vic lee, abc7 news. >> all right, vic. thanks very much. >>> a strange scene in oakland today when the police chief denied allegations about something that's not even public yet, about a crime lab scandal similar to the ones involving san francisco. laura anthony joins us from police headquarters. >> reporter: hi, cheryl. this was a highly unusual move. police chief anthony batts called a press conference at headquarters this afternoon to say anonymous allegation of misconduct against a crime lab technician is unfounded. now batts called this press conference this afternoon. he would not say whether the accusation has to do with the testing of drugs, d.n.a. or something else at the lab, which is on the sixth floor here. but he did say he wanted to nip a rumor in the bud before he leaks out. batts say the allegation came in as an anonymous phone call on december 22. >> we are look closely to the va lilty of all accusations. at this point in time, through the investigation over the last two weeks we have no reason to believe

vic lee has more. >> this is what the state fire marshal wants to prevent gas station fires.n this case caused by malfunctioning gas pump nozzles. drivers have reported 13 incidents of nozzles unexpectedly spewing gasoline. gasoline would freely spray. the nozzles are made by ohio based vapor system technologies. the clip which allows hand free pumping is the problem. there's a mechanism that prevents gas from flowing until the noz is inserted in the tank. the state says with the latch engaged the nozzle will continue fewing fuel even though the nozzle is not in the tank. >> there's a major safety and fire hazard risk here because of this malfunction. >> in may the state issued a bulletin asking gas stations with those nozzles to remove the hold open clip. in august it became mandatory with a deadline of october 15th. >> i did talk to a vsp executive which said they are ramping up the production of a new nozzle. they can shut down gas stations not in compliance. but a spokesman told me they would rather work with gas stations than impose any kind of sanction. vic lee. >> i th

vic lee looks into proposition 19. >> buying a joint could soon be as easy as buying a drink. last week the governor signed a law that makes possession into a minor infraction with a maximum fine of hundred dollars. but it's still illegal to sell marijuana unless it's for medical use. that could change. >> proposition 19 decriminalizes regular laces and taxes marijuana. >> joseph mcnamara was a police chief for 15 years. >> let's be honest, the drug war against marijuana has failed. anyone who wants marijuana in california can get it, yet we keep doing more and more of what has worked. >> mcnamara supports proposition 19. it would allow people to have up to an ounce of marijuana. you could also grow it at home. smoking pot would be banned public and schools. commercial production of marijuana would be allowed but to for that, each city and county would create their own regulation and impose taxes. >> it's a golden opportunity to strike a blow against the drug cartels and drug gangs and to greatly reduce violence and crime that flows from the prohibition of the drug. >> the cit
