i'm willie geist. with us this morning, msnbc contributor mike barnicle. former united states senator and msnbc political analyst, claire mccaskill. and white house editor for "politico," sam stein. we wake up to some news this morning. a redacted copy of the affidavit used to justify the search warrant executed at donald trump's mar-a-lago estate will be made available to the public by at least noon today, possibly this morning. federal magistrate judge rhinehart yesterday ordered it to be unsealed after the justice department submitted the redacted version for him to review. in the order, he outlined which sections of the affidavit the government redacted before public release, saying, i find the government has met its burden of finding a compelling reason, a good cause, to seal portions of the affidavit. because disclosure would reveal the identity of witnesses, law enforcement, uncharged parties, the investigator's strategy, direction, scope, sources, and methods and grand jury information protecte

i'm willie geist.ight into the big overnight development into the justice department investigation looking at donald trump. sources now telling "the new york times" the government has recovered more than 300 documents marked as classified from the former president's estate in florida. the first batch returned in january included more than 150 classified documents. according to the "times," quote, the number ignited intense concern at the justice department and helped trigger the criminal investigation that led fbi agents to swoop into mar-a-lago this month, seeking to recover more. a number of people briefed on the matter telling the "times," the former president personally went through 15 boxes beforehand beforehanding them over in january. quote, the highly sensitive nature of some of the material in the boxes prompted archives officials to refer the matter to the justice department which, within month, had convened a grand jury investigation. the government retrieved a second set of documents from t

and, you know, the argument is bonnie willis is democratic district attorney.political. that's the argument from trump allies and so game on, we're going to politicize this. we're going to make this a political issue, we're going to make the argument that bonnie willis is ignoring crime in atlanta, escalating murder rates, violence on the rise and instead focusing on donald trump so they're going to argue that this is a -- that this is disqualifying on its face and bonnie willis should be replaced. georgia recall law is exceedingly stringent and you need 30% of all the registered voters in the relevant jurisdiction. in fulton county that's 800,000 voters. 300,000 would be needed to sign those signatures. that's a pretty steep haul for the recall folks. but i don't think they're really thinking about getting this on the ballot. this is all about politics muddying the water and making the argument that somehow the investigation is political and therefore illegitimate. >> and from your report that they would consider that a win, which is incredible to say this, ri

in a court filing today, fani willis said this. motion purportedly requesting partial quashing of the subpoena, senator graham insists that each and every possible topic of grand jury inquiry is forbidden. joining us now is gwen keys fleming, former district attorney for the decab county, georgia and corner other of the report, fulton county georgia's trump investigation. thank you very much for joining us tonight with your local experience there it is incredibly helpful. and knowing district attorney fani willis as you do and what she might do next. on the lindsey graham subpoena, as we are seeing it, it's taken a little bit longer than some of these local georgia subpoenas for example, the governor's subpoena to work it out through the federal and state courts. what do you expect next in that? >> well, i think what we will have next is the district court judge will decide for a third time the extent to which senator graham will have to appear before the grand jury. i say that because she ruled on the original motion to quash agai

>> that's right, willie. this is the most significant rebuttal we've seen from the justice department to the trump team. i think we're learning more from this than we ever did from the warrant or the affidavit that we were waiting for last week. now, we're learning this is not just a matter of the president taking back records that should have been stored in the national archives. in fact, they go as so specific to say that in a footnote that this is a matter of taking classified document where is they should not be and obstruction. and they talk about how they believe that some documents were taken from a storage room. that they were first today, look, here's everything. the trump lawyer signed it. handing everything over. then they get significant information that there was still more left behind. they were told anything left behind would be in a storage room. that's also what the trump legal team said, they didn't need to go all over the premises. they said just alone in that storage room there were 76 doc

one of them has already been able to disqualify or get fani willis disqualified. she held a fund-raiser for a political opponent of state senator -- one of the state senators that's part of this fake elector scheme, the sham that tried to illegitimately certify president donald trump in the wake of the 2020 election as the rightful winner of the state of georgia. 11 of these fake electors thought that because burt jones was successful in disqualifying fani willis, they, too, could prove there's a political motivation behind fani willis's investigation. a judge disagreed, saying there's no indication that there's any politics at play with fani willis related to these fake electors, so they failed in their attempt. guys, this is a, you know, a lot of moving parts here. remember, this all started with the now infamous phone call between former president trump and secretary of state here in georgia, brad raffensperger. it has expanded to include these fake electors as well as rudy giuliani, lindsey graham, who's still in a lot of legal wrangling as to whether or not h

the da willis even inscribed camp as a mere witness who acted honorably.he's fighting -- he probably does want to be on trump's bedside. something else being investigated in fulton county grand sure er the efforts by the trump campaign to create a fake list of electors to cast fraudulent electoral votes for congress for certification. the da has notified all 16 fake electors in the state, letting them know that they too are considered targets of the investigation. not witnesses. we know from house january six committee hearings and from supportive justice investigations that giuliani, eastman, john eastman, another trump lawyer and jeffrey clark, our former just apartment official. were involved in the fake elector scheme in georgia and in other states. you probably knew about all of this. except this. kanye west. george investigators report -- testimony from one of kanye's former publicist who allegedly pressured election worker were eager to learn more about this particular aspect of the case but now we've reached the head honcho. former president of the

look, i think, willie, there's a couple important points here.usly, there's a lot of support for president biden's policy. there is an important segment of his base, john della volpe spoke to that, younger voters for whom this is an important move. you have to look at this in totality. i don't know that we know holistically it is the best political move, possibly before the midterm elections where biden and democrats need to juice their base and the democratic electorate. it could be helpful. but when you look at the 2024 scenario where it is not just how many votes you win but in which battleground states you win those votes, there are a lot of americans who did not go to school or did go to school and pay off their loans, who are going to be resentful of fact that they are now paying for everybody else. when the government engages in loan forgiveness, it's the taxpayer that is engaging in loan forgiveness. i think there's a reason why when you look at the key senate races this year, whether it is tim ryan in ohio, senator bennett in colorado, s

told that yes, he is a target of the criminal investigation by fulton county district attorney fani willislection fraud in georgia's 2020 election. prosecutors informed rudy giuliani's lawyers today that he is a target. before his scheduled testimony to the grand jury on wednesday. also today, a federal judge in atlanta ruled a republican senator south carolina lindsey graham must testify in fulton county. the judge rejected senator graham's argument that he cannot be compelled to testify because he was acting in his official senate duties when he made a phone call to georgia's secretary of state asking about the vote count in the presidential election. the judge said the district attorney is shown extraordinary circumstances and a special need for senator graham's testimony on issues relating to alleged intents to influence or disrupt the lawful administration of georgia's 2022 elections. lindsey graham is scheduled to testify before that grand jury next week. senator graham says he appeals to plans to appeal the ruling. joining us is glenn kirschner, former assistant u.s. attorney and an
