temperatures a little bit cooler yesterday morning. upper 20s in windsor. novato reporting 29. so many of us below freezing this morning. 34 in concord. 36 right now in moraga. you can see the frost advisory is for the inner east bay valley. the freeze warning for our north bay valley locations and it goes until 9:00 this morning. when i come back i'll have a look at your afternoon highs today target at the fremont hub. one of the suspects fired a gun into the air outside of the store. police later tracked that suspect and made the aarrest of suspects in newark. right now police haven't told us how many were involved. . >>> new this morning, a water main break in san francisco last night stoppe water flooded china town underground pipes broke. and shut down the entire cable car. there were three water main breaks and a 6" break at kansas and california. this was first reported at about 9:00 last night. right now many have no wart in this area while the repairs are being made. three homes were damaged with flooding garages and basements. the flooding may also have been because of a crash on the street. there are reports, two people were hurt in this crash. they were taken to a hospital and treated for injuries. >>> time is 4:03 the chp in monte roadway county investigating another projectile. something thrown at a moving car in the prunedale area. it happened on (vo 2) get 0.9% during the subaru share the love event. >>> new details this morning about the chaos and perhaps cleanup efforts inside the white house after the president's decision to freeze military aid to ukraine. a confidential white house review has found there was an extensive effort to justify the move after the fact as well as to debate about whether it was even legal. suzanne malveaux live on capitol hill. no hearings this week, suzanne, but a lot of new information coming to light. >> reporter: that's right, john. a break from the hearings. but, yes, there is new information here. this is coming from a "washington post" report here. what it does is it reveals after the fact the level within the white house the debate, the division, the tension over the justification for delaying ukrainian aid. when house democrats launched their impeachment inquiry into president trump, the white house quickly responded launching a confidential internal review of his skidecision to withhold nea $400 million of military aid to ukraine. the white house counsel's office uncovering hundreds of documents with three sources telling the paper one early august email between mick mulvaney and budget officials shows the white house looking for a way to explain the freeze. after trump already paused security assistance funds in mid-july. that conversation coming days after the white house counsel's office learned about the whistle-blower complaint. scrutinizing the july 25th phone call with ukraine's leader. budget lawyers ultimately decided it was legal to withhold the security assistance. a person familiar with the review confirms to cnn. as long as it was called temporary. the office of management and budget writing in a statement sunday there was a legal consensus at every step of the way that the money could be withheld in order to conduct the policy review. a source tells cnn that some trump administration officials feared the money would never be released. the white house eventually sending the military funding to ukraine in september. two days after the house was informed of the whistle-blower complaint which sparked the impeachment inquiry focusing on whether trump abused his power by using that military aid and a possible meeting in washington to pressure ukraine to investigate his political rivals. meanwhile, after two weeks of public hearings, house democrats pressing forward. >> every single day provides new and incriminating evidence. so it's a little hard to tell you that this thing is done. >> reporter: trump's allies once again using this defense. >> they didn't hear anybody say when they were asked bribery, no. extortion, no. quid pro quo for the aid, no. preconditions for meeting? >> i think cleanup effort is a perfect way to describe it. it's clear that the white house after the whistle-blower came forward and sort of talked to the inspector general saw that this was problematic. i think that this evidence that they did this investigation and saw all these emails shows that they needed to find some sort of justification for freezing aid to ukraine that had nothing to do with the pressure on ukraine for these investigations. and it sounds like they turned up some problematic emails. the question is will we ever see those and the answer for the next few months is going to be no. because the white house has been stonewalling. and i think it's just a reminder of how much we don't know even after seeing these hearings for the past two weeks. you know, it's kind of like a puzzle and we're seeing sort of the pieces come together on the outside and closer to the middle. but there's still those pieces in the middle and we don't know exactly what mulvaney was doing. it's interesting to, again, remind us the questions that are still out there. >> but mulvaney knows, right? and those documents tell a story. it's extraordinary we're not going to see them. >> and mulvaney's fingerprints are all over these emails. what we're seeing from them is pressure from mulvaney on the omb to find at least an excuse to hold the money. we're also seeing that that was not the decision that the nsc and the state department wanted with regards to the money. talk about the frustration and what could lead from such inner agency disagreements. >> well, we saw it in the top story today with eddie gallagher that there seems to be kind of two governments. the vast government that works through an inner agency process and then the president who watches foxis frustration. so i think this story is interesting in a couple of dprounds. the fact that this story leaked means the nooifs are out for mick mulvaney. it made no bones that mulvaney is the person responsible. there's some chatter in washington that white house counsel cipollone wants to come to the chief of staff. the reason we may see some of these records is when white house advisers talk to each other, that's executive privilege. as soon as white house advisers start talking to agencies, those are public records. so we are likely to see them. the timing is unclear of when we'll see them. but we'll see them than if they were talking to each other. >> before christmas seems likely. then this story broke at friday night at 9:00 which is a lawyer for lev parnas who is this guy who's been indicted for shady dealings with rudy giuliani. this lawyer says that devin nunes was part of some kind of a meeting with this ukrainian investigator who was fired and wants to dig up dirt on joe bid
