melanie joins us live with all the details. >> reporter: we could have that decision any moment here.ith the almeida county sheriff's office is testifying. we heard from two other witnesses so far. people are coming out of the court and the decision could be made at any moment. we did hear from two other witnesses including home invasion victim. he described how he was in bed with his wife and somebody came into their home and said your daughter is okay but told them to turn over and said he would tie them up. there was a struggle that ensued and the victim said he said a couple of times to his wife honey get the gun to scare off the home invasion robber and the home invasion robber did leave the home. we also heard from a sergeant with the almeida county sheriff's office about responding to that scene. a lot of the cross examination here from matthew muller's attorney has focused on whether or not detectivess felt there was an urgent situation in which they needed to get a cell phone number and who the phone belonged to, a cell phone left behind presumably by the suspect on the scene

melanie was there for all the drama. no contest. that's the plea matthew entered for a june home invasion in dublin. mueller left the cell phone behind. key piece of evidence that led investigators to his south lake tahoe home. where they found more evidence. also linking him to march kidnapping in vallejo. police initially called the kidnapping a hoax. >> the attorney says the no condition test plea is a strategic move. >> everything we do here is done with an eye to federal court. >> that strategic move overlapping sentence if found guilty in the vallejo kidnapping case. >> binding agreement he will receive concurrent tame for whatever time he gets in if sacramento in the federal case. >> home invasion carries 11 years because the vallejo kidnapping could send him to prison much longer. >> decade as in plural. >> arraigned on federal complaint for vat lay oh, kidnapping. >> mess mental state will be component of what happens in sacramento. >> johnson says mueller will plead not guilty. >> federal complaint that mueller is answerin

. >> melanie woodrow was in sacramento for the hearing and joins us live. melanie? >> reporter: you may remember matthew muller is a former marine. he's a harvard educated attorney who is accused of not only kidnapping denise huskins but possibly in connection with other home invasions. now he'll be facing another harvard trained lawyer representing the u.s. attorney's office. we got a look at matthew muller today in court. this is a sketch of him. he was in plain clothes today. his attorney says likely the clothes that he was initially arrested in. he'll be entering a not guilty plea on his behalf. at issue in court is whether or not he'd be fully shackled in the future. the judge decided yes. muller's family and friends were also in court today. his family did not want to speak on camera including his mom who investigators spoke to prior to his arrest after muller left his cell phone behind in a dublin home invasion, they tracked the phone to his family who in turn pointed investigators to his south lake tahoe home where they found muller and more evidence linking
