[ gunshot ] [ gunshot ] [ gunshot ] cnn's don lemon spoke with the attorney for william bryan, the man who recorded the video. >> did he call 911 when this was happening? >> he does not call 911. to my knowledge. i don't think there's any evidence that he did. >> because you said -- you said that you did everything he could. but he did not call 911. but he did record it. >> well, you can't record and call 911 at the same time. not on the same phone. >> i think people are happy that this video is out there, right? because it helps with this case. but i think -- >> it is the case. >> i think people are understanding -- people are having a hard time understanding why it was more important for him to record than call 911. can you explain that? >> well, i'm not going to speak for him or relay what he said. but you have seen the video and you're familiar with the circumstances. it is absolutely impossible under the circumstances that people around the neighborhood weren't calling. so there's every reason to believe that that was happening. >> don also spoke with the fiance of the ma

>> the video was filmed by one of the individuals i consider a suspect, which is william bryan. he is one of the people who initially made a call about mr. arbury's presence in the neighborhood. he pursued mr. arbury and eventually he was present afor his murder. >> what are you trying to get answered about what happened on that day in that moment? how has this case been handled up until now? >> i'm most concerned about the corruption. the police department should have arrested these men on the day of the shooting. all they needed was probable cause a crime was committed. beyond that, the district attorney barring statements that justified the shooting and what role that the, one of the shooters' relationship witness the district attorney's office played and why they're still free today. >> what is your perspective? you said there's been a little bit of corruption you believe in the way it's handled. how have the police and the district attorney's office been handling this case in the way that there's been a delay in making an arrest so far? this is something that as we mentione

gough, on behalf of william bryan, also known as roddie, is he wasn't working with the mcmichaels, hescene by the mcmichaels and he wasn't videoing in any way to help the mcmichaels. is that all true from your perspective? >> he wasn't there for the mcmichaels at all. i can say that and he doesn't have any relationship with the mcmichaels. >> and the one sticking point that aye heard you try to explain before but hasn't met satisfaction with me yet is when you see something that you know is wrong, even though you're videotaping it in the molt, eme efsh though things happened before that he didn't videotape, you call the police. i don't care about his education. everybody knows that. you can be in high school. i've met many people, so have you, in high school who will eat our lunch despaite owl our education intellectually. why didn't he call 911? >> well, first of all, he can't use the phone for a phone ca call -- >> i know, you can hang up and call 911. stop videotaping and call 911. >> chris, chris -- >> yes. >> with all due respect. >> please. >> feel free to give the answer for me

william roddy bryan. he was on the show. he didn't want to talk. attorney didn't want him to talk thatch. bryan's attorney, though, kevin gough, is back he says to make the case for his client to you. welcome back to "prime time" counselor. what we have learned from the false imprisonment warrant is the accused did attempt to confine and detain arbery, without legal authority, to attempt to confine utilizing his vehicle on multiple occasions with the intent of confining and detaining arbery. we saw the same thing from the mcmichaels in the incident report. is that true? >> sir, mr. bryan has committed to crime. he bears no criminal responsibility in the tragic death of mr. arbery. we have demanded a speedy trial. and we're entitled to it. and we want to know when we can set this case down for trial. and that's -- that's what i'm here to talk about. >> justice delayed is justice denied. but the question is, if you want people to believe he's committed no crime, explain why the mcmichaels and the gbi, both have determined that he tried to detain mr.

william bryan jr.ded video of arbery being chased, shot and killed in a georgia neighborhood back in february is now charged with murder and criminal attempt to commit false imprisonment. a father and son are already charged with murder. omar villafranca has been following this story for us. >> he tried to block my son off on so many occasions while trying to get away. >> reporter: ahmaud arbery's father marcus and his attorney ben crump say they're encouraged by the arrest of william roddie bryan, the man who recorded the cell phone video of arbery's death. >> you can look at the video for yourself and see that the evidence fits the crimes that he has been charged with. >> reporter: kevin goff is the attorney for bryan. he has not spoken to the media since his client's arrest but held a press conference earlier this week. >> mr. bryan has committed no crime and bears no criminal responsibility in the death of ahmaud arbery. >> reporter: travis and gregory mcmike alwere arrested and charged with murder

state investigators say there could be more charges coming, saying they're looking at william roddy bryan, a neighbor of mcmichael's, who took the cell phone video. >> i'm not proud that i shot the video. but maybe it helps in the end. >> reporter: the state attorney general has officially asked the u.s. department of justice to investigate the handling of the case. did you guys ever have what they call the talk, the conversation that many parents of color often have with their children? >> many occasions, yes. >> fact is the talk doesn't work. wanda cooper could have had a conversation with ahmaud about not stepping by property under construction or not running away from men with guns as they chase you and get shot and fight. the problem is not with the victims. the problem is with the system that continues to allow this to happen. it's time for us now to begin to speak truth to the systems that are allowing this thing to happen over and over and over again. >> reporter: the talk did not save ahmaud, nor will the justice system bring him back. his parents pray his dying will not be in va
