good evening, wendell. >> good evening. the president is meeting right now with the democratic leaders of the house and senate, talking about a plan to cut the deficit and raise the debt ceiling. less than two weeks to go before the nation runs out of borrowing authority. they are still debating what they say has less than a chance of passing and even less with getting signature. with time running out on the borrowing authority, senate considered a house pass deficit cutting plan that democrats said had less than one chance in a million. >> does the half baked concoction of ideas that don't hold together, that don't add up, that would actually further threaten the economic recovery. >> theydynied report they were close to spending cut but no increase tax revenue. >> there is no deal, not close to a deal. >> boehner himself warned the deficit must be cut and the debt ceiling raised to protect the country's credit rating. >> if the united states of america debt rating gets downgraded, every interest rate in america will go up

and now, wendell, the main reason for the veto threat? >>reporter: the requirement they have to vote against on raising the debt ceiling by the end the year. democrats and the house and congress say that makes today's vote in the house of representatives pointless because the senate will not pass that plan and it is the same argument that house speaker boehner used when he argued the president's call for higher taxes was pointless because it could not get through the house. republicans say the president objects to a second vote for political reasons. today, white house press secretary carney denied that and he said another fight five months from now could slow the economic recovery and he cast speaker boehner as the grinch. >> the most important economic season in the country and at a time when people do not want to worry whether their interest rates going to go up, their mortgage payments and student listen bills, and their credit card payments especially if they are buying gifts for the holidays. >> 53 senators, 51 democrats and the two

, wendell. the president really made three points. first of all, as i say, he laid out the plan about 1.6 trillion in spending cuts. 1.2 trillion in revenue increases from closing loopholes and ending deductions. he said he is calling congressional leaders to the white house at 11:00 a.m. tomorrow to find out some way to avert default but he did did add he has been talking to treasury secretary gitedner about the possibility of default and how the government will handle that. so he, at least for the first time, seems to be indicating default is, while a very unpleasant, a real possibility and thirdly he really took off after the republicans said can they say yes to anything and while democrats have been able to step up, that republicans have not shown the capacity to make any tough decisions. again, this is the comments of the president. we're going to hear from speaker boehner in just a few minutes. wendell, what can you add to it and what are you hearing there at the white house about really s

this is 20 years before oliver wendell holmes would make that stand in thinking about free speech. i think free speech and other issues of civil liberties during the period of the american status is really growing. these issues are quite connected. so, in the supreme court decision, which upheld the power of the state to vaccinate peop people, the court nodded at the end of its decision which essentially compared the right to order vaccination, to the right to compel an invasion, a military invasion. the court nodded to individually to ought not to be so easily invaded. the court said the vaccination measures must be reasonable. they must not be arbitrary. and as an example, the court went on to talk as judges do once they've already made the ruling, about the case of someone who could prove to a court of law that because of their medical background and medical history, their medical condition, vaccines pose a special harm, special dangers. that in such a case the supreme court said, of course it would be a violation of that person's liberty to vaccinate them, to order them to be v

jenna: wow a lot to keep track of there, wendell. thanks very much for "the rundown." more of course as we get it. jon: as white house and congress wrestle with the debt ceiling debate new weekly jobless numbers are in today. the numbers of americans filing for first time unemployment claims actually dropped to 398,000 last week. that's the lowest level since early april. it's a sign the job market could be on the upswing after this long, long slump. jenna: we should mention though those numbers are revised every week and for last four weeks they have been revised higher. we'll see what stand and what indication of a job market it will actually be. there is also a new report on health care costs in that health care will account for one out of every five dollars spent in the u.s. by 2020. the centers for medicare & medicaid services predicts the government will pick up half the tab. just two years ago the government paid for 44% of the nation's health care. this new forecast is based on increasing costs and millions of americans who will be covered under the health care

oliver wendell holmes was asked by his law clerk, he said this is unjust. holmes said young man, we're not in the justice business. we're in the law business. that distinction is important. our legal system is based on a combination of factors -- preserving the privacy of defendant, he has his rights given to him, no junk science. we keep out evidence that might be relevant but it's too prejudicial. we're not on a scientific quest for truth. we're not trying to do justice for caylee or any particular person. we're trying to have a verdict consistent with constitutional rights. the system as a whole should be just, but it will in a given case produce innocent verdicts for guilty people. that's just the way it turns out. and that's the way it should turn out if we believe better ten guilty go free than one innocent be wrongly confined. one thing about tv in the courtroom, what does -- i agree with you, piers -- it makes trials look like reality shows. they would never end a television show with this kind of uncertainty, with all these questions unresolved. it
