joel: this is the genius of john marshall. john marshall was a federalist.was the last federalist in this country, basically. every single judge appointed to the court after john marshall was a republican. appointed by a republican president determined to overturn the jurisprudence of john marshall. and john marshall nevertheless, he participated in more than 1100 decisions in his 34 years on the court. in that time, more than half of those opinions, john marshall wrote himself, he wrote the longhand himself, and all but 35 of his opinions are unanimous. what does that say? that is a record we cannot possibly hope to equal today. john marshall had the personality and intellect to bring people together, to find common ground, to forge some sort of compromise in situations where nobody for a compromise -- thought a compromise was possible. he was talking to a court appointed to be his opponents. people naturally liked him, they found him credible him and he worked very hard to find a middle ground. that is what is missing in the court today and what is so impo

and john marshall turned him down. instead he concentrated on his successful and lucrative private practice and argued the case against the supreme court but he impressed everyone that hurt his arguments. marshall finally agreed to become one of the emissaries sent to france to handle the troubles we were having. france was waging a war against the united states. john adams decided to negotiate his way out of it. they went to meet with the minister of foreign affairs. an intermediary told them you are going to need to give us money. and john jay came back without paying the bribe . people were very upset with france for understandable reasons. congress eventually declared a naval war passing a series of statute's and that-- allowing naval vessels to attack french naval vessels. so that first foray did not work out so well but apparently john adams was impressed with john marshall. he offered to make a john marshall secretary of war. john adams sent his name to the senate anyway and before the senate could act, the secre

then, i looked at the wonderful collection that charles hobson edited from the papers of john marshall. and he's taken most of the known marshall documents with a huge staff, publish them in hard copy books and they are a treasure trove. among others, there are almost 2 volumes of marshall's business records from the 80s and 90s. in these records, we begin to see, john marshall becoming a slave owner. unlike his cousin, tommy jefferson, john marshall did not inherit hunter's place. he was given one slave at his wedding, the slave robin who he later claims he would like to emancipate. and later on his father gave him a couple other slaves but basically john marshall does not come from a wealthy background and acquire slaves, the good old-fashioned american way by buying them. what we see in his personal record is he is constantly buying slaves. this is again, fascinating information. i just want to read you a little bit of this, i don't like reading from tech but is so detailed i have to stare down. marshall buys a slave moses for 74 pounds, he's not using dollars, he also buys shoes, o
