if you go back to atkins and read the opinion, it's on the basis of an eighth amendment analysis of the twin pillars of the criminal law which are retribution and deterrence. the court makes the judgment that low i.q. means that you're less responsible and less likely able to be deterred. so the twin pillars of the criminal law don't really apply. but i'm not sure that the psychologists who do psychological testing and i.q. or the neuroscientists have really connected up the constitutional reasons why because it may be that they're substructures of i.q. that are more relevant to the eighth amendment question. it's not a general i.q. score that is ultimately relevant. in fact, the california supreme court has dealt with exactly that question of what subscales might be constitutional relevant rather than the global i.q. score. >> one question here which i think is very interesting. in my community, we strongly feel that diet plays a strong diagnosis of the violence we see, the intake of sugar which is heavily consumed is a factor. what is your take on that? >> diet certainly plays a role

but the atkins low-carb diet had problems too, it increased stress and chronic inflammation. a metabolic perspective, all calories are not along. and for the best long-term outcomes, avoid restricting any major nutrients, either fat or carb rate and focus on white bread, white rice and sugary foods. >> so everything in moderation, more healthy than not healthy. >> well not exactly. not exactly everything in moderation. our findings suggest that actually trying to restrict either carbs or fat is not the best way there. and instead to focus on the quality of the fats and the quality of the carbs. >> and that's where the low glycemic comes in. for people not familiar with that, give us a quick description of what that means. >> sure. well, you know, the traditional carbohydrates we've eaten for years, like stone cut oats, these traditional carbohydrates they slowly raise blood sugar slowly. so there isn't the same surge and crash. but all of the refined carbs that invaded our diets with the low-fat craze seems to lead to metabolic changes not only making us hungrier, but causing

this is a classic atkins diet. you can see it's very restrictive on carbs. that's 10%. 60% and 30% divided between protein and fat. it's difficult to stay on. for meat lovers they love it. the interesting part of this diet, it stoked metabolism the most. people were burning about 300 calories more each and every day because it's hard to break down protein and fat. so that's the good news. it also elevated the good cholesterol and lowered triglycerides. all good. >> does that make it the best diet? >> no, increased stre stress hormone called cortisol and inflammation. some pros but not the winner. >> low glycemic. >> we need a drum roll. it means, it's the diet that does not elevate your blood sugar. it's all things in moderation. a moderate amount of carbs, protein, fat. you see the breakdown, like perfect. >> everyone getting the idea we like the low glycemic. >> the key is we don't restrict carbs, but high-quality, high-fiber, don't increase blood sugar. beans, lent ills. >> the best. >> bumped not quite as much as the low carb, much we feel good about it.
