that went to the supreme court and the supreme court upheld the law as the proper law, not violate not -- not in violation of the constitution. since then there has been a seachange throughout the country and in new york that had its own three strike law where we are not doing that anymore. you will find that even if it is technically on the books that you are not going to have three strikes be imposed, if somebody committed three very violent felonies, of course that would be a factor but it is not mandatory anymore, and that -- not implied in new york state anymore that simply if someone has three felony convictions, regardless of the nature of conviction, that they had to be put in jail for life. so i had to sentence walter johnson 28 years ago to life because, at that time, the three strikes law was enforced in new york and i had no choice but to do that. today we do not do that anymore, there has been a change. so one of the important things about this whole concept of giving people a second chance is to realize that in the passage of time, things do not stay static. laws change.
