joining us now is nbc news justice correspondent pete williams. pete, the white houses. so what happens now and will the national archives then turn over those documents to the january 6th committee? >> reporter: depends on what a federal judge says. there have been three letters from the white house now waving executive privilege. first sort nf response to a request from the committee that the archives be passed along. two other letters include the one last night directly responding to president trump's assertion of executive privilege and the white house saying "we don't agree." the former president asked a federal court to block this because without intervention by the court, the archivist will begin handing them over november 12th. a hearing november 4th evalue ace request. and then wanting to write legislation, needs to have a legislative purpose and has an identified one and secondly, he still has some level of executive privilege even though he's the former president. those are the things that the court will have to work out. this whole idea congress needs a leg

joining us now, nbc news national political reporter, sahil kapur on capitol hill, and nbc news white housedent, mike memoli. for the most part, congress is off this week. what will democrats be focusing on during their time away from washington and what are the major issues they'll be dealing with? >> jose, the house and the senate are out of session this week, but it will be a busy week for democratic leaders, as they try to wrangle their members into an agreement on that multi-million-trillion dollar spending bill that is a priority of president joe biden. one of the dilemmas that democrats are grappling with, as they try to get to that $1.9 trillion to $2.2 trillion sweet spot is how to structure these programs, how to cut down that bill. there's one school of thought in the democratic party that you should shrink the programs to just four core programs. things like the aca, medicaid, child tax credit, and climate change. and just eliminate all the rest and do those four programs well over the long haul. there's another school of thought among progressives, who say, do all the programs,

for more on this and other top issues, i'm joined by kelly o'donnell, nbc news white house correspondent, sahil kapur, and also with us, the nbc senior analyst, ron insana, thank for being with me. ron, what do these jobs numbers tell you about our recovery or non-recovery from the pandemic? >> jose, i think they're a little misleading. the nonforeign payroll number that you referenced, had some seasonal distortions in it. there were more teachers hired in august than september because of the change in the calendar for the school year. and when you look at a separate survey that the bureau of labor statistics does, the household survey, the number of unemployed people fell by 710,000. that's what got the unemployment rate down to 4.8%. so i think the number is weaker than expected, but better than it appears. and so wall street is trying to make head or tale of this, but it does suggest that the economy is on the mend, but with still some pandemic-related disruptions in the labor force that will take some time to work out. >> that 4.8 number is always interesting. the unemployment among

the white house is expected to announce a plan to get millions of children vaccinated before the holiday travel rush. nbc news gained exclusive access to a major part of the plan. here to break it down is correspondent heidi pinterest -- przybyla. >> reporter: the white house is going to be rolling out an initiative ahead of this expected emergency use authorization of the vaccine for children ages 5 to 11. the white house realizes we are at a crossroads and we cannot get back to normal in this country unless we have a significant number of children vaccinated. even though we have a lot of vaccinated parents out there, not all of them according to the surveys they've been looking at are planning to immediately vaccinate their kids. what are they doing here? they want to set up an infrastructure where they're going to partner with children's hospitals, at least 100 to 200 of them all across the country, to set up vaccine clinics within those hospitals. this is importantly going to look very different than the drive to vaccinate adults, where we had fama setting up drive-through clinics. this is something the s
