this special counsel will deal with everything relating to mar-a-lago, the raid at mar-a-lago a few months ago and also aspects of the january 6th investigation. right now the u.s. attorney's office in washington has been dealing with a lot of this january 6th investigation so the attorney general i'm told by a justice department official will lay out specifically what this special counsel will do and will have to do involving the january 6th investigation. but back to mar-a-lago, that's interesting because former president donald trump announced just days ago he is throwing his hat in the ring once again to become president of the united states. by appointing a special council, merrick garland takes the political heat off of his plate dealing with all things donald trump, whether it be january 6th or whether it be mar-a-lago and the documents roughly 100 classified documents taken from mar-a-lago. it's important to point out that a special counsel will operate with his own office, his own staff, or her own staff, but at the end of the day, the attorney general would make any final decisio

what trump had to do today, this is about the mar-a-lago documents investigation.was there to try and convince these three judges that he was wronged when the fbi and justice department searched his home and took all kinds of documents out of there in august. the reason he's making that is because he had convinced a lower court judge, a trial level judge, to step in and basically cordon off some of the documents that were taken out of mar-a-lago. so the justice department at least now couldn't access them. and potentially in the long-term might not get access to some of that evidence. but the judges were very harsh, that there was even a role for the court there. these are some of the things that they said. one of the quotes, judge william briar, what are we even doing here? that's one thing he said. he also pressed trump's lawyer, can you cite a single decision that's allowed a court to get involved at this stage in the case? it would not be the types of things that you would want to hear if you were donald trump's legal team trying to get this through the appeals

the mar-a-lago case is a lot simpler. they've already got the documents.re are many legal experts who have said that if donald trump was anybody else, he already would have been charged. and so today, merrick garland pledged that this special counsel will have all of the resources he needs to complete his investigations, and you can interpret that as there are a lot of fbi agents already working on these cases, presumably they will now go to work for the special counsel and it may that this person has mainly charging decisions, to make rather than what we're seeing in the investigations, but you know, we'll have to see. >> ken dilanian. thank you. i will let you get back to other reporting. paul, let me bring you in for a moment for other analysis separate from the reporting that others have done and i understand you have crossed paths with mr. smith during your time as a trial attorney. what is his reputation at the d.o.j.? what should we know about him? >> he was the chief of the public integrity section where i worked as a trial attorney. we didn't over

, going so far as to execute search warrants at mar-a-lago itself. so, you know, one of the concerns you always have with a special counsel is how much delay is there going to be when you have to bring a whole new person up to speed. here at least with respect to mar-a-lago there's probably a bundle of materials that the special counsel can just read and borrow the existing apparatus of the justice department including their investigators, line prosecutors and the like so you don't have to start from scratch. with january 6th, it may be a different thing. we don't really have much window into how much the justice department has investigated with respect to high-level wrongdoing, where they certainly brought over 800 prosecutions against low-level folk who is attacked the capitol and the like. but jack smith's mandate expressly says that's not what he's to focus on. he's only to focus on the higher-ups. so it does seem like investigation there is going to have to be done, probably staff hired an the like. so they are factually very different. i would

mar-a-lago is the backdrop of legal troubles.y want to confer a degree of seriousness to what he's saying. don't expect a rally like speech. we want to talk about policy goals, legislative goals, should he become the republican nominee and should he win the presidency, and i think that's a big difference from what we have seen in the past. i think this is an attempt to kind of reset, try and kind of draw the line and try and show that he remains the republican front runner even after kind of pretty disappointing results in the midterms on tuesday. >> i will believe that it's a policy speech when i hear that it's a policy speech. hugo, last question for you. do you expect him to take swipes at any fellow republicans over what happened during the midterms considering that they are all plowing the blame his way? >> i think it's a good question. i don't think it's going to be scripted. that's not what i have heard from his team, drafting stuff down in mar-a-lago. it's trump. he can always veer off script. he has a habit of doing that

he said he'll be making a statement at mar-a-lago at 8:30. and i have to tell you i made a number of calls to members of his inner circle who were surprised to learn from me he'd be making this announcement. there was a last minute scramble, many advisers essentially telling him not to make this announcement, not to have any kind of statement here. they did not think it was thought through given it came just hours before they put it through social and there was no plan there for that, and one source in particular familiar with his thinking saying it was likely to be more of a rant than than actual statement and of course we'll be keeping an eye on that for you. >> thank you very much. and i should let you know we'll keep an eye on it and let you know if it makes actual news. perspective now from cnn's senior law enforcement analyst andrew mccabe. director, you've got some pretty unique experience in these types of matters, so how necessary here was the appointment of a special counsel to address even the appearance of a conflict of interest?

we know the former president is at mar-a-lago at his club.e is not happy with the appointment of the special council by the justice department. the attorney general said he did primarily because of trump's announcement on tuesday night that he is going to be a candidate for president in 2024, saying there was a conflict there obviously given. biden has stated his own interest in potentially running in 2024. so i would expect the former president to be critical of this. he has been essentially bracing for this knowing that this was a possibility that was out there. there had been some reporting that the justice department was considering appointing a special council. he's been likening it to robert mueller, the special counsel who oversaw the investigation into russia, and their efforts to interfere in the 2016 election. and, so, really, wolf, i would expect the president to be heavily critical of the special counsel. but his own legal team had essentially been dreading this prospect because what they believe a special counsel does is they are

thank you. >>> a major development in the mar-a-lago investigation.h patel has been granted immunity to testify about those classified and top secret documents recovered at the former president's estate. it's a powerful but many what -- but somewhat risky move. kash patel said he should declassify documents before he left office. he pleaded the fifth before the grand jury. he was designated by donald trump after the election, after the transition, to be the go-between, the liaison with the national archives for turning over documents. what does the immunity deal say about the importance prosecutors are placing on what they believe patel knows? >> it's just as you introduced the subject. when prosecutors grant a witness immunity, they are walking a tightrope. on one hand, it's an extraordinarily powerful tool in which you can compel, force a witness to go before the grand jury, even in the face of the fifth amendment right and make them testify about a crime. on the other hand, there's a risk. as you say, this immunity can be broad. the likelihood of p

i think if we're going to see an indictment in a short term, it's on the mar-a-lago case.t be a continuing investigation on the january 6 investigation, but that's a longer term process. that is a difference in the mueller investigation where we had to create a team and there was not a lot that was done. we were starting basically from scratch. that is not at all what's happening here. here he is inheriting two investigations. one that seems quite advanced, and he is inheriting what is an extremely good team. he is in a different circumstance. >> he can use the justice department prosecutors, the investigators, because otherwise he would have to hire and get national security clearances on the mar-a-lago instances for all these people. that takes a while. >> yeah. absolutely. he by all accounts will inherit the team currently in place. there's no reason not to. the agents and the prosecutors seem to be doing a fine job. they have the right experience. they actually have been steeped in the investigation. you can tell from the argument that's about to happen in the 11th cir
