i don't know if we'll continue to see that refraining from her on the campaign trail, she may have been testing it out today. we might not hear it again. >> the trump campaign put out a statement specifically about warren's announcement, i don't think we've seen that on any other candidate announcement, and the president also tweeting this weekend about her. he is also taking a swipe an amy klobuchar and her snowy campaign start today. he's not going after other candidates for the most part, ana. why? >> and i saw the tweet about amy klobuchar and calling her a snow woman for standing there braving the snowfall. it made me chuckle, frankly, and roll my eyes. this is a

bishop, your take on elizabeth warren's campaign kickoff.progressive platform, is it the right call now heading into 2020? >> thank you for having me. i think it is. senator warren has continued to prove to the american people and democratic party she is a true leader interested in the types of policies that really resonate with a majority of americans. that isn't to say we don't have one of the most diverse and experienced groups of candidates right now in the democratic party, when you look at everyone from secretary castro to senators harris, gillibrand and so forth, yes, i think she's capable of doing a tremendous job and she brings the type of leadership and experience american people are hungry to see. >> let's talk about the one controversy, though, she is still under past fire for native-american heritage. she apologized for that and said it was something the media has to let go as well. she is trying to move on. the president posting her announcement refers to her as pocohantas, still, using this native-american stereotype to mock w

a warren aide says they are not disputing the fact that this was, in fact, elizabeth warren's own handwritingte they are making the point that this was not a part of the bar application but a form she filled out after she was already admitted to the bar. obviously a distinction they are trying to make but it is politically so noteworthy because as you said jim it's the first example where we appear to see an explicit example of warren describing herself as native american as opposed to previous examples where it may not have been clear whether it was warren or perhaps somebody else that filled out the forms. after this story, elizabeth warren is repeating her apology through a spokesperson, let me just read what she had to say. she said? a statement to cnn, senator warren has said she is not a citizen of any tribe and only tribes determine tribal citizenship. she is sorry that she was not more mindful of this earlier in her career. >> all of this comes after the apology senator warren made to cherokee leaders last week having to do with the dna test result she is released earlier. now the tim

elizabeth warren is not getting out of this race. she wants to get back to talking about her issues. she's got unimpeachable credentials as a progressive. her roll-out aside from this issue has so far been pretty good. she got good crowds in iowa when she first came out here. but this issue has dogged her really for as long as she's been a national figure. her team has always been very sensitive about talking about it. so has she. for a long time she wouldn't discuss this question at all. wouldn't discuss the racist way that the president talked about it. then they lean into this with the slickly produced web video they put together after she took a dna test, and today they finally decided to appear to throw in the towel on this, a complete mea culpa in the hopes this issue will go away so they can talk about something, anything else as she starts up this run for president. >> kimberly atkins, is this a case where the president has whatever you make of his tactics, straight up defined her, and even though she's looking for a national
