let's go to cnn's kara scannell.his is part of a broader, more aggressive pushback from biden and his lawyers against a whole host of charges. tell us what this lawsuit claims beyond this. >> reporter: yeah, jim, that's right. this is part of a more aggressive legal strategy by the biden team. what they're alleging in this lawsuit is that those two irs agents turned whistleblower, gary shapley and joe feoff ziegler, went beyond what is normally allowed for whistleblowers. they're alleging in multiple television interviews, including some on cnn, they said things that went beyond what is protected, specifically getting into the details of what was on hunter biden's tax returns. here is gary shapley during a cbs interview in july -- excuse me, in june -- that hunter biden's lawyers have focused on in this lawsuit. take a listen. >> there were personal expenses that were taken as business expenses, prostitutes, sex club memberships, hotel rooms for purported drug dealers. >> reporter: those are some of the details they

cnn's kara scannell joins us now with details. if you can, breakdown, what's in this ruling? >> yeah, anderson. this is a huge loss for donald trump and for his family and his family business. the judge finding that he engaged in fraud for a decade by inflating the value of some of his more key marquee properties on -- financial statements provided a number of business hundred actions, with a judge saying that all trump's explanation for how he came up with the values for some of his assets -- he called it a fantasy world, not the real world. specifically, he singled out trump's xxx apartment at trump tower in manhattan. trump had inflated the value of that property, including just the mere -- and the judge saying that that massive discrepancy could only mean fraud. he also said that he was ordering that certificates of business to operate in new york state state be canceled, and that he would put in place a receiver to dissolve the business. exactly what that will look like remains unclear at this point. there is a lot of confusion, even among the parties, about how that wil

>> kara scannell live from new york.nk you so much. >>> i want to bring in cnn chief law enforcement and intelligence analyst john miller now. john, you were at the fbi during an investigation into senator menendez when he was in the house. tell us about that and what your reaction is to these charges. >> well, this was the 2006 investigation, which ironically, boris, was started by the then u.s. attorney in newark, who was chris christie, now presidential candidate on the republican side. but christie's investigation focused into a property that menendez was renting to another entity that he was also trying to obtain grant money from, and that case ultimately did not get prosecuted, but it was followed by the 2015 case, which was a years' long investigation into bribery allegations between menendez and a florida-based doctor. that ended in a hung jury. menendez walked away from those charges, which then led into this investigation involving the three businessmen and these alleged bribes. so senator menendez has been lit

let's get over to kara scannell. kara, tell us what the judge has decided. >> that's right, kate.esident donald trump. as you may remember he was found liable of defaming and abusing e. jean carroll for statements that he made in october of 2020. there is a separate lawsuit related to statements that trump made about the same conduct and the same statements essentially in 2019. that case is set to go to trial in january, but the judge has found now is that the jury's verdict holds on finding that these. stays both in 2019 and in 2020 were defamatory. so that is something that this new jury will not have to find. in other words, the judge saying that the jury in this case coming up in january will only have to make the decision of how much money donald trump will have to pay e. jean carroll in damages for the statements that were defamatory. so they're going into this trial with that conclusion already made, that the statements trump made when he was president denying allegations that he had sexually assaulted e. jean carroll in the mid-1990s and his denials that he even knew her a

it's slated to start next week let's get more on that from kara scannell. >> the witness lists have come out from both the new york attorney general and trump's defense team. both of them have put donald trump, his adult sons, on the list as potential witnesses that both sides might call in this case. they are defies in the case. they are at the center of the case. the issue of the inflated financial statements, which the judge earlier this week ruled were fraudulent and said that the company and these individuals had engaged in persistent fraud. now the question is, will they actually be called as witnesses. these witness lists are put up there because if they don't put someone on the list, they can't call them. there certainly was a lot of eagerness for trump to testify that he wanted to. but this can change always as a case is playing out. and given that the judge has found against the trump organization, there's a question of whether he would want to testify in his own defense. the a.g. could compel had him to testify. he also sat for a video tape deposition. he said he had little, i

cnn's kara scannell is outside of the courthouse in new york, and what are you learning?n. as you say the senator and his wife and three new jersey businessmen are indicted on corruption-related charges. what the authorities are alleging is that menendez and his wife had accepted hundreds of thousands of bribes and used that to affect influence. these are some of the details that we are learning from indictment. authorities had executed a search warrant on the senator's home in new jersey in june of 2022 and on safety deposit boxes they had, and what they found when they executed the search warrant was $480,000 cash in envelopes and stuffed in jackets, including jackets that say the senator's name on them. we also learned they had gold bars they had received from some of the businessmen and in the envelopes of cash, they found the dna of another one of the businessmen with them, and another with businessmen of the menendez' and they had received payments for a home mortgage and no-show jobs and also that luxury vehicle. what we have also learned from the indictment is so

kara scannelle is now gives us a sense of why biden is going to sue now, and there was a plea deal ofrs? >> this is a bolder legal defense here and suing irs, and filing a lawsuit saying that through the agency, and the two whistle-blowers, that they disclosed private informationa and that the irs did not do a good job to safeguard the information. they are saying that the whistle-blowers went beyond what is expected from the statue of the whistle-blower to go forward. in the lawsuit, they are saying that the witnesses with the whistle-blower label does not allow them to make disclosures of the process. the whistle-blower is to uncover the cop duct and not the employee's opinion of the wrongdoing of a private person. so in this, they point to a number of public opinions where, including on cnn, they are talking about their thoughts of the investigation that hunter biden has received favorable treatment. they talk specifically about what they say that hunter biden had in the tax returns in that he was taking as personal expense, and marking them as business expense, and including prost

