senator al franken, thank you so much for being here and starting us off tonight.ore on today's decision i am joined by melissa murray professor at new york university school of law, and former supreme justice. when she was on the court of appeals for the second circuit. melissa, can you break down for us the quartz reasoning in today's ruling on obamacare? >> it is a very technical opinion and doesn't focus at all on the merits of this case whether the aca is in fact unconstitutional,. it focuses on the right of the plaintiffs here, the individual plaintiffs and a group of states to bring this in federal court. the decision was on standing, this idea that federal plaintiffs need to have standing and true injured to bring their case and federal court and here it was determined that there was no injury that could be addressed by federal court adjudication, it was a very technical jurisdictional opinion. it doesn't address the merits of the case at all. >> how surprising though is it to see so many justices joining the majority on this case? >> that actually was quit

and the former minnesota senator, al franken.be confused thinking this is a vote about s-1. about the for the people act. it is not. it is just a procedural vote. can you explain what happens when as we know will happen, that bill dies because it only gets maybe 50 votes? maybe 40, 49, 50 votes? >> well, of course, this is not a bill that we can pass through reconciliation like we did the relief act. so this immediately brings to question the filibuster and i was encouraged that joe manchin in this audio that was released the other day by the intercept, has said that he is open to a modification of the filibuster, and we've been working on a modification that would basically right now, you need 60 votes to break a filibuster. this would put the burden on those filibustering and 41 would have to come to the floor. and they would have to stay on the floor. they would have to stay there, the 41, and they would have to debate. and it would have to be germane. i would like to see them defend why it is a crime to give someone water wai

the one that al franken and i have proposed, including talking filibuster elements so you put the burden on the minority. moving the number to 55. and in an ideal world, also making that present and voting. ways as he said himself that shift the burden back to the minority. they're not going to want to have those burdens. we're still a little ways away from actually getting the right strategy and the right approach that all the democrats would support. you'll need all 50 and the vice president in the chair. but we're getting much closer. and i think it's 100% clear that we will get no more than one or two votes, if any, among the republicans for this very reasonable bill in which manchin tried to reach out to them with the voter i.d. issue. and then we're on a path towards something positive. and it would be something that should make us all very happy. >> carson allred, we've come a long way from some democrats during the presidential primaries thinking that joe biden was still working in the old world where you could do business with mitch mcconnell. there he was yesterday saying that

al franken and norm ornstein have a proposal that would force the minority to put up 41 votes and hold the floor and hold the floor or lower the threshold to 55. you know these senators. is that something they could get manchin and sinema to go along with you think? >> never say never. i think there is some reform they would consider. certainly making people own the filibuster rather than calling it from their office and saying, i object and never having to show their face or identify who they are, i any that's something. i think some of the reforms, joy, that have been talked about where, if a bill comes out of committee on a bipartisan vote, it goes to the floor for debate and amendment, period. and that way, if you get some republicans votes in committee, then you're assured that it isn't going to get buried somewhere behind mitch mcconnell standing up and saying no, we won't do it. i think there are some reforms. just keep in mind, if chuck schumer does this over and over again and he adds in gun safety, and he adds in some things like help with day care and elder care and he adds

i know that there is former senator al franken is part of an effort to come up with things like having 41 votes to hold a filibuster or having people hold the floor. are those conversations going on in the democratic caucus, including manchin and sinema saying maybe we add some of these things but at least it would be more realistic than trying to find ten republicans to do anything? >> i just don't think that's realistic when it comes to voting rights and i want to make that clear. it may be on other things. but they instead of changing their candidates or changing their views on issues or changing how they talk to people, they double down on it. now they're saying we want to change the voters. in the words of reverend warnock in his maiden speech, some people don't want some people to vote. so the answer to me is look at these senate rules, figure out what we can do to move ahead and as senator schumer said many times, failure is not an option. the exciting news for me from listening to your program is that there is so much work even outside of us taking our rules committee out on th

much of the work that i've done, along with al franken, has been aimed at trying to get joe manchin tod say, we're not ending or weakening the filibuster, we're restoring it while we're actually doing something that's going to provide opportunities to vote and to put the burden on the minority where it belongs. and i think the actions today demonstrating that not a single republican actually deviated from this rhetoric of states' rights. i'd love to go back and look at what richard russell and james eastland and george wallace said about the sanctity of states and their own voting places, which parallels what the republicans were saying today. not a single one went along. not one other than senator murkowski has gone along with joe manchin as effort to get john lewis voting rights act somewhat comes next is to have one or two or three more examples to show the republicans are going to unite together to block everything that democrats want that's meaningful and that it's time to bring about a change. and hopefully you can have to same kind of argument with sinema that we're not going to
