. >> we're back with andrew weissman. was donald trump's defense lawyer correct? >> as jack smith said in his papers to the d.c. circuit on this issue, he pointed out that exact quote saying that donald trump told the senate that he could be in fact prosecuted after he left office, and now that he is out of office, he says, no, i can't be if i have been acquitted. if i've been charged and acquitted by the senate, then there's a get out of jail free card that he cannot be prosecuted. he pounlts out that inconsistency. and this really relies on what is call the impeachment judgment clause which says that -- >> let's get into it, andrew. >> so the clause says if you have been impeached and you have been convicted, then you are subject afterwards to being criminally prosecuted. meaning just because you've been cleared from office doesn't mean that you can't face criminal prosecution. donald trump says that has a negative implication. if you've been acquitted by the senate, then you cannot be. and that is really going to be a bit of a battle ground in the d.c. circuit.

former top official with the justice department, msnbc legal analyst andrew weissman.ith the fact that not a single judge requested a vote, which feels to a nonlawyer like me significant. what does that tell you about the weakness of the case, about trump's clear potential desire to try to get the supreme court to take this case up? >> sure, well, this -- having just watched you and clare, this might be the legal equivalent to her analogy to the bus and the dog. >> keep it going. >> this is basically -- he lost the first time around by a panel of d.c. judges, three judges. and as is his right, he asked whether the full court of 11 full-time sitting judges would hear it, and they said no. the fact that not one of the judges asked for a vote to record how the vote went doesn't necessarily mean that it was unanimous. but it definitely is a sign of the weakness of the case. it could be that one of those judges who didn't necessarily agree with the decision understood that there were not enough votes and there was no reason to have a vote. it also could be because of their

interference case, and we are here discussing that, and i want to bring in former fbi council, andrew weissman. where do you think this headed? >> well, obviously the discussion of the s.e.a.l. team 6, that was the sound bite and the hard question for donald trump's team. i think the other thing for people to keep their eye on is not the merits, and it seems clear to me that the d.c. circuit is not going to say that the president is -- the former president is immune. i am interested in the issues that came up having to do with timing of when this case can get back on track. so there are two points about that. one is there was a suggestion from some of the judges and questioning about whether the case should go back to judge chutkan for some fact finding if the court were to say that the court needs to -- the district court needs to decide what is within the president's functions and what is not within the president's functions, and whether he was acting as president or whether he was acting as somebody seeking the office as a campaign official. very similar to a prior case they decided, and al

also with us is andrew weissman and john heilemann. ken dilanian, what can we expect? which is an interesting development. we're expecting donald trump to arrive at some point. these are appellate arguments. generally the defendant doesn't show up to court. that's created a heightened atmosphere around here, a much larger police presence than i'm used to seeing at a typical appellate argument. we're going to see rather lengthy arguments here in front of these three judges because there are some weighty issues at play here even though most legal experts don't think this is a close call, the idea that a former president cannot be charged with any contact in office whatsoever. that's really not supported in our traditions and our law, particularly if you listen to what jack smith says about the matter. there is no case law or precedent here. donald trump is arguing not only is he immune, but this prosecution is improper under the double jeopardy provision because he was already impeached and acquitted in the senate. of course, jack smith responds these are different charg
