gloria borger joins us now as well as jeff toobin and phil mudd. jeff, just from a legal standpoint, what is he facing if he doesn't go to the grand jury, if he doesn't hand over the documents he's been asked to? >> legally this is a very simple situation. if he simply just doesn't comply, doesn't take the fifth, just doesn't show up, mueller goes to the judge who is supervising the grand jury, asks him to be held in contempt. they hold him in contempt because he didn't show up. then the marshals go get him, and he is held for up to 18 months, where he has the keys to the cell himself, just agreeing to testify. i don't think mueller wants to do that. i think mueller wants to dial down the controversy, talk to his lawyer, say just, you know, get him in here. we don't want this sort of drama. and this is a completely legitimate grand jury subpoena, and his arguments -- you know, nunberg's arguments that it's ridiculous, it's a waste of time, those are not legal arguments, and no judge is going to pay the slightest bit of attention to them. >> phil, if

jeff toobin, to you. this notion that trump lawyers and dowd specifically was, the way "the times" put it, broaching this idea, dangling these pardons in front of manafort and flynn, what concerns might team trump have had ahead of these guys talking to mueller? >> i think it shows the ideas the president ha to short circuit the investigation. whether the president can direct the fire iing, the dismissal of mueller. he can end the investigation in other ways, but simply taking away the targets, by pardoning the people who might be prosecutor. flynn has already pled guilty. manafort, of course, has not pled guilty and is preparing to go to trial. the other issue that pardons raise is that it could be something that you would dangle the possibility of to encourage people not to cooperate with the mueller investigation. >> isn't that the crux of this potentially? you know you know, you want to appease these two guys who may have potential dirt so that they don't cooperate with bob mueller? >> well, that is c

geragos, when you looked at the agreement, did it look like a cut and paste job, like sort of a -- jeff toobin said it looked kind of like a form that had been used before. i don't know how a lawyer would figure that out, but did it you? >> well, without discloser wing the clientss are, i've dealt with keith davidson on numerous occasions. i've seen this iteration countless time. so, yes, this is a cut and paste. generally there's also a declaration under penalty of perjury that accompanies these things. and there's generally what i think michael was referring to is generally what you do is you turn over all of the texts, photos, and things of that nature and then sign a declaration that you don't have anything else in your possession. that's the one component that we haven't seen here, and i suspect that's what michael's referring to when he says that he hasn't turned over everything else because this is really standard operating procedure in hollywood and amongst high-profile people. and, remember, he was -- during this time, he was a tv star. this is something that, you know, in a post-tmz