i want to bring in cnn correspondent kara scannell, also cnn legal analyst and prosecutor elliott williamsral prosecutor and contributing writer for political -- i'm glad you're all with us, i want to begin with you here kara, because help us understand. we remember this plea deal, something that really imploded in the courtroom, but how did we get from that implosion to these serious charges so soon after it all fell apart? >> yeah, this plea deal that was initially announced in june was hunter biden would have pled guilty to two tax misdemeanor charges and then avoided prosecution on the gun possession charge if he agreed to meet certain conditions for a period of 24 months. the republicans in the house had to said that that appeared to be a sweetheart deal, then when he showed up in court in late july the judge had a lot of questions about it. she had questions about how it was structured and whether it was constitutional, so she told both sides, the government and hunter biden's team, to go back and try to work it out. in that time, and that is when then u.s. attorney david weiss, a tr

cnn's kara scannell broke that reporting. she joins me now.rt filing say, and when could we see hunter biden actually appear in court? >> hunter biden's attorneys are asking for a remote first appearance on the felony gun charges saying he's not asking for special treatment and that some other defendants in the district of delaware have appeared remotely, but they're saying that they don't need a lot of time for him to enter a plea of not guilty. they also note that hunter biden had previously appeared in court when his plea deal fell apart on the tax misdemeanor charges and at the time, he was finger printed and had his mug shot taken. he's saying he doesn't need to be processed. since biden is protected by the secret service, that requires a lot more protections, security parameters have to go into place, requiring a local law enforcement that brings him in for a hearing that will be relatively brief. this is up for the judge. the prosecutors oppose this. their filing is due tomorrow, and then the judge will decide whether biden will have hi

cnn's kara scannell joins us with more. what more are you learning?were just going to get a status report in this case but special counsel's office is saying, we will move forward with an indictment related to this gun possession by the end of this month, by september 29th. that is a pretty significant development. one reason maybe because the developments around the gun possession expires and october. they have to move quickly. >> they have not been doing a whole new investigation. the plea deal fell apart so they decided that we are going to go and charge it? >> yeah. this is a fairly straightforward issue. he possessed the gun, and filled out paperwork while he was addicted to cocaine. that is against the law. he falsified the document by saying that he wasn't. >> it is illegal to falsify the document. >> both of those are legal, he has acknowledged this in court and he is prepared to plead, so it is a fairly open and shut case. it is just a question of what he will charge them with, because you have this deal that was a pretrial diversion meeting,

kara scannell has the latest. >> some of the cash was stuffed in the senator's pockets. >> reporter:ainst. bob menendez facing corruption charges. prosecutors announcing a three-count federal indictment against the democratic senator and his wife over their dealings with three new jersey associates and businessmen starting in at least 2018. >> the senator and his wife accepted hundreds of thousands of dollars of bribes. in exchange for senator menendez using his power and influence to protect and to enrich those businessmen. >> reporter: the alleged bribes include more than $550,000 in cash hidden in the senator's home and safe deposit box. a mercedes-benz convertible and gold bars worth tens of thousands of dollars among other things. the indictment also alleges the senate foreign relations committee chair, quote, provided sensitive u.s. government information and took other steps that secretly aided the government of egypt. >> behind the scenes, senator menendez was doing those things for certain people. the people who were bribing him and his wife. >> he issued a defiant statement

. >> all right, kara scannell, thanks. and with me here is cnn legal -- who is a former manhattan chief assistant district attorney. also with us, criminal fence attorney mark -- and, cnn senior law enforcement analyst andrew mccabe, former deputy director of the fbi. caroline, let's start with you, what about these charges, what do you make of? them? >> i mean, i think they had to bring this case, because the statute of limitations was running. and when the deal fell apart, it was either you walk away from it, or you bring the case in order to preserve the status quo. i do think that there will be some significant legal hurdles, that they face, by making the decision to bring this case. however, there is a real constitutional question about whether these charges can stick. there is at least one, potentially to appellate courts, that aren't binding on delaware, but that have already ruled that this infringes on second amendment rights. and, the supreme court has been saying, some restrictions like this are potentially unco

kara scannell has reporting on this and joins us this morning. there are so serious that if convicted, he could face prison time. yeah i mean, these charges have a maximum of sentence of 20 years in prison that doesn't normally happen for someone, especially a first time offender. >> but they are serious charges and, you know, the eyes now are on menendez and what's going to happen this week. and so we are expecting he may give a press conference today. new jersey.com is reporting that citing someone familiar with his plans. so we're waiting to see if he does. but he has been defiant. so there's no belief that he's going to change his mind and resign at this point. you know, he is due in court on wednesday. there is a summons for him. his wife and the three co-defendants to appear. it's possible he will be arraigned on those charges. then, you know, he has made it very clear he's, you know, believes he's going to fight this. right. i mean, he's saying he's not going anywhere. he's not stepping down. and this is the second time in a decade that me
