i'm tori campbell. this morning's retrial for a concord teacher accused of child molestation has been postponed. 46-year-old joseph martin has been in jail since last year after a former fifth grade student accused him of molestation and other students then came forward. martin initially faced 150 counts involving 14 boys. his first trial ended in august after the jury acquitted him of charges involving three students but were split on the other counts. >>> the chp officer accused of sharing nude photos taken off the cell phones of women he had arrested turned himself in today. officer shawn harrington has been accused of removing nude photos from the phones of at least two women and texting them. harrington, who resigned from the chp on wednesday, is scheduled to be arraigned this afternoon. ♪ >>> happening now -- a funeral service in roseville for sacramento sheriff's deputy danny oliver. oliver and placer county sheriff's detective michael davis were killed in the line of duty last month while invest

i'm tori campbell. the 49ers' defensive line backer, ray mcdonald, will not be charged following his domestic violence arrest back in august. ktvu's janine de la vega was there as the district attorney explained the reason behind the decision and janine joins us live. good afternoon, janine. >> reporter: good afternoon, tori. we just spoke fought d.a. charge and her supervisor. they both said that even though ray mcdonald apregnant fiance had injuries, there was insufficient evidence to prove a crime occurred. ray mcdonald was arrested at his home in august after his fiance called 911 911 during a birthday party for him. the d.a. said the investigation revealed that ray mcdonald and his fiancee that during an argument she hit him first. each of them blamed each other. mcdonald maintained he was trying to restrain her and get her out his house. he said he never punched her. >> both parties agree that jane doe truck ray mcdonald first and her injuries are consistent with restraint rather than attack. beca

i'm tori campbell. major traffic backups after a deadly crash in the south bay. it happened in a very busy area on hillsdale avenue in san jose. that's where we find ktvu's janine de la vega. janine, is the road back open yet? >> reporter: in the last two minutes, tori, they just opened up two lanes of hillsdale avenue. you can see two lanes are still closed. the turn lane coming from almaden expressway on himsdale and you can see there is the toe truck with the car involved in the accident. still sitting on the bed there. now, i just want to give you a sense of where we are. this is right near auto row on capitol expressway, just as it turns into hillsdale. this accident happened at 7:45. a car coming from almaden expressway, suddenly hit the side railing and overturned. witnesses saw the male driver crawl out of the car badly injured. paramedics rushed to the scene but the man did not survive. no other vehicles were hit. but many witnessed the accident and were shaken up by what they saw. >> another witness showed me where the person was and came over there and

good afternoon, i'm tori campbell. noelle walker joins us live from the san leandro station with what b.a.r.t. riders need to know. good afternoon. >> reporter: good afternoon, tori. we can hear the b.a.r.t. train honking coming into the station right now. just a short time ago, this stakes was packed with people whose commutes just stalled in their tracks but now within the last ten minutes or so, the b.a.r.t. trains here at the san leandro station have started running again. so this station is back up and running for business. take a look at this video we shot from chopper 2. this was shortly after that train stopped in its tracks. it was a fremont to daly city bound train stopped because of a death investigation first reported as a person under the train. now, b.a.r.t. is now saying that person was a 30-year-old adult female who died on the tracks and that witnesses reported seeing that woman step off the platform in front of the train. we talked to one of those witnesses. >> you heard the conductor panicking. there

i'm tori campbell. we're following developing news out of san jose where an active investigation is underway after police and firefighters found a body inside a burning car. ktvu's reporter joins us live from the scene to let us know what investigators believe happened. good afternoon. >> reporter: good afternoon, the body was found inside this parking garage on the second floor. police have part of that floor sectioned off. the coroner has arrived. and in determining how this person died, initial reports suggest the driver may have had a medical episode. just before 9:30, san jose fire got calls about a car accident and smoke coming from the second floor. when they arrived, they discovered the car hit a pillar and was on fire. after putting out the fire, they found a badly bushed person deseized inside the car -- deceased inside the car. another car caught fire. other cars may have been damaged due to the heat of the blaze. here's what one witness told us after he pulled into the garage. >> the car was
