the gas station wrote down the license plate and went to michael dunn's home and then brought him out the issue of race was largely ignored in the trial. dunn wrote to family members that he thinks the justice system is unfair and biased to african-americans. he wrote -- but that was never brought up in court. >> there is great sensitivity to bring up race in the zimmerman case and in this case, we have to ask questions why. are notthe south, they ready to talk about these issues . i think the state prosecution is concerned to bring it up. these statements and michael dunn's actions show that he was a threat. that he willthing serve at least 60 years in prison. of these statements, it is clear he is a threat. >> the attorney for jordan davis's family released a video formerael dunn's neighbor. he said he had a history of violent behavior and cocaine use and insurance fraud and even bragged about once putting a hit out on someone. his first wife said that he had held a gun to her head and threatened to kill her. this is an interview of his former neighbor. >> he acted like he was smart

that's what many are asking about the trial of michael dunn. the only testimony supporting dunn's self-defense claim was his own. and even that was contradicted by other witnesses. dunn was convicted on four other counts. but the jury deadlocked on the charge related to killing jordan davis. and for davis' parents, that's not an abstract legal issue. it's very personal. abc's byron pitts sat down with them for our series "crime and punishment." >> it has been an incredibly long 15 months for you two. it was his father ron davis who got the call. his boy had been shot outside a suburban convenience store the day after thanksgiving. >> all i remember hearing the doctor say is mr. davis, i'm so sorry, we were unable to revive -- >> and then he made that long walk a parent would rather die than ever take. >> and i asked to see my son. they said wait a minute, we don't want you to see him like that. and so they pulled a sheet up to his neck like that. when i saw him, he was laying there peacefully. had a little blood on his nose and his eye was open

michael dunn says it was all in self defense. his girlfriend when they pulled into a convenience store to get a bottle of wine. she went in to get the wine. next to his car, four teenagers playing very loud music. he didn't like the music, he asked them to turn it down. words were exchanged, so was gunfire. at least one-way gunfire was shot. the woman who is at the center of testifying about what the scene was like is that fiancfia rhonda auro rhonda our. have a listen. >> did the defendant say anything about the music when he parked the car next to the red car? >> yes. >> what did the defendant say? >> i hate that thug music. >> and what was your response to the defendant? >> i said, yes, i know. >> rhonda rouer, talking about thug music, four black teenagers, and the defendant himself has had some pretty choice words to describe the african-american community, at least in the jail where he has been held since all of this happened. my next guest has a lot to say about that. he's a prominent pastor at a local church here, and he

i think on retrial the prosecution is going to focus heavily on the cross-examination of michael dunn him than they did in the first trial. >> beside the letter, dunn's phone calls were also considered irrelevant. here is what he said on one phone call to his fiancee. >> so being in a room by myself kind of sucks, but i guess it'd would be better than being in a room with them animals. >> well, you know, they probably wouldn't think too highly about what is going on. and so it is best. but i can only imagine. >> now, it's better than being in a room with those animals. couldn't the prosecution when they were cross examining -- when they were direct examining the fiancee, who was their witness, when he said he never mentioned a gun, couldn't they have played this phone call with him and her from jail saying even on this call he never mentioned a gun, and let them also hear the kinds of thoughts this man had by putting this into the trial? >> no. the judge would not have allowed that in. that statement would have been more prejudicial than probative. they could have gotten easily in the

the state might try and go after dunn's character using a letter michael dunn wrote from jail. quote, this jail is full of blacks and they all act like thugs. in is dunn writing. another. this may sound a bit radical, but if more people would arm themselves and kill these idiots when they're threatening you, eventually they may take the hint and change their behavior. i mean, if this were presented in front of this jury, it might have not only changed this juror's feeling, it might have changed others. >> this is toxic, explicit racism of the kind that you rarely get in courtrooms today. you know, a lot of times we're guessing. is this guy racist or not based on his conduct? well, here we have in writing very clear language from michael dunn himself just months after the shooting where he is clearly a racist with the capital r. that evidence should have come in. but i do not blame these jurors, as you say. they were not given the evidence. they were instructed to follow the law. they did follow the law. stand your ground was a great big problem for them. that's not their fault.

. >> with michael dunn. let's move forward, martin. you mentioned earlier there are protests planned for the week ahead. what do you know about these protests. >> reporter: well, i think right now they're just sort of being loosely organized. some talked about wearing black bands or wearing black arm bands or black ribbons. this is something that would be organized both here in jacksonville and they're trying to encourage it across the country. these are protests always designed to be peaceful. in fact, when i was talking to protesters as people were awaiting verdict, i said, well, if it doesn't go your way what do you predict is going to happen? no one ever suggested anything along the lines of violence. what they said is there would be protests. there would be a very forceful message said that this would not be tolerated and that laws need to change in the state of florida. but always, always it was peaceful and it was always to be within the laws of florida. don? >> all right. martin, thank you very much.

it was just after michael dunn left the reception that the shooting happened. himself has not commented publicly on his side of the story. but since being in jail he has written many letters. they've now been submitted as evidence. in a letter dated july 14th, presumably to his fiancee, he writes, "i just got off the phone with you and we were talking about how racist the blacks are up here. the more time i am exposed to these people the more prejudiced against them i become." in another letter to his grandmother he complains, "the blacks seem to be calling the shots in the media and the courts." in yet another letter he acknowledges comparisons to the trayvon martin shooting. "cory, my attorney, says i have a much stronger case of self-defense than zimmerman does." this case does seem to have a lot of parallels to the george zimmerman trial. right down to the prosecutors. >> jordan davis gasping for air. >> reporter: these are the same two who tried to get a conviction against zimmerman. >> i don't see how stand your ground applies there. but in this case, wit

michael dunn has never denied he shot and killed 17-year-old jordan davis after an argument over loud muse nick a parking lot. dunn testified he feared for his life even though police never found any evidence of a weapon in the car carrying davis and his friends. there's been a lot of speculation about how big a role if any race played in the killing and the trial. in a moment you're going to hear from the parents of jordan davis as they react to juror number 8. first we want you to hear from juror number 8, her take. she was one of just two african-americans on the jury. she was also the youngest juror, just 21 years old. here's what she told our cnn reporter. >> what did you think of michael dunn? >> i honestly think he was a good guy. i think he's a good guy. i don't think he hates everybody. i don't think he walks around wanting to shoot everybody. i think that he made bad decisions. >> you still think he's guilty of murder, though. >> yes. i really think he's guilty of murder, but not guilty as charged. >> first degree. you don't think he's guilty of first degree? >> i think he's
